Section Description During the documentation review, BSCC staff determined safety checks were reviewed at regular defined intervals by a supervisor or facility manager. The agency was found noncompliant because there § 1027.5 Safety Checks was no manner to verify the review included methods of mitigating patterns of inconsistent documentation, or untimely completion of, safety checks as the regulation requires. BSCC staff determined the agency in noncompliant with this regulation for not having their Operating § 1029. Policy and Procedures Manual Procedures (OP) reviewed and updated at least every two years. After the documentation review, BSCC staff determined the agency is noncompliant as the safety checks for safety cell placements do not involve § 1055. Use of Safety Cell variance and several safety checks lapsed 15- minutes between each check, making the agency late with conducting observations twice within thirty minutes. After the documentation review, BSCC staff determined the agency is noncompliant with this § 1056. Use of Sobering Cell regulation as there were vague evidence incarcerated people were placed in sobering cells for their safety Napa County Department of Corrections Initial Inspection Report Page 2 Title 15. Use of Sobering Cell – Continued sobering cell was evaluated after six hours to determine if an urgent medical problem exists. BSCC staff also determined the agency does not involve variance while conducting their safety checks for sobering cells. Most of the observation logs provided indicated NCDC’s personnel primarily conduct exact 15 and 30-minute checks. During the documentation review, BSCC staff found the agency’s process for logging recreation time was not thoroughly documented in the unit logbooks for § 1065. Exercise and Out of Cell Time general population housing. This makes it difficult to account for the seven hours of required recreation per a period of seven days. Title 24. Section Description The agency is noncompliant with this regulation as the 1231.2.5 Safety cell first-floor safety cell in the intake area is short of the required 48 square feet. *Multiple Occupancy Cells (8227) 1973 standards: On 1231.2.7 Double-occupancy cells the day of inspection, housing area in SJ 226B Module was over its rated capacities. On the day of inspection, housing area SJ M112 1231.2.8 Dormitories Module was over its rated capacity. During the walkthrough of the facility, stack-a-bunks or temporary plastic beds were utilized throughout the 1231.3.5 Beds facility. These temporary plastic beds were not elevated off the floor and are not securely fastened to the floor or wall. During the walkthrough of the facility, BSCC found additional bunks were added into some single, 1231.3.5 Beds double, and multiple occupancy cells. These bunks were not securely fastened to the floor or wall.
