October 29, 2018 Rick DiBasilio, Sheriff Calaveras County Sheriff's Department 1045 Jeff Tuttle Drive San Andreas, CA 95249 2016-2018 BIENNIAL INSPECTION CALAVERAS COUNTY ADULT DETENTION FACILITY Dear Sheriff DiBasilio: On May 14, 2018, staff of the Board of State and Community Corrections (BSCC) conducted the 2016- 2018 biennial inspection of the Calaveras County Adult Detention Facility. Pursuant to Penal Code Section 6031, this inspection was performed to determine compliance with the Minimum Standards for Local Detention Facilities as outlined in Titles 15 and 24, California Code of Regulations. In addition, BSCC staff conducted compliance monitoring pursuant to the federal Juvenile Justice and Delinquency Prevention Act (JJDPA) for the separation requirements of juveniles from incarcerated adults. The complete BSCC inspection report is enclosed and consists of: this transmittal letter; the Title 15 Procedures checklist outlining Title 15 requirements for the jail facility; the Physical Plant Evaluation outlining Title 24 design requirements; and, the Living Area Space Evaluation summarizing the physical plant configuration and the total rated capacity. LOCAL INSPECTIONS In addition to the biennial inspection by the BSCC, inspections are also required annually by the County Health Officer and biennially by the State Fire Marshal or an authorized representative (Health and Safety Code Sections 101045 and 13146.1). Please consider our report in conjunction with the reports from the County Health Officer and the respective fire authorities for a comprehensive perspective of your facilities. We encourage the practice of maintaining a permanent file for historical copies of all inspections that would also include documentation of corrections made following the inspection. This file should be the first point of reference when preparing for all future inspections. 405 Calaveras County LTR 16-18 Sheriff Rick DiBasilio Page 2 Health Inspections The local health inspection took place on 8/30/17, thus is considered current. There were no non- compliance issues. Fire and Life Safety Inspections The fire and life safety inspection took place on 5/12/16 and is current. BSCC INSPECTION Title 15 Inspection – Policies, Procedures and Documentation Our inspection began with a review of the Calaveras County Sheriff's Office Custody Bureau Policy and Procedures Manual. Our audit consisted of a review of only those policies and procedures related specifically to the applicable regulations included in Title 15, Minimum Standards for Local Detention Facilities.1 After the review of the manual, we reviewed a sampling of hourly safety checks at each facility and found that staff were performing their checks within the 60 minutes required by Title 15, Section 1027, and by policy. We also reviewed documentation on the use of sobering cells and safety cells in the jail and found that documentation conformed to applicable regulations. Our review of a sampling of grievances and discipline reports revealed timely and appropriate responses. There were no Title 15 non-compliance issues to report. Title 24 – Physical Plant Inspection Adult Detention Facility: This facility is evaluated under 2008 Title 24, Minimum Standards for Local Detention Facilities2 and was very clean and well-maintained. With a BSCC rated capacity of 128 inmates, on the day of the inspection there were 72 male inmates and 10 female inmates in custody. There were no Title 24 non-compliance issues to report. Juvenile Justice and Delinquency Prevention Act Compliance Monitoring In accordance with the JJDPA, BSCC monitors jail facilities for compliance with one of four core requirements of the Act, Separation of Juveniles from Incarcerated Adults. Minors are not housed at this facility; therefore, no violations of the JJDPA were identified. _______________ 1 BSCC does not review all policies and procedures. We do not “approve” policies and procedures nor do we review them for constitutional or legal issues.
