Mission Street San Jose, CA 95110 2020-2022 BIENNIAL INSPECTION OF SAN JOSE POLICE DEPARTMENT TEMPORARY HOLDING FACILITY, 6031 PC & 209 WIC Dear Chief Mata: On October 17, 2022, staff of the Board of State and Community Corrections (BSCC) staff met with Captain Jaime Jimenez, Sergeant Kevin Sebree, and Officer Paulo Paredes to conduct the 2020-2022 biennial inspection of the San Jose Police Department’s Temporary Holding Facility for adult arrestees and the department’s Youth Process Center for youth being detained. Pursuant to Penal Code Section 6031, this inspection was performed to determine compliance with the Minimum Standards for Local Detention Facilities as outlined in Titles 15 and 24, California Code of Regulations (CCR). In addition, BSCC staff conducted compliance monitoring pursuit to Welfare and Institutions Code Section 209(f) for the federal Juvenile Justice and Delinquency Prevention Act (JJDPA). During the inspection, BSCC staff was informed that the agency is no longer operating a local detention facility as all locks have been removed from each holding cell, which was verified. The detention area is now referred to as the “Process Center.” When an arrestee enters the area, they will be “processed” in front of the sergeant desk and be immediately transported next door to the County Jail, or a detective will interview the arrestee in one of the four interview rooms. For the Youth Process Center, we have verified that locks have been removed from each holding room and all locked doors leading from the process center to the outer building and onto the street have been replaced with a “push bar.” The push bar will allow an individual to walk out of the center and onto the street without assistance. With the changes to the detention facility, the agency will no longer be inspected biennially by the BSCC. Please notify us if your facility’s status changes. As for the Youth Process Center, we will indicate that the agency holds “Non-Secure” Minors only. Anthony Mata Chief of Police Page 2 Juvenile Justice and Delinquency Prevention Act Compliance The BSCC monitors law enforcement agencies for compliance with JJDPA. Minors are held in “non-secure”, away from sight and sound of adult prisoners.
