April 30, 2020 Erik Apperson, Sheriff Del Norte County Sheriff's Office 650 Fifth Street Crescent City, CA 95531 2018-2020 BIENNIAL INSPECTION OF DEL NORTE COUNTY SHERIFF’S OFFICE JAIL AND COURT HOLDING FACILITY, PENAL CODE 6031 Dear Sheriff Apperson: Between February 27-28, 2020, Board of State and Community Corrections (BSCC) staff conducted the 2018-2020 biennial inspection of the Del Norte County Sheriff’s Office County Detention and Court Holding Facility. Pursuant to Penal Code Section 6031, this inspection was performed to determine compliance with the Minimum Standards for Local Detention Facilities as outlined in Titles 15 and 24, California Code of Regulations (CCR). In addition, BSCC conducted compliance monitoring pursuant to Welfare and Institutions Code Section 209(f) and the federal Juvenile Justice and Delinquency Prevention Act (JJDPA). The complete BSCC inspection report is enclosed and consists of: this transmittal letter; the Title 15 Procedures Checklist outlining applicable minimum standards; a Physical Plant Evaluation outlining Title 24 requirements for design; and, a Living Area Space Evaluation summarizing the physical plant configuration and showing the capacity of the facility. Refer to the Title 15 Checklist for compliance status and evidence used to determine compliance. LOCAL INSPECTIONS In addition to the biennial inspection by the BSCC, inspections are also required annually by the County Health Officer and biennially by the State Fire Marshal or an authorized representative (Health and Safety Code Sections 101045 and 13146.1). Please consider our report in conjunction with the reports from the County Health Officer and the respective fire authorities for a comprehensive perspective of your facility. Each of the local inspections were current in the Main Jail with the exception of the Medical/Mental Health inspection. The Court Holding Facility could not provide documentation for local inspection reports for their Fire, Environmental Health and Medical/Mental Health inspections. Undersheriff Bill Steven said he would advise the BSCC when the reports were located or when the inspections have been completed. BSCC staff also notified the Court Executive Officer, Esperanza Esparza, of the inspection deficiencies on the day of the inspection. Prior to completing this report, Undersheriff Bill Steven notified the BSCC that all local inspections for the Court Holding Facility were completed and up to date. 0640/0645 Del Norte LTR 18-20 1 Facilities are assessed against Title 24 requirements in place at the time of design or significant remodel to the jail area. Sheriff Erik Apperson Del Norte County Page 2 Facility Fire Environmental Medical/Mental Nutritional Health Inspection Health Health County Jail 10/24/2019 3/11/2020 3/11/2020 7/9/2019 Court Holding 4/27/2020 4/27/2020 4/27/2020 N/A BSCC INSPECTION Title 15, CCR Inspection The inspection consisted of a review of policies and procedures related specifically to applicable Title 15, CCR sections1, a site visit to review operations, physical plant and relevant documentation, and interviews with administration, facility staff, inmates, and collaborative partners. The following items of noncompliance with Title 15, CCR were identified; please refer to the Procedures Checklist for detailed information and technical assistance: County Jail Title 15, Section 1027.5 Safety Checks During the review of safety check documentation, BSCC staff determined the agency to be noncompliant with this regulation based on safety check logs being incomplete or intermittently completed and routinely exceeding the 60-minute time lapse between checks as required by this regulation. It was also noted that, prior to January 2020; safety checks were not being conducted at random intervals as stated in definitions of a safety check. The logs had predesignated times to complete safety checks on the hour. Del Norte Court Holding Facility Title 15, Section 1027 Number of Personnel BSCC staff determined the agency to be noncompliant with this regulation due to not having sufficient staff to ensure the implementation and operation of the programs and activities required by these regulations. During the onsite physical plant evaluation, interviews with the Correctional Technician and the Undersheriff, BSCC staff determined the agency noncompliant with this regulation based on not having an employee immediately available and accessible to inmates in the event of an emergency. The information provided during the inspection clearly indicated the Correctional Technician is not allowed to respond to the holding cells and the Bailiff is assigned to the courtrooms where they would be unable to respond to an inmate emergency when court is in session. 1 BSCC reviews only those policy and procedures required by, and applicable to, Title 15, CCR. BSCC staff do not “approve” policies and procedures nor do we review them for constitutional or legal issues. We recommend agencies seek review through their legal advisor, risk manager and other persons deemed appropriate. 0860 0865 Del Norte CCF CH LTR 18-20 Sheriff Erik Apperson Del Norte County Page 3 Title 15, Section 1027.5 Safety Checks BSCC staff determined the agency to be noncompliant with this regulation due to not being able to provide documentation for court holding safety checks being conducted when holding county inmates. During the review of the log book and interviews with staff, the log only indicated the names of inmates brought to the court holding facility from CDCR and the jail. Title 24, CCR Physical Plant No changes were made to the physical plant of the jail or court holding facility during this rating cycle. There are no outstanding items of noncompliance with Title 24 minimum standards. Please see the Living Area Space and Physical Plant Evaluations for detailed information. Juvenile Justice and Delinquency Prevention Act Compliance Monitoring The BSCC monitors local detention facilities for compliance with the JJDPA. Minors are not held at the Del Norte County Jail and have designated areas separate from adult inmates at the Court Holding Facility. (b) The facility administrator, in cooperation with the responsible physician, shall develop written policies and procedures for the use of restraint devices on pregnant ☐ ☐ ☒ minors. The policy shall address requirements of Penal Code 3407. Policy shall include reference to the following: (1) A minor known to be pregnant or in recovery after delivery shall not be restrained by the use of leg irons, ☐ ☐ ☒ waist chains, or handcuffs behind the body. (2) A pregnant minor in labor, during delivery, or in recovery after delivery, shall not be restrained by the ☐ ☐ ☒ wrists, ankles, or both, unless deemed necessary for the safety and security of the minor, the staff, or the public.
