July 28, 2021 Wayne Barley, Chief Probation Officer Butte County Probation Department 42 Country Center Drive Oroville, CA 95965 BUTTE COUNTY 2020-2022 BIENNIAL INSPECTION PURSUANT TO WELFARE AND INSTITUTIONS CODE SECTIONS 209 AND 885 Dear Chief Barley: The 2020-2022 biennial inspection of the Butte County Probation Department’s Juvenile Hall and Camp Condor has been completed. A pre-inspection briefing was held on April 27, 2021; the facility inspections occurred between July 19th and July 21st, 2021. The complete Board of State and Community Corrections (BSCC) inspection report is enclosed and consists of the following: this transmittal letter; a Title 15 Procedures checklist, outlining applicable minimum standards for juvenile detention facilities; a Physical Plant Evaluation, outlining applicable Title 24 minimum standards; and the Living Area Space Evaluation (LASE), summarizing the physical plant configuration and outlining the rated capacity of the Juvenile Hall and Camp Condor. Please refer to the Title 15 Procedures checklist for a summary of all relevant minimum standards, indication of compliance or noncompliance, and information that was used to determine compliance. Mandatory Local Inspections In addition to the biennial inspection, Title 15, section 1313, and its authorizing statute also require local inspections conducted by the following local authorities: • county building inspector or person designated by the Board of Supervisors • fire authority having jurisdiction • local health officer • county Superintendent of Schools • Juvenile Court • Juvenile Justice Commission. Results of those inspections are considered a part of this report. The dates of the local inspections may be found in the accompanying Procedures Checklist. Chief Barley Page 2 7/28/2021 Scope of the Inspection The inspection consisted of a review of the Juvenile Hall and Camp Condor Policy and Procedure Manual1, a site visit to review operations, physical plant and relevant documentation, and interviews with administration, facility staff, youth, and collaborative partners. During the inspection, we evaluated consistency between policy and practices. Inspection Results Title 15, CCR Minimum Standards Upon final review of all documentation, there are no outstanding items of noncompliance with Title 15 at the Juvenile Hall or Camp Condor. No corrective action is required at this time. During the inspection process, we discussed several policies and procedures with staff and provided technical assistance and best practice recommendations which might bring more clarity and specificity to the facility policy and procedure manual. In particular, we discussed Title 15 sections 1354 “Separation” and 1370 “Education.” Our discussions pertained to youth who are placed on Administrative Separation (AD-SEP) due to continuously creating an unsafe environment for themselves, other youth, and the facility. It should be noted youth placed on AD- SEP are provided with Title 15 minimum requirements with regards to recreation and programming but are separated from the group. At the time of the inspection, youth placed on AD-SEP needed to achieve five (5) four-hour blocks of good behavior before being removed from AD-SEP and returning to normal programming with the group. During our discussions of the AD-SEP program we recommended revising the practice of youth needing to achieve five (5) four-hour blocks of good behavior to youths on AD-SEP returning back to normal programming with the other youths once the youth is no longer a threat to the safety and security of the facility. Our other discussions pertained to AD-SEP youth who are unable to attend school in the classroom due to safety concerns. Those youth must be provided with an educational packet and a location outside of the youth’s locked room to complete their schoolwork. If a youth requested to complete their educational packet inside of their room, we recommended such request be documented in a special incident report as voluntary room confinement. We further discussed how and when AD-SEP youth who are unable to attend school in the classroom, receive their educational packets. It was discussed that youth shall receive their educational packet prior to school and the packet should be delivered by the school Teacher Aid or Paraprofessional. Youth who are working on educational packets shall receive assistance from school staff throughout the school day. We recommend this educational assistance be documented by school and probation staff. Following our inspection, Probation Superintendent Nino Pinocchio addressed areas of concern with Title 15 section 1354 and 1370 with probation and school staff. Protocols and quality assurance procedures have been put in place to hold staff accountable for ensuring youth unable to attend school due to safety concerns receive their educational packet, education assistance and a location outside of their room to complete schoolwork. 1 BSCC reviews only those policy and procedures required by, and applicable to, Title 15, CCR. BSCC staff do not “approve” policies and procedures or assess them for constitutional or legal issues. Agencies should seek review through their legal advisor, risk manager, and other persons deemed appropriate for such evaluation. 7027+7029 Butte JH Camp LTR 20-22 Chief Barley Page 3 7/28/2021 All other agreed-upon changes were completed prior to the submission of this report. Title 24, CCR Physical Plant There were no changes made to the physical plant and your rated capacity remains at 25 youth for the Juvenile Hall, 20 youth for the Transitional Age Youth (TAY) program, and 15 youth for Camp Condor. Please see the Physical Plant Evaluation for more information. There are no outstanding items of noncompliance with Title 24 minimum standards. Training According to the most recent Standards and Training for Corrections audit, Butte County Probation Department is in compliance with all relevant regulations and mandates and mitigating circumstances if applicable. Juvenile Justice and Delinquency Prevention Act (JJDPA) Compliance Monitoring We reviewed applicable documentation and found no violations of the JJDPA. Night lighting in the above areas provides good visibility and is conducive to sleep.  Padding (2.7) Padding in safety rooms covers the floor, door and walls to  a clear height of eight feet. Benches or platforms are not placed on the floor of safety rooms. Padded rooms are equipped with a tamper-resistant fire  sprinkler as approved by the State Fire Marshal (SFM).
