A pre-inspection briefing was held on Wednesday, July 31, 2024, and the following facilities were inspected on October 28, 2024: FACILITY NAME BSCC # FACILITY TYPE Central Men’s Jail 3480 II Intake Release Center 3490 II Central Women’s Jail 3500 II Theo Lacy 3560 II These inspections were conducted pursuant to Penal Code Section 6031 to determine compliance with the Minimum Standards for Local Detention Facilities as outlined in Titles 15 and 24, California Code of Regulations. INSPECTION RESULTS During the Targeted Inspection, we identified the following items of noncompliance with Title 15 Minimum Standards. Title 15 § 1027.5 Safety Checks, Subsection (d): Safety checks shall occur at random or varied intervals. BSCC staff reviewed safety check documentation and found safety checks were logged at 45-minute intervals at both the Central Men’s Jail and Central Women’s Jail. Title 15 § 1065. Exercise and Out of Cell Time, Subsection (1): An opportunity for three hours of exercise… Don Barnes Sheriff-Coroner Page 2 BSCC staff reviewed recreation logs and found Barrack housing at Theo Lacy lacked documentation that an opportunity for three hours of exercise was offered. Refer to the attached Procedures Checklist for detailed information. Refer to the Physical Plant Evaluation and Living Area Space Evaluation attachments for information related to Rated Capacity and Title 24 compliance (See Pending Items of Noncompliance below for remaining items found during the 2023 Comprehensive Inspection.) The following regulations were found to be noncompliant with Title 24 Minimum Standards during the BSCC’s Comprehensive Inspection conducted on November 13, 2023, and continue to remain noncompliant as of this Targeted Inspection. Corrective action and follow-up for these noncompliance findings occur separately. Central Men’s Jail: Title 24 § 1231.3.11 Table/Seat – Insufficient tables and seats for the rated capacity in Ward C, Ward D, and Dorms 5 & 6. Central Women’s Jail: Title 24 § 1231.3.11 Table/Seat – Tank 13 and 14 have insufficient seating and tables for the rated capacity. Intake Release Center: Title 24 § 1231.2.22 Audio Monitoring System – There is no audio monitoring system in the intake holding cells. Theo Lacy: Title 24 § 1231.2.7 Double-occupancy cells – Module I, J, K, and L have cells less than 70 sq. ft. (The agency is not housing incarcerated people in these cells.) Title 24 § 1231.2.8 Dormitories – Barracks F, G, and H were populated over their rated capacity. Title 24 § 1231.3.1 Toilets/urinals – Barracks F, G, and H were populated over their rated capacity and with insufficient fixtures per the person to toilet ratio. Title 24 § 1231.2.9 Dayrooms – Barracks F, G, and H were populated over their rated capacity. Title 24 § 1231.2.22 Audio monitoring system – The Receiving Area/Booking Loop does not have audio monitoring in holding cells. 3480+ Orange County Sheriff’s Office II Targeted LTR 23-24 Don Barnes Sheriff-Coroner Page 3 CORRECTIVE ACTION PLAN (CAP) An Exit Briefing with your staff was held on Tuesday, December 3, 2024; BSCC staff presented the Targeted Inspection overview and discussed technical assistance and best practice recommendations. An Initial Inspection Report (IIR) outlining the identified areas of noncompliance was provided to your staff. On December 16, 2024, Orange County supervision submitted safety check logs from the Central Men’s Jail and Central Women’s Jail for BSCC review. The agency staff advised they implemented new technology for logging safety checks. After review, BSCC staff determined the agency is now in compliance with Title 15 Section 1027.5, Subsection (d) as safety checks are being conducted in random or varied intervals. Agency supervision advised they are addressing the second item of noncompliance regarding recreation logs at the Theo Lacy facility.
