June 30, 2022 Rick DiBasilio, Sheriff Calaveras County Sheriff’s Office 1045 Jeff Tuttle Drive San Andreas, CA 95249 BIENNIAL INSPECTION OF CALAVERAS COUNTY MAIN JAIL AND SUPERIOR COURT HOLDING, PENALCODE6031. Dear Sheriff DiBasilio: On March 23, 2022, staff of the Board of State and Community Corrections (BSCC) provided pre-inspection briefings to facility supervisors outlining the purpose, process, and necessary documentation needed for the biennial inspection. Staff gave participants a complete preview of the visit and provided a schedule of the inspection. BSCC staff provided applicable checklists and answered any questions. On June 8, 2022, the 2020-2022 biennial inspection of the Calaveras County Jail and Court Holding was completed pursuant to Penal Code Section 6031. These inspections were performed to determine compliance with the Minimum Standards for Local Detention Facilities as outlined in Titles 15 and 24, California Code of Regulations. In addition, BSCC staff conducted compliance monitoring pursuant to Welfare and Institutions Code Section 209(f) for the federal Juvenile Justice and Delinquency Prevention Act (JJDPA) for the separation requirements of juveniles from incarcerated adults. The complete BSCC inspection report is enclosed and consists of this transmittal letter; the Procedures Checklists outlining applicable Title 15 sections for both custody and court holding facilities; and individual Physical Plant Evaluations and Living Area Space Evaluations that summarize each facility’s physical plant configuration. We encourage the practice of maintaining a permanent file for historical copies of all inspections that would also include documentation of corrections made following the inspection. This file should be the first point of reference when preparing for all future inspections. LOCAL INSPECTIONS In addition to the biennial inspection by the BSCC, inspections are also required annually by the County Health Officer and biennially by the State Fire Marshal or an authorized representative (Health and Safety Code Sections 101045 and 13146.1). Inspection Main Jail Superior Court Holding Fire and Life Safety 10/26/2021 5/17/2022 Medical and Mental Health 9/23/2021 9/23/2021 Nutritional Health 9/15/2021 N/A Environmental Health 9/16/2021 9/9/2021 BSCC INSPECTION Calaveras County Jail Title 15, CCR – Procedural and Operational Review (County Jail): The inspection consisted of a review of the Calaveras County Sheriff’s Office Policy and Procedure Manual1, a site visit to review operations, physical plant, relevant documentation, and interviews with administration, facility staff, inmates, and collaborative partners. In reviewing policies and procedures during the 2020-2022 cycle, consideration was given to agency’s Emergency Suspension of Services (ESS) related to the COVID-19 emergency measures taken and authorized by the BSCC. For the safety of the inmates and staff, the Calaveras County Sheriff’s Office had suspended the following services during part or whole of this inspection cycle: Section 1061, Inmate Education Programs (March 23, 2020 – May 17, 2021) Section 1062, Visitation (March 13, 2020 – May 17, 2021) Section 1070, Individual/Family Service Programs (March 13, 2020 – March 29, 2022) Section 1072, Religious Observances (March 16, 2020 – March 29, 2022) Section 1267, Hair Care Services (August 19, 2020 – March 10, 2022) BSCC Staff reviewed policy and procedures for these sections and any mitigation measures taken to minimize the impact of the suspension of these services. No items of noncompliance were identified; please see the procedures checklist for detailed information. Title 24, CCR - Physical Plant (County Jail): There were no changes made to the physical plant and rated capacity remains at 176. Please see the Physical Plant Evaluation Checklist for more information. There are no outstanding items of noncompliance with Title 24 minimum standards. 1BSCC reviews only those policy and procedures required by, and applicable to, Title 15, CCR. BSCC staff do not “approve” policies and procedures or assess them for constitutional or legal issues. Agencies should seek review through their legal advisor, risk manager, and other persons deemed appropriate for such evaluation. 0405 0409 Calaveras County II LTR 20-22 Rick DiBasilio Sheriff Page 3 Calaveras Superior Court Holding Title 15, CCR – Procedural and Operational Review Inspection (Court Holding): No items of noncompliance were identified. Title 24, CCR - Physical Plant (Court Holding): Title 24, Section 1231.3.8: Seating In temporary holding and temporary staging cells, seating must be securely fixed to the floor and/or wall. When bench seating is used, 18 inches (457 mm) of bench is seating for one person. Cells D-1 & D-9 contain 13” affixed bench seats and are currently non-compliant. Upon identification of the non-compliance item, the Calaveras County Sheriff’s Court Holding Supervisor contacted the Judicial Council of California (JCC) representative. BSCC staff have received a corrective action plan to correct the deficiency by installation of new benches that meet the Title 24 seating requirements. Juvenile Justice and Delinquency Prevention Act (JJDPA) Compliance Monitoring Minors are not held at the Main Jail and any minor in attendance at the Calaveras County Superior Court is held in a separate area under the control and supervision of the Calaveras County Probation Department. No violations of the JJDPA were found. Corrective Action Plan There were no Title 15 areas of non-compliance items and action is currently underway to correct the Title 24 item. There is no need for a corrective action plan. Technical Assistance At the conclusion of each inspection, BSCC staff offered an out brief of findings to the Sheriff and department senior management. This included an immediate review of the inspection and any non-compliance issues. It also included potential courses of action in correcting those non- compliance issues. Finally, the out brief provided managers with technical assistance in identifying hazards that may exist in the facility. -- This concludes our inspection report for the 2020-2022 biennial inspection cycle of the Calaveras County Jail and Superior Court Holding Facility.
