January 18, 2023 Scott Fairfield, Chief of Police Bell Gardens Police Department 7100 Garfield Ave Bell Gardens, CA 90201 2020-2022 BIENNIAL INSPECTION OF BELL GARDENS POLICE DEPARTMENT TYPE I JAIL FACILITY, 6031 PC & 209 WIC Dear Chief Fairfield: On November 14, 2022 staff of the Board of State and Community Corrections (BSCC) conducted the biennial inspection of your agency’s Type I Jail Facility. Pursuant to Penal Code Section 6031, this inspection was performed to determine compliance with the Minimum Standards for Local Detention Facilities as outlined in Titles 15 and 24, California Code of Regulations (CCR). In addition, BSCC staff conducted compliance monitoring pursuit to Welfare and Institutions Code Section 209(f) for the federal Juvenile Justice and Delinquency Prevention Act (JJDPA). The complete BSCC inspection report is enclosed and consists of: this transmittal letter; the Title 15 Procedures Checklist outlining applicable minimum standards for the facility; the Physical Plant Evaluation outlining Title 24 requirements for design of the facility; the Living Area Space Evaluation summarizing the physical plant configuration and showing the capacity of the facility. Refer to the Title 15 Checklist for indication of compliance status and evidence used to determine compliance. We encourage the practice of maintaining a permanent file for historical copies of all inspections that would also include documentation of corrections made following the inspection. This file should be the first point of reference when preparing for all future inspections. LOCAL INSPECTIONS In addition to the biennial inspection by the BSCC, inspections are also required annually by the County Health Department and biennially by the State Fire Marshal or an authorized representative (Health and Safety Code Sections 101045 and 13146.1). Please consider our report in conjunction with the reports from the County Health Department and the respective fire authorities for a comprehensive perspective of your facilities. Local inspection reports are forwarded to your department under a separate cover. The fire and local health inspections are current. There was no noncompliance noted. Please refer to the Procedures Checklist for detailed information. Title 24, CCR Physical Plant There were no changes made to the physical plant. We found no items of noncompliance. Please refer to the Physical Plant Checklist for detailed information. Juvenile Justice and Delinquency Prevention Act Compliance The BSCC monitors local detention facilities for compliance with JJDPA. Secure and nonsecure youth are held in the juvenile area which is outside the jail facility. 12 months of Juvenile Detention Logs were reviewed. One nonsecure youth was detained for 10 hours. The livescan system was down and did not reboot for several hours. The county Juvenile Hall would not accept any youth without a livescan report and a Department of Justice record. --- This concludes our inspection report for the 2020-2022 biennial inspection cycle of the Bell Gardens Police Department’s Type I Jail Facility. If you should have any questions, please contact me at (916) 956-5968 or email at michael.bush@bscc.ca.gov. Sincerely, 1 BSCC reviews only those policy and procedures required by, and applicable to, Title 15, CCR. BSCC staff do not “approve” policies and procedures or assess them for constitutional or legal issues. Agencies should seek review through their legal advisor, risk manager, and other persons deemed appropriate for such evaluation. 1950 Los Angeles Bell Gardens PD I LTR 20-22 Scott Fairfield Chief of Police Page 3 MICHAEL BUSH Field Representative Facilities Standards and Operations Division Enclosures cc: City Manager, City of Bell Gardens* Presiding Judge, Superior Court, County of Los Angeles* Grand Jury Foreman, Superior Court, County of Los Angeles* * Complete copies of this inspection are available at www.bscc.ca.gov 1950 Los Angeles Bell Gardens PD I LTR 20-22 TYPE I FACILITIES Board of State and Community Corrections PROCEDURES1 BSCC Code: 1950 FACILITY NAME: Bell Gardens Police Department FACILITY TYPE: I PERSON(S) INTERVIEWED: Jail Supervisor Katheryn Astudillo FIELD REPRESENTATIVE: Michael J.
