Section Description Subsection (a) (1) states: “Room confinement shall not be used before other, less restrictive, options have been attempted and exhausted, unless attempting those options poses a threat to the safety or security of any youth or staff.” During the inspection, multiple dates during the inspection period were identified whereupon some of the youth on a unit remained in their locked rooms while other youth on the unit were out of their rooms; then those youth in their rooms rotated out to the unit while those youth who had been out on the unit were § 1354.5. This was attributed in documentation and interviews to the use of “Split Programming” which was being used to keep youth separate due to tension between various youth on the unit. Additional documentation reviewed used phrases such as “behavior split”, “on a two-way behavior split”, and “on split schedule”. This also resulted in multiple occasions of youth in the unit eating their meals in their locked rooms, rather than eating meals out on the unit, keeping groups of youth separate from other groups of youth. Section Description This constitutes room confinement; however, no documentation was provided indicating the youth in their rooms were on room confinement or that the criteria necessary to meet regulatory requirements for room confinement, such as less restrictive attempts or administrative approval, had been met.
