July 18, 2018 Gregory Ahern, Sheriff-Coroner Alameda County Sheriff’s Office 1401 Lakeside Drive Oakland, CA 94612 2016-2018 BIENNIAL INSPECTION ALAMEDA COUNTY SHERIFF’S OFFICE - COURT HOLDING FACILITIES, PENAL CODE SECTION 6031 Dear Sheriff Ahern: On June 27-28, 2018, staff of the California Board of State and Community Corrections (BSCC) conducted the 2016 - 2018 biennial inspection of the Alameda County Sheriff’s Office court holding facilities pursuant to Penal Code Section 6031. The court holding facilities were inspected for compliance with the Minimum Standards for Local Detention Facilities as outlined in Titles 15 and 24, California Code of Regulations. The inspection consisted of a review of applicable policies and procedures governing the operation of the facilities, staff interviews, a review of documentation to verify that your practices follow your written procedures, and a walk- through of the physical plants. Captain Donald Mattison coordinated the facility inspection schedule. He provided us with a copy of the Alameda County Sheriff’s Office - Court Services Policy Manual for our policy review and he provided direction to his staff to ensure that the necessary documentation was available for our Title 15 compliance verification. Lieutenants Richard Carter and Ralph Lacer worked with their supervisors and staff to assemble the necessary documentation and they were present to answer operational questions. We sincerely appreciated your staff’s professionalism and their courtesy at the Juvenile Justice Center, Wiley Manuel Courthouse, Fremont Hall of Justice, and the Hayward Hall of Justice. The complete BSCC inspection report is enclosed and consists of: • This transmittal letter; • The Procedures Checklist outlining applicable Title 15 sections for the above facilities; • The Physical Plant Evaluations for each facility outlining Title 24 requirements for design; and, • The Living Area Space Evaluations that summarize each facility’s physical plant configuration. We encourage the practice of maintaining a permanent file for historical copies of all inspections. This file should be the first point of reference when preparing for all future inspections. LOCAL INSPECTIONS In addition to a biennial inspection by the BSCC, inspections are also required annually by the County Health Officer and biennially by the State Fire Marshal or an authorized representative (Health and Safety Code § 101045 and 13146.1). Fire clearance was granted for all court holding facilities listed below. While statute requires a biennial fire and life safety inspection, the Oakland Fire Department conducts an inspection at six-month intervals. When your department receives a copy of the heath inspections for the Juvenile Justice Center, please forward a set to the BSCC. BSCC INSPECTION PHYSICAL PLANT: The BSCC would like to acknowledge the professional working relationship established between the Alameda County Sheriff’s Office and the Judicial Council’s Facilities Manager Michael Kong. Mr. Kong and his staff are responsible for the maintenance of the court buildings, including the holding cells, and they are responsive to requests from the Sheriff’s Office - Court Services Division. During our physical plant evaluations, we observed the holding cells to be graffiti free, floors were clean, toilets, washbasins and drinking fountains in good working condition, and lights and HVAC systems functioning. Janitorial maintenance is rendered every evening and despite the number of inmates cycling through the holding cells, they are well maintained. Juvenile Justice Center 121 125 127 129 Alameda Co CH CHJ LTR 2016-18 Gregory Ahern, Sheriff-Coroner Page 3 The Juvenile Justice Center was constructed in 2007. There are two cells used to hold adult inmates. These holding cells are evaluated under the 2001 Title 24 standards1. We noted no issue of non-compliance. East County Hall of Justice The East County Hall of Justice was constructed in January 2017 and is evaluated under the 2010 Title 24 standards. Since this facility opened during the 2016-2018 biennial inspection cycle, the court holding facility is exempt from a Title 15 inspection. The BSCC will conduct an inspection for compliance with Title 15 and 24 California Code of Regulations during the 2018-2020 biennial inspection schedule. Wiley W. Manuel Courthouse The Wiley W. Manuel Courthouse was constructed in 1980 and is evaluated under the 1980 Title 24 standards. There are thirty-six holding cells dispersed on five levels of the court building. We noted no issues of non- compliance. Fremont Hall of Justice The Fremont Hall of Justice was constructed in 1979 and was remodeled in 1988. This facility is evaluated under the 1978 and 1988 Title 24 standards. We noted no issues of non-compliance. Hayward Hall of Justice The Hayward Hall of Justice was constructed in 1976 and was remodeled in 1988. The original facility’s sixteen holding cells were constructed under pre-1978 Title 24 standards. As a result, we do not inspect these cells. Two cells, which were constructed during the remodel, are evaluated under the 1988 Title 24 standards. We noted no issues of non-compliance. POLICY REVIEW: BSCC reviewed the relevant sections of agency policy to ensure that applicable Title 15 regulations were addressed2. During our limited review, we found no issues of non-compliance. PROCEDURES REVIEW: BSCC continued its inspection by reviewing procedures and practices to evaluate compliance with applicable regulations. This included reviewing court holding facility training requirements; the number of personnel and hourly safety checks; monthly fire and life safety inspection reports, and inmate screening and classification. During our review of supporting documentation, we did not identify any issues of non-compliance. Please refer to the Procedures Checklist for additional details. JUVENILE JUSTICE AND DELINQUENCY PREVENTION ACT (JJDPA) COMPLIANCE MONITORING: 1 Facilities are assessed against Title 24 requirements in place at the time of design or significant remodel. 2 BSCC does not review all your policies and procedures. We only review those policies related specifically to the applicable regulations included in Title 15, Minimum Standards for Local Detention Facilities for issues of non- compliance. We do not “approve” your policies nor do we review them for Constitutional or legal issues. We recommend agencies seek policy review through their legal advisor, risk manager, and other persons deemed appropriate. 121 125 127 129 Alameda Co CH CHJ LTR 2016-18 Gregory Ahern, Sheriff-Coroner Page 4 In accordance with the JJDPA, BSCC monitors court holding facilities for compliance with one of the four core requirements of the Act: Separation of Juveniles from Incarcerated Adults. Since the Juvenile Justice Center opened, juveniles are no longer transported to the Fremont or Hayward Hall of Justice for court appearances. Juvenile court cases are still scheduled at the Wiley Manuel Courthouse. When an in-custody juvenile is required to appear at the Wiley Manuel Courthouse, the probation officer will transport the juvenile to the Glenn Dyer Jail sally port. Custody staff advises all jail personnel that a juvenile will be escorted from the jail sally port through the tunnel, which connects to the Wiley Manuel Courthouse. After this announcement, all adult prisoner movement is stopped. Custody staff will maintain side-by-side supervision of the juvenile from the jail sally port until the juvenile is placed in the court holding cell. Custody staff will monitor the juvenile in the holding cell and upon conclusion of the court matter, the juvenile will be escorted back to the jail sally port for transport back to the juvenile hall.
