August 8, 2018 Kory Honea, Sheriff – Coroner Butte County Sheriff’s Office 5 Gillick Way Oroville, CA 95965 Dear Sheriff Honea: BIENNIAL INSPECTION, BUTTE COUNTY SHERIFF’S OFFICE, ADULT DETENTION FACILITY, PENAL CODE SECTION 6031 On April 3, 2018, the Board of State and Community Corrections (BSCC) conducted the 2016-2018 biennial inspection of the Butte County Jail and court holding facilities. The facilities were inspected for compliance with the Minimum Standards for Local Detention Facilities, as outlined in Titles 15 and 24, California Code of Regulations. The inspection consisted of a review of applicable written policies and procedures governing the operation of the facility, a site visit, and a review of documentation to verify that regulated practices occur as required. Lieutenants Jarred Agurkis, Robert Hadley, Daryl Hovey, and Al Smith, Sergeants Mike Hannah and Robert Cooley and other key staff members were instrumental in the inspection process and your facilities were well prepared for our visit. The participation of command-level staff during our visits allows a better examination of jail conditions and, when appropriate, the rapid remedy of issues. We particularly appreciate Undersheriff Jones and your participation in the debrief session at the conclusion of our visit. The complete BSCC inspection report is enclosed and consists of: this transmittal letter; the Procedures Checklists outlining applicable Title 15 sections for both custody and court holding facilities; and individual Physical Plant Evaluations and Living Area Space Evaluations that summarize each facility’s physical plant configuration. We encourage the practice of maintaining a permanent file for historical copies of all inspections that would also include documentation of corrections made following the inspection. This file should be the first point of reference when preparing for all future inspections. Local Inspections In addition to a biennial inspection by the BSCC, inspections are required by the County Health Officer annually and the State Fire Marshal (or designee) biennially. BSCC Inspection Title 24 - Physical Plant Jail: Completed in 1965, the jail is evaluated against Title 24 standards from 1963 and 1994.1 The rated capacity is 614 inmates and 550 inmates were housed at the time of our visit. The facility was clean and serviceable. No housing unit was crowded. No issues of non-compliance were noted. Oroville Superior Court: Completed in 1996, this facility is evaluated against the 1994 and 2001 Title 24 standards. No issues of non-compliance were noted. Chico Superior Court: Completed in 2015, this facility is evaluated against the 2010 Title 24 standards. No issues of non-compliance were noted. Title 15 Inspection – Operational Review During the inspection, BSCC staff reviewed applicable policy, procedures, practices and supporting documentation as indicated. Policy 2– Policy and procedures for the jail are found in Departmental Orders. Policy for the court holding facility is found in both Departmental Orders and Court Security Plan. The latest revisions 1 Facilities are evaluated against the versions of Title 24 in effect at the time of construction or significant remodel. It is common for different revisions of Title 24 to be applicable to a single facility. 2 BSCC does not review all of your policies and procedures. BSCC reviewed all manuals against relevant regulations and found all required elements present. Please refer to the Procedures Checklists for further information. Training – Court holding facilities are staffed by jail deputies, so an audit of the jail’s training program also encompasses the court holding facilities. The most recent Standards and Training for Corrections (STC) audit (August 2017) found the agency in full compliance (with mitigation) with all training requirements. We interviewed line staff and found them knowledgeable about emergency procedures, Title 15 standards and related issues. Procedures - BSCC also reviewed a variety of records to ensure that procedures relevant to Title 15 standards matched policy and that all required procedures were being performed within regulated criteria. To assess the facility’s staffing levels, BSCC reviewed security logs, shift rosters, incident reports, and related records which give insight to the facility’s operation. The jail inmates are supervised by four self-relieving teams of one sergeant and 10-12 deputies per shift. In the absence of sergeants, jail teams operate without a supervisor. Other teams serve in administrative, field and court assignments. BSCC reviewed a variety of records to ensure that staffing was adequate to complete all regulated tasks in a safe and timely manner. Hourly checks of inmates consistently occurred within regulated timelines and supervisors toured each floor daily. We found no indication that staffing was insufficient in either the jail or the court holding facilities. Sobering cell and restraint logs were reviewed and all required interventions were timely and consistent with regulations. No safety cell is installed at the jail and self-injurious inmates are housed in standard cells under enhanced surveillance. Grievances we reviewed did not reveal unexpected or unusual complaints. Disciplinary incidents did not appear excessive and the outcomes were consistent, proportional to the offense and in keeping with the published disciplinary matrix. Inmates were interviewed and revealed no unexpected complaints. Operations in the court holding facilities are overseen by Sheriff’s sergeants. Classification and hazard information from the jail was effectively communicated to transport and court staff. Remanded arrestees are not mixed with jail inmates prior to classification and medical screening. Safety checks were timely. Concerning agency procedures, we found no instances of non-compliance with the minimum standards. Juvenile Justice and Delinquency Prevention Act (JJDPA) Compliance Monitoring: In accordance with the JJDPA, BSCC monitors jail facilities for compliance with one of four core requirements of the Act - Separation of Juveniles from Incarcerated Adults. Minors are not housed at the jail or the court holding facilities. No violations of the JJDPA were identified. We do not “approve” your policies nor do we review them for constitutional or legal issues.
