2023 BSCC CORRECTIVE ACTION PLAN (CAP) FOLLOW-UP AND UNANNOUNCED
INSPECTION OF THE TEHAMA COUNTY TYPE II JAIL
Dear Sheriff Kain:
On July 3, 2023, Board of State and Community Corrections (BSCC) staff conducted a
follow-up to the Tehama County Sheriff's Office Corrective Action Plan (CAP) and
conducted an Unannounced Inspection of the jail to determine compliance with the
Minimum Standards for Local Detention Facilities as outlined in Title 15, California Code
of Regulations. The focus of the inspection was to verify the corrective actions your
agency has taken to correct the one remaining item of noncompliance (§1070
Individual/Family Service Programs) from your 2023 Comprehensive Inspection and to
review Title 15 regulations §1055 Use of a Safety Cell and §1056 Use of a Sobering Cell.
During the onsite inspection, Sgt Jones informed BSCC staff that the tablet provider had
installed the programming module. BSCC staff had an incarcerated person explain and
demonstrate the access and programs offered on the tablets. BSCC staff noted the
following program categories: Academic, Job & Finance, Health & Recovery, Arts/Culture,
Reentry, Spirituality, and Español. Each category had several subcategories, for
example, Parenting, Personal Growth, Prepare for Success, and Returning to Citizens.
Sgt. Becker also informed BSCC staff that your agency is waiting on community program
providers to return their paperwork to start in-person programming.
After completing the review of programming options on the tablet and interviews with staff
and an incarcerated person, BSCC staff has determined your agency is now in
compliance with Title 15 Regulation §1070 Individual/Family Service Programs.
BSCC staff also reviewed a random sampling of written sobering and safety cell reports
for compliance with Title 15 regulation sections:
§1055 Use of a Safety Cell. The safety cell described in Title 24, Part 2, Section 1231.2.5,
shall be used to hold only those people who display behavior which results in the
destruction of property or reveals an intent to cause physical harm to self or others.

§1056 Use of a Sobering Cell. The sobering cell described in Title 24, Part 2, Section
1231.2.4, shall be used for temporary holding of incarcerated people who are a threat to
their own safety or the safety of others due to their state of intoxication.
After reviewing a random sampling of sobering and safety cell written reports, BSCC staff
has determined your agency complies with the above-listed Title 15 regulation sections.
