A pre-inspection briefing was held on Tuesday, September 19, 2023, and the following facilities were inspected on September 25, 2023. FACILITY NAME BSCC # FACILITY TYPE Del Norte County Jail 0640 II Del Norte Court Holding 0645 CH These inspections were performed pursuant to Penal Code Section 6031 to determine compliance with the Minimum Standards for Local Detention Facilities as outlined in Titles 15 and 24, California Code of Regulations. In addition, Board of State and Community Corrections (BSCC) staff conducted compliance monitoring pursuant to Welfare and Institutions Code Section 209(f) and the federal Juvenile Justice and Delinquency Prevention Act (JJDPA). In addition to the inspections by the BSCC, inspections are also required annually by the County Health Officer and biennially by the State Fire Marshal or an authorized representative (Health and Safety Code Sections 101045 and 13146.1). The results of those inspections are considered a part of this report. The Environmental Health and the Medical/Mental Health inspection reports noted deficiencies. Your staff is working through a corrective action plan with those agencies to correct the issues. Most of the issues noted in the Environmental Health Report have had work orders since the agency's last BSCC Comprehensive Inspection on November 4, 2021. Garrett Scott Sheriff Page 2 BSCC INSPECTION The inspection consisted of a review of the Del Norte County Sheriff's Office Custody Policy and Procedure Manual, a site visit to review operations, physical plant, and relevant documentation, and interviews with administration, facility staff, inmates, and collaborative partners. INSPECTION RESULTS We identified the following items of noncompliance with Title 15 Minimum Standards: Del Norte County Jail § 1027 Number of Personnel The agency is noncompliant with this regulation due to insufficient staffing to ensure the implementation and operation of the required programs and activities. § 1027.5 Safety Checks BSCC staff reviewed a sampling of safety check documentation from May 2023 through August 2023. During the documentation review, BSCC staff determined the agency is noncompliant with this regulation due to not routinely completing safety checks within the 60-minute time requirement of this regulation. § 1053. Administrative Separation BSCC staff determined the agency is noncompliant with this regulation due to having no current documentation to evaluate the need to continue placement in administrative separation. § 1056. Use of Sobering Cell BSCC staff determined the agency is noncompliant with this regulation due to eight out of twenty-two reports reviewed documenting safety checks not being routinely completed with the thirty-minute time requirements of this regulation. § 1067. Access to Telephone BSCC staff has determined the agency is noncompliant with this regulation due to the agency not having devices for those individuals who are known to have or are perceived by others as having hearing or speech impairments. § 1065. Exercise and Out of Cell Time During the documentation review, BSCC staff determined the agency was noncompliant due to not consistently documenting three hours of exercise and an opportunity for seven hours of recreation for administratively separated persons. 0640 0645 Del Norte Sheriff’s Office LTR 23-24 Garrett Scott Sheriff Page 3 Del Norte Court Holding § 1032. Fire Suppression Preplanning During the documentation review, BSCC staff determined the agency is noncompliant with this regulation due to not having a two-year retention of documented monthly fire inspections for the courthouse. The agency has not completed monthly fire prevention inspections by facility staff for the courthouse from January through July 2023. Refer to the attached Procedures Checklist for detailed information. We identified two items of noncompliance with Title 24 Minimum Standards: Del Norte County Jail § 1231.2.22 Audio monitoring system The two sobering cells are noncompliant with this regulation because the intercoms are out of service. § 1231.3.9 Mirrors The agency is noncompliant due to not having mirrors in housing cells J1-J4, J8, and G module. Refer to the attached Physical Plant (PHY) and Living Space Evaluation (LASE) for each facility for information related to Rated Capacity. Juvenile Justice and Delinquency Prevention Act Compliance Monitoring We found no violations of the JJDPA for the Del Norte Sheriff’s Office facilities. A copy of the monitoring report is attached for your information. CORRECTIVE ACTION PLAN (CAP) An Exit Briefing with your staff was held on September 25, 2023; BSCC staff presented an inspection overview and discussed technical assistance and best practice recommendations. BSCC staff reviewed and provided an Initial Inspection Report for noncompliance items found during the inspection.
