A pre-inspection briefing was held on September 10, 2021, and the facilities were inspected on November 4, 2021. The following facilities were inspected: JAIL COURT HOLDING Del Norte Jail Del Norte Court Holding Pursuant to Penal Code Section 6031, these inspections were performed to determine compliance with the Minimum Standards for Local Detention Facilities as outlined in Titles 15 and 24, California Code of Regulations. In addition, BSCC staff conducted compliance monitoring pursuant to Welfare and Institutions Code Section 209(f) for the federal Juvenile Justice and Delinquency Prevention Act (JJDPA) for the separation requirements of juveniles from incarcerated adults. The complete Board of State and Community Corrections (BSCC) inspection report is enclosed and consists of the following: this transmittal letter; a Title 15 Procedures checklist, outlining applicable minimum standards for juvenile detention facilities; a Physical Plant Evaluation, outlining applicable Title 24 minimum standards; and the Living Area Space Evaluation (LASE), summarizing the physical plant configuration and outlining the rated capacity of the 146. BSCC INSPECTION Title 15, CCR Minimum Standards The inspection consisted of reviewing policies and procedures related specifically to applicable Title 15, CCR sections, a site visit to review operations, a physical plant evaluation, a review of relevant documentation, and interviews with administration staff, facility staff, persons incarcerated, and collaborative partners. Items of compliance: The following items of noncompliance with Title 15, CCR were identified: Del Norte Jail Title 15, Section 1027.5 Safety Checks BSCC staff reviewed safety check documentation from March 2021 through October 2021. During the review, BSCC staff determined the agency is noncompliant due to safety 1 BSCC reviews only those policy and procedures required by, and applicable to, Title 15, CCR. BSCC staff do not “approve” policies and procedures or assess them for constitutional or legal issues. Title 15, Section 1032 Fire Suppression Preplanning During the documentation review, BSCC staff determined the agency is noncompliant with this regulation due to not having documented monthly fire inspections conducted by staff from February 2020 through October of 2021. Title 15, Section 1280 Facility Sanitation, Safety, and Maintenance During the onsite inspection, BSCC staff determined the agency is noncompliant with this regulation for various areas needing maintenance and other noncompliance issues noted in the Del Norte County Environmental Health Inspection report. Del Norte Court Holding Facility Title 15, Section 1032 Fire Suppression Preplanning (b) During the documentation review, BSCC staff determined the agency is noncompliant with this regulation due to not having documented monthly fire inspections conducted by staff from February 2020 through October of 2021. Title 24, CCR Physical Plant There were no changes made to the physical plant, and your rated capacity remains at 146. Please see the Physical Plant Evaluation for more information. There is one item of noncompliance with Title 24 minimum standards. Title 24, Section 1231.3.9 Mirrors The mirrors in Modules A-E need to be replaced due to being in disrepair. Training According to the most recent Standards and Training for Corrections (STC) audit, the Del Norte County Sheriff’s Office is in compliance with all relevant regulations and mandates and mitigating circumstances, if applicable, except: Title 15 Section 1025 Continuing Professional Education The agency was found noncompliant with this regulation by the BSCC Standards and Training for Corrections (STC) division for not having annual required training specified in Section 184 of Title 15, CCR. Please refer to the Title 15 Procedures checklist for detailed information. Corrective Action Plan On November 9, 2021, BSCC staff held an Exit Brief with you and your staff. BSCC staff provided the Initial Inspection Report outlining items of noncompliance requiring a Corrective Action Plan (CAP) to be submitted to BSCC staff by December 9, 2021. During that briefing, BSCC staff provided an overview of the biennial inspection and the Enhanced Inspection Process and provided technical assistance and best practice recommendations. BSCC staff also discussed ligature areas for you and your staff. Your agency provided a Corrective Action Plan on November 30, 2021, addressing the noncompliant issues; we will respond to the CAP under a separate cover letter.
