Section Description Safety checks shall be conducted at least hourly through direct visual observation of all inmates. There shall be a written plan that includes the documentation of routine safety checks. BSCC Staff requested to review multiple months of § 1027.5 Safety Checks safety checks of the housing areas of the facility. Due to problems with the Jail Management System, a random of 11 days over the last 5 months were able to be provided. In 10 of the 11 days, there were one or more documented safety checks that did not meet the under 60-minute requirement of this section. Title 24. Section Description When BSCC Staff inspected the facility, all dayrooms had additional bunks and sleeping boats in the dayrooms of the facility. The facility was 20 inmates 1231.2.9 Dayrooms over the rated capacity or 24%. The additional persons in each housing unit and dayroom decreased the space available to per each person. The number of inmates in Unit D exceed the number 1231.3.4 Showers of inmates per Shower. Link to State Fire Marshal’s form provided for future inspections of the local fire department. Additional Information On the dates of the inspection, the facility was 20 inmates overrated capacity. This is 24% over their rated capacity. Since April 2020, the agency has had BSCC authorized Emergency Suspension of Standards for 1061, 1062, 1065, 1070, and 1267 through most of this two-year cycle. This was due to COVID-19 health care restrictions. Amador County has won their legal challenges to the 40-bed expansion to their jail. Their initial Operation and Staffing plans have been submitted and designs are under review. Redman, Sheriff Amador County Sheriff’s Office 700 Court Street Jackson, CA 95642 2020-2022 BIENNIAL INSPECTION OF AMADOR COUNTY SHERIFF’S OFFICE, AMADOR COUNTY JAIL AND COURT HOLDING FACILITY Dear Sheriff Redman, On May 18 and 19, 2022, staff of the Board of State and Community Corrections (BSCC) conductedthe 2020-2022biennial inspection of the AmadorCounty Jailand the Amador County Court Holding Facility. Pursuant to Penal Code Section 6031, this inspection was performed to determine compliance with the Minimum Standards for Local Detention Facilities as outlined in Titles 15 and 24, California Code of Regulations(CCR). In addition, BSCC staff conducted compliance monitoring pursuant to the federal Juvenile Justice and Delinquency Prevention Act (JJPDA) for the separation requirements of juveniles from incarcerated adults. The complete BSCC inspection report is enclosed and consists of: this transmittal letter; two Title 15 Procedures Checklist outlining applicable minimum standards for each facility; two Physical Plant Evaluation outlining Title 24 requirements for design of each facility; two Living Area Space Evaluation summarizing the physical plant configuration and showing the capacity of each facility. Refer to the Title 15 Checklist for indication of compliance status and evidence used to determine compliance. We encourage the practice of maintaining a permanent file for historical copies of all inspections that would also include documentation of corrections made following the inspection. This file should be the first point of reference when preparing for all future inspections. Gary W. Fire Inspections were not available or delayed due to COVID measures. Inspection Date Fire and Life Safety, (Jail/Court Holding) COVID Delayed Medical and Mental Health (Jail/Court Holding) November 22, 2021 / November 14, 2021 Nutritional Health (Jail) November 20, 2021 Environmental Health (Jail/Court Holding) November 22, 2019 / November 14, 2021 BSCC INSPECTION The inspection consisted of a review of the Amador County Sheriff’s Office Custody Services Manual and sections of the Amador County Sheriff’s Office Policy Manuals that apply to Jail and Court Holding Operations, a site visit to review operations, physical plant and relevant documentation, and interviews with administration and facility staff. In reviewing policies and procedures during the 2020-2022 cycle, consideration was given to agency’s Emergency Suspension of Services (ESS) related to the COVID-19 emergency measures taken and authorized by the BSCC. For the safety of the inmates and staff, the Amador County Sheriff’s Office had suspended the following services during part or whole of this inspection cycle: Section 1061, Inmate Education Programs (March 12, 2020 – Present) Section 1062, Visitation (March 12, 2020 – Present) Section 1065, Exercise and Recreation (March 12, 2020 – March 10, 2022) Section 1067, Access to Telephones (September 28, 2021 – November 6, 2021) Section 1070, Individual/Family Service Programs (March 18, 2020 – March 10, 2022) Section 1267, Hair Care Services (August 19, 2020 – March 10, 2022) BSCC Staff reviewed policy and procedures for these sections and any mitigation measures taken to minimize the impact of the suspension of these services. Title 15, CCR Inspection (County Jail): Our evaluation consisted of reviewing only those policies and procedures related specifically to the applicable regulations included in Title 15, CCR.1 We found the following items of noncompliance. 