November 10, 2022 Mark Ferriera, Chief Probation Officer Stanislaus County Probation 2215 Blue Gum Avenue Modesto, CA 95358 2022 UNANNOUNCED INSPECTION – WIC 209 AND 885 STANISLAUS COUNTY JUVENILE HALL AND CAMP FACILITY BSCC# 7673 AND 7675 Dear Chief Ferriera: Pursuant to Welfare and Institutions Code section 209 and 885, on September 15, 2022, the Board of State and Community Corrections (BSCC) staff conducted an unannounced inspection of the Stanislaus County Juvenile Hall and Juvenile Commitment Facility (JCF), BSCC #7673 and 7675. The focus of the unannounced inspections was to verify continued compliance with Title 15 California Code of Regulations (CCR), Minimum Standards for Local Detentions Facilities, Sections 1354.5 Room Confinement, 1361 Grievance Procedure, 1371 Programs, Recreation, and Exercise and 1391 Discipline Process. BSCC INSPECTION Title 15, CCR Minimum Standards The inspection consisted of a site visit, interviews with administration, facility staff, and youth, a review of room confinement and grievances for dates in June-August of 2022, and a review of the youth daily program schedules as well as youth due process hearings for the Juvenile Hall and the Juvenile Commitment Facility. 1354.5 Room Confinement: During the BSCC comprehensive inspection completed in April 2022, the Juvenile Hall and JCF were deemed to be in compliance with this regulation; however, technical assistance was provided for continued compliance. Since the comprehensive inspection, the facilities have adopted the technical assistance provided and all reviewed youth room confinement were within compliance of the regulation. However, I reminded the facilities the amount of room confinement time given to a youth should not be a predetermined set amount of time. In reviewing one of the room confinement reports, staff stated they recommend the youth to serve two hours of room confinement time. Following our unannounced inspection, Superintendent Tracie Martin sent an all staff email stating, effective immediately, staff shall not include nor recommend specific amounts of time when placing a youth on room confinement. Superintendent Martin also reiterated any youth placed on room confinement shall be returned to normal programming once they no longer pose a threat to the safety or security of any youth or staff. Mark Ferriera Chief of Police Page 2 1361 Grievance Procedure: During the BSCC comprehensive inspection completed in April 2022, the Juvenile Hall and JCF were deemed to be in compliance with this regulation. During the unannounced inspection, we reviewed a total of ten (10) grievances from the Juvenile Hall and JCF. We also conducted a walkthrough of each housing units to ensure grievance lockboxes and grievance forms were posted in the dayrooms. Review of documentation provided and walkthrough of the housing units revealed compliance with this regulation. It should be noted the grievance lockboxes are checked by a Supervisor once per shift. 1371 Programs, Recreation, and Exercise: During the BSCC comprehensive inspection completed in April 2022, the Juvenile Hall and JCF were deemed to be in compliance with this regulation. During the unannounced inspection, we reviewed the program logs for the month of August 2022 from the Juvenile Hall and JCF. Review of documentation revealed each youth detained was provided a minimum of one hour of program, recreation, and exercise per day. Each facility remains within compliance with this regulation. 1391 Discipline Process: At the time of the BSCC comprehensive inspection completed in April 2022, the Juvenile Hall and JCF were deemed to be in compliance with this regulation. During the unannounced inspection, we reviewed five (5) Disciplinary Review forms from the Juvenile Hall and JCF. Documentation reviewed from both facilities revealed continued compliance with this regulation. Title 24, CCR Physical Plant The Stanislaus County Juvenile Hall and Juvenile Commitment Facility were observed to be in good, clean, and orderly condition during our visit. There are no outstanding items of noncompliance with Title 24 minimum standards. CORRECTIVE ACTION PLAN There were no items of noncompliance identified during the unannounced inspection and no Corrective Action Plan is required at this time. -- I am available to provide technical assistance when requested.
