YES DATE CAP DUE TO BSCC: 1/31/2022 Current Items of Noncompliance Title 15. Section Description 1354.5 Room Confinement • Policy is consistent with regulation however, operationally, the facility lacks options for discipline other than counseling the youth and staff revert to room confinement instead of utilizing room confinement for the intended purpose, to ensure immediate safety and security. • Youth who engage in inappropriate behavior automatedly receive two (2) hrs of room confinement, although, youth may be ready to reenter the unit program. Department cannot define what is or is not inappropriate behavior. • Youth who get into fights serve four (4) hrs of room confinement prior to returning to the general population. • KMJD - per room confinement logs, one youth was placed on room confinement for 4 hours 59 minutes for Inappropriate Behavior. Two youth were placed on room confinement for 4 hrs and 22 minutes for fighting without documentation. 7491+ San Diego JH Initial 20-22 IIR v1. 10.29.20 San Diego Probation Department Page 2 Technical Assistance Provided BSCC staff reviewed regulations section 1354.5 Room Confinement with each facility’s staff. Each facility will review their room confinement’ practice to ensure their practice aligns with the regulations and statue. Additional Information A Corrective Action Plan shall be filled within 60 days of having received notice of noncompliance from the Board of State and Community Corrections. The corrective action plan shall outline how facilities plans to correct the issue of noncompliance and give a reasonable timeframe, not to exceed 90 days, for resolution. In the event the juvenile hall fails to meet its commitment to resolve noncompliance issues outlined in its corrective action plan, the board shall make a determination of suitability at its next scheduled meeting. 7491+ San Diego JH Initial 20-22
