§ 1027. Number of Personnel
A sufficient number of personnel shall be employed in
each local detention facility to ensure the
implementation and operation of the programs and
activities required by these regulations.

BSCC staff reviewed the facilities staffing plan,
available personnel, safety checks, and programs.
The facility is operating with less than 70% of
budgeted line staff. Due to the limited availability of
staff, the agency has not been meeting the new
requirements for §1065, Exercise and Out of Cell
Time.
§ 1065. Exercise and Out of Cell Time.
(a) The facility administrator of a Type II or III facility
shall develop written policies and procedures for a
minimum of 10 hours of out of cell time distributed
over a period of seven days to include:

(1) an opportunity for three hours of exercise and
(2) an opportunity for seven hours of recreation.
Policies shall include reasonable and necessary
procedures to ensure safety and security.
BSCC staff reviewed April and May 2023, out of cell
time and access to exercise. Using the facility’s

current documentation of exercise and out of cell
time, staff was unable to verify that all persons in
custody are receiving the ten hours required in this
section.
Technical Assistance Provided
Discussed current recruitment and retention efforts. Reviewed plans to improve tracking and
documentation of exercise and out of cell time. Provided the agency with a sample corrective action
plan (CAP) for submission back to BSCC in 30 days.
Additional Information
The agency is in the process of recruitment and selection. Two recruits are to begin training in the
next week and seven are in backgrounds as part of the selection process. Finally, the agency is
conducting on going testing, increase salaries, and added incentives.