1 BSCC does not review all policies and procedures. We do not “approve” policies and procedures, nor do we review them for constitutional or legal issues. We recommend agencies seek review through their legal advisor, risk manager and other persons deemed appropriate. 0320 0325 Amador County Jail CH LTR 20-22 Gary W. Redman Sheriff Page 3 Title 15, Section 1027.5: Safety Check Documentation (County Jail): Safety checks shall be conducted at least hourly through direct visual observation of all inmates. There shall be no more than a 60-minute lapse between safety checks. There is a written plan that includes the documentation of routine safety checks. BSCC Staff requested to review multiple months of safety checks of the housing areas of the facility. Due to problems with the Jail Management System, a random of 11 days over the last 5 months were able to be provided. In 10 of the 11 days, there were one or more documented safety checks that did not meet the under 60-minute requirement of this section. Title 15, Section 1032: Fire Suppression Preplanning (County Jail): (c)Fire prevention inspections as required by Health and Safety Code Section 13146.1(a) and (b) which requires inspections at least once every two years. BSCC Staff requested to see the completed Fire Marshal or local fire department inspection report. There was not a current report available. This was delayed due to COVID-19 restrictions. Since the inspection, the facility administrator has scheduled the fire inspection. Please refer to the Procedures Checklist for detailed information. Title 24, CCR Physical Plant (County Jail): There were no changes made to the physical plant and the rated capacity remains at 76. The Jail was originally constructed under the 1976 Title 24 Regulations, and there were additions of double cell housing units under the 1988 regulations. Finally, there was a renovation to add a second sobering cell under the 2001 Title 24 Regulations. The initial early podular design had 6 pods with a dayroom and a mezzanine. The facility is dated and is clearly a challenge to maintain. Initially designed with single and double cells. Second bulks have been installed in the single cells as of the 2008 – 2010 assessment. The jail still has a BSCC rated capacity of 76, but the facility has been operating well over capacity for several years. With the exception of a few months during the COVID-19 emergency and for the last seven years, the population has maintained an average daily population (ADP) ranging from 78 to over 100. On the date of the inspections, the facility was at 96 in-custody, 23% over the rated capacity. To accommodate the number of inmates, for the last five inspections cycles, some of the dayrooms contain triple bunks and sleeping boats that are in use. As a result, this facility has been, and is currently, non-compliant with Title 24, Section 470A.2.9, Dayrooms. In addition, due to the number of inmates in Unit D, rated at 20 but holding 35, the facility has continued to be non-compliant with Title 24, Section 470A.3.4, Showers. The number of inmates exceeds the 1:16 shower to inmate ratio. 0320 0325 Amador County Jail CH LTR 20-22 Gary W. BSCC Staff requested to see the completed Fire Marshal or local fire department inspection report. There was not a current report available. This was delayed due to COVID-19 restrictions. Since the inspection, the Judicial Council of Courts (JCC) administrator for this facility has contacted the BSCC and Fire Marshal and scheduled the inspection. Title 24, CCR Inspection (Court Holding): The court holding facility was completed under the 2001 Title 24 Regulations. There are six holding cells. There were no issues of non-compliance. Juvenile Justice and Delinquency Prevention Act Compliance In accordance with JJDPA. BSCC monitors jail facilities for compliance with one of four core requirements of the Act, Separation of Juveniles from Incarcerated Adults. Minors are not securely held in either of these facilities; therefore, no violations of the JJDPA were identified. Technical Assistance At the conclusion of each inspection, BSCC staff offered an out brief of findings to Sheriff’s Department leadership. Undersheriff Bryan Middleton was briefed on the findings which included an immediate review of the inspection and the non-compliance issues. It also included potential courses of action in correcting those non-compliance issues. Finally, the out brief provided leaders with identified hazards existing in the facility, which are all primarily due to the overcrowding of the existing jail. Amador County has received approval for a jail expansion project under SB 863. Corrective Action Plan The BSCC has received your Corrective Action Plan (CAP) letter and will be scheduling a follow- up visit to confirm compliance with Section 1027.5, Safety Checks for both facilities. -- 0320 0325 Amador County Jail CH LTR 20-22 Gary W.
