A pre-inspection briefing was held on Wednesday, January 29, 2025, and the following facility was inspected between Tuesday, February 25, 2025 and Monday, March 3, 2025: FACILITY NAME BSCC # FACILITY TYPE Berkeley Public Safety Center 0165 I This inspection was conducted pursuant to Penal Code Section 6031 to determine compliance with the Minimum Standards for Local Detention Facilities as outlined in Titles 15 and 24, California Code of Regulations. In addition to inspection(s) by the Board of State and Community Corrections (BSCC), inspections are also required annually by the City Health Officer and biennially by the State Fire Marshal or an authorized representative (Health and Safety Code Sections 101045 and 13146.1). The results of those inspections are considered a part of this report. At the time of the BSCC inspection, the Medical and Mental Health Inspection required by the Health and Safety Code Section 101045 had not been completed since 2023. It is recommended that your staff coordinate with the City Health Department or County Health Department to complete this requirement. INSPECTION RESULTS We identified the following items of noncompliance with Title 15 Minimum Standards: Title 15 § 1032 Fire Suppression Preplanning: (b)monthly fire prevention inspections by facility staff with two-year retention of the inspection record. Fireprevention inspections were not documentedfor three months. Since January 2025, the new manager has reinitiated the inspections. Use of the Safety Cells during the last year did not include the documented reasons for placement in the cells. Refer to the attached Procedures Checklist for detailed information.
