7754 Yuba-Sutter Co (2020-2022 inspection cycle)

October 3, 2022 Jim Arnold, Chief Probation Officer Yuba County Probation Department 215 5th Street Marysville, CA 95901 2022 UNANNOUNCED INSPECTION – WIC 209 AND 885 YUBA-SUTTER COUNTY JUVENILE HALL AND CAMP FACILITY BSCC# 7752 AND 7754 Dear Chief Arnold: Pursuant to Welfare and Institutions Code section 209 and 885, on September 1, 2022, the Board of State and Community Corrections (BSCC) staff conducted an unannounced inspection of the Yuba-Sutter County Juvenile Hall and Maxine Singer Youth Guidance Center Camp, BSCC #7752 and 7754. The focus of the unannounced inspections was to verify continued compliance with Title 15 California Code of Regulations (CCR), Minimum Standards for Local Detentions Facilities, Sections 1433 Request for Health Care Services, 1361 Grievance Procedure, 1360 Searches, and 1370 Education Program. BSCC INSPECTION Title 15, CCR Minimum Standards The inspection consisted of a site visit, interviews with administration, facility staff, and youth, a review of strip searches for dates in June-August of 2022, and a review of the Education program schedules for the Juvenile Hall and Camp Singer. 1433 Request for Health Care Services: During the BSCC comprehensive inspection completed in February 2022, the Juvenile Hall and Camp were deemed to be in compliance with this regulation; however, technical assistance was provided for continued compliance. Since the comprehensive inspection, the facilities have placed medical lock boxes within each housing unit and dormitory to ensure youth are provided an opportunity to confidentially submit medical slips. Also, to further ensure confidentiality, only the medial staff have access to the medical lock box. Review of policy and procedure and interviews with youth and staff revealed continued compliance with this regulation. 1361 Grievance Procedure: During the BSCC comprehensive inspection completed in February 2022, we provided technical assistance regarding ensuring the grievance boxes within the housing units are locked at all times. During the unannounced inspection, we inspected the grievance boxes in each housing unit and dormitory and determined that all boxes were locked and secured. The lock boxes are checked by a Supervisor once per shift. Review of policy and procedure revealed continued compliance with this regulation. Jim Arnold Chief Probation Officer Page 2 1360 Searches: During the BSCC comprehensive inspection completed in February 2022, we provided technical assistance regarding the searches of Camp youth following their return to the facility from a field trip or furloughs. We discussed, prior to conducting a strip search, staff needs to document a reasonable suspicion that a youth is concealing contraband. We also discussed a need to revise their current Supervisor’s authorization form. During the unannounced inspection, it was discovered the facility revised and implemented a new Strip Search Authorization form and no strip search had been conducted since February 2022. 1370 Education Program: At the time of the BSCC comprehensive inspection completed in February 2022, both facilities maintained continued suspension of the 1370 Education Program regulation. During that inspection, interviews with staff and youth revealed only one (1) certified/credential teacher was utilized for both programs. During the inspection, we met with the Assistant Superintendent of Yuba County Office of Education and the school Principal and verified the current teachers’ credentials. We also verified the youth are receiving the required 240 minutes of school per day as outlined in the state education code. Title 24, CCR Physical Plant The Yuba-Sutter County Juvenile Hall and Camp Singer were observed to be in good, clean, and orderly condition during our visit. There are no outstanding items of noncompliance with Title 24 minimum standards. CORRECTIVE ACTION PLAN There were no items of noncompliance identified during the unannounced inspection and no Corrective Action Plan is required at this time. -- I am available to provide technical assistance when requested.
