Section Description (c) fire prevention inspections as required by Health and Safety Code Section 13146.1(a) and (b) which requires inspections at least once every two years; § 1032. Fire Suppression Preplanning The agency was unable to provide documentation of a State Fire Marshal or local fire authority inspection of the temporary holding facility. (c) In deciding housing and programming assignments, the agency shall consider on a case-by- case basis whether a placement would ensure the health and safety of the incarcerated person, and whether the placement would present management or security problems. A person’s own views with § 1050. Classification Plan respect to their own safety shall be given serious consideration. BSCC staff reviewed intake questions and found there were no questions regarding the person’s own view with respect to their own safety while in custody. At the time of intake into the facility, an inquiry shall be made of the person being booked as to whether the person has or has had any communicable diseases, such as tuberculosis or has observable § 1051. Communicable Diseases symptoms of tuberculosis or any other communicable diseases, or other special medical problem identified by the health authority. Section Description BSCC staff reviewed intake questions and found there were no questions regarding communicable diseases or symptoms. Technical Assistance Provided BSCC Staff provided an outbrief to the Operations Captain and Facility Supervisor. Current Minors in Detention forms and video were suppled to assist the agency with meeting requirements for holding minors in temporary holding facilities. Additional Information (1) There was violations of Welfare and Institutions Code, Section 207.1(b)(1)(F) Logs: A log or other written record is maintained by the law enforcement agency showing the offense that is the basis for the secure detention in the facility, the reasons and circumstances forming the basis for the decision to place the minor in secure detention, and the length of time the minor was securely detained. There was one minor held in secure confinement and a secure detention log was not completed. Additionally, several of the Minors In Non-Secure confinement entries were not thoroughly completed or reviewed for accuracy by supervisors. (2) Additionally, the evidence dryer/refrigerator stored in the shower should be removed because it is blocking it’s use by persons that maybe contaminated with chemicals or infested with vermin.
