November 7, 2021 Marcus Dawal, Chief Probation Officer Alameda County Probation Department 400 Broadway Oakland, CA 94607 2020-2022 BSCC CORRECTIVE ACTION PLAN (CAP) FOLLOW-UP INSPECTION OF THE ALAMEDA COUNTY PROBATION JUVENILE DETENTION FACILITY AND CAMP WILMONT SWEENEY Dear Chief Dawal: On November 2, 2021, the Board of State and Community Corrections staff conducted our third follow- up inspection on your agency’s Corrective Action Plan (CAP) to determine compliance with the Minimum Standards for Local Detention Facilities as outlined in Title 15, California Code of Regulations. The focus of the follow-up inspection was to verify corrective actions your agency has taken to correct the items of noncompliance from your 2020-2022 Biennial Inspection. There were four outstanding items of noncompliance from the 2020-2022 Inspection that required corrective action, three for Juvenile Hall and one for Camp Sweeney. The issues of non-compliance were Staffing, Section 1321 – Juvenile Hall; Safety Checks, Section 1328 – both facilities; and Programming, Section 1371 – Juvenile Hall. BSCC staff conducted corrective action follow-up as follows: Inspection and Notice of Non-Compliance May 14, 2021 Corrective Action Plan submitted to BSCC June 11, 2021 1st On-site Review July 26, 2021 Bi-weekly Zoom to check status August 17, 2021 Bi-weekly Zoom to check status August 30, 2021 Bi-weekly Zoom to check status September 13, 2021 Labor Agreement #1 to 10-2-21 September 15, 2021 Bi-weekly Zoom to check status September 27, 2021 BOS Approved Vendor Contracts September 28, 2021 Labor Agreement #2 to 10-30-21 October 6, 2021 2nd On-site Review October 11, 2021 Labor Agreement #3 to 11-27-21 October 29, 2021 Final Review November 2, 2021 With regard to Section 1328, Safety Checks, Camp Sweeney gained compliance on July 26, 2021. The Juvenile Hall was remarkedly improved at that time; however, we continued to assess compliance pending another review. Chief Dawal Page 2 11/7/21 At our second on-site review, Juvenile Hall gained compliance with Safety Checks and showed great improvement regarding staffing and programming, mostly due to the labor agreements in place which provided for holdovers of staff for unfilled shifts. Upon our final review on November 2, 2021, all documentation for the remaining two noncompliant issues at Juvenile Hall determined you have corrected the items of noncompliance with Title 15, Minimum Standards for Local Detention Facilities, related to regulation sections 1321, Staffing, and 1371, Programming, Recreation and Exercise. BSCC staff will continue to conduct additional follow-up inspections to ensure continued compliance and provide technical assistance in line with regulations and best practices.
