March 26, 2020 Kory Honea, Sheriff – Coroner Butte County Sheriff’s Office 5 Gillick Way Oroville, CA 95965 Dear Sheriff Honea: BIENNIAL INSPECTION, BUTTE COUNTY SHERIFF’S OFFICE, ADULT DETENTION FACILITY, PENAL CODE SECTION 6031 On November 12, 2019, staff of the Board of State and Community Corrections (BSCC) provided pre-inspection briefings to facility supervisors outlining the proposes, process and necessary documentation needed for the biennial inspection. Staff gave participants a complete preview of the visit and provided a schedule of the inspection. BSCC staff provided applicable checklists and answered any questions. During January 7-9, 2020, the 2018-2020 biennial inspections of the Butte County Jail and court holdings were conducted. The facilities were reviewed for compliance with the Minimum Standards for Local Detention Facilities, as outlined in Titles 15 and 24, California Code of Regulations. The inspection consisted of a review of applicable written policies and procedures governing the operation of the facilities, a site visit, and a review of documentation to verify that regulated practices occur as required. The complete BSCC inspection report is enclosed and consists of this transmittal letter; the Procedures Checklists outlining applicable Title 15 sections for both custody and court holding facilities; and individual Physical Plant Evaluations and Living Area Space Evaluations that summarize each facility’s physical plant configuration. We encourage the practice of maintaining a permanent file for historical copies of all inspections that would also include documentation of corrections made following the inspection. This file should be the first point of reference when preparing for all future inspections. Local Inspections In addition to a biennial inspection by the BSCC, inspections are required by the County Health Officer annually and the State Fire Marshal (or designee) biennially. The individual inspector’s comments and concerns were noted in local reports, including discussion of maintenance and housekeeping issues. Refer to original local inspection reports for other details. In accordance with California Health and Safety Code § 101045, the County Health Officer’s annual Medical/Mental Health inspections for the court holding facilities are overdue. Please forward them to BSCC as they become available. BSCC Inspection Title 24 - Physical Plant Jail: Completed in 1965, the jail is evaluated against Title 24 standards from 1963 and 1994.1 The rated capacity is 614 inmates and 537 inmates were housed at the time of our visit. The facility was clean and serviceable. No housing unit was crowded. No issues of non-compliance were noted. Butte County Superior Court - Oroville: Completed in 1996, this facility is evaluated against the 1994 and 2001 Title 24 standards. No issues of non-compliance were noted. North Superior Court - Chico: Completed in 2015, this facility is evaluated against the 2010 Title 24 standards. The follow non-compliance issue was identified in several of the cells, under the 2010 standards: Title 24, 123.3.1 Toilets/Urinals – Toilet areas shall provide modesty for inmates with staff being able to visually supervise. Please note that at the time of the inspection, BSCC staff was informed that the cells in question were not being utilized because of the lack of a modesty screen. Title 15 Inspection – Procedural and Operational Review Prior to and during the inspection, BSCC staff received and reviewed applicable policy, procedures, practices and supporting documentation as indicated. To assess the facility’s staffing levels, BSCC reviewed security logs, shift rosters, incident reports, and related records which give insight to the facility’s operation. Jail: Policy and procedures for the jail are found in Departmental Orders and Butte County Sheriff’s Department Manual. No issues of non-compliance were identified. Butte County Superior Court - Oroville: Policy for the court holding facility is found in Departmental Orders, Sheriff’s Department Manual, and Court Security Plan. The latest revisions were published in 2019. BSCC reviewed all manuals against relevant regulations and found all required elements present. The following non-compliance issue was identified during the visit to the facility: Title 15, 1032 Monthly Fire and Life Safety – (b) Regular fire prevention inspections by facility staff on a monthly basis with two-year retention of the inspection record. At the time of the inspection no records were available, but since the inspection a checklist was developed and implemented to correct this item. North Superior Court - Chico: All findings were the same as Butte County Superior Court – Oroville Juvenile Justice and Delinquency Prevention Act (JJDPA) Compliance Monitoring: In accordance with the JJDPA, BSCC monitors jail facilities for compliance with one of four core requirements of the Act - Separation of Juveniles from Incarcerated Adults. Minors are not housed at the jail or the court holding facilities. No violations of the JJDPA were identified. Corrective Action Plan: All Title 15 areas of non-compliance were noted by Sheriff’s Office staff, and a corrective action plan is in place and being implemented. If modesty barriers are installed at the North County Superior Court Holding, notify us and we will remove this item from our records. Technical Assistance: At the conclusion of each inspection, BSCC staff offered an out brief of findings to the Sheriff and department senior management. This included an immediate review of the inspection and any non-compliance issues. It also included potential courses of action in correcting those non- compliance issues. Finally, the out brief provided managers with technical assistance in identifying hazards that may exist in the facility. Below are items presented in the out brief: In the County Jail inmates are supervised by four self-relieving teams of one sergeant per shift. In the absence of sergeants, jail teams operate without a supervisor leaving a senior deputy, officer in charge (OIC), as the lead. He or she makes determinations regarding operations and 0340 0355 0385 Butte County SO LTR 18-20 Sheriff Honea Butte County Sheriff’s Office Page 4 implementation of the use of restraints. Because of the limited relief factor for sergeants in the facility, a review of the staffing plan or addition training of OICs may be in order. In the Butte County Superior Court – Oroville there is a holding cell, Cell 75. It serves as the cell for the adjacent courtroom used for trials that require a large gallery. This cell is not subject to this inspection due to its date of construction. The holding cell is of an old design with bars and is used for holding single defendants during court breaks and lunches. Due to the design and its use, a barrier to prevent tie off points for ligatures should be considered. Finally, much of the County Jail is over 50 years old and experienced a significant amount of use. Although well maintained, the facility has many areas that are not consistent with current correctional practices and designs. BSCC staff was pleased to be advised that the Sheriff’s Office is in the planning phases for new construction and renovation. We look forward to assisting the Sheriff’s Office team in improving their facility for their staff and inmates.
