Box 1788 Fresno, CA 93717 Dear Sheriff Mimms: BIENNIAL INSPECTION, FRESNO COUNTY SHERIFF’S OFFICE, ADULT DETENTION FACILITIES, PENAL CODE SECTION 6031 During the week of April 30, 2018, the Board of State and Community Corrections (BSCC) conducted the 2016-2018 biennial inspection of the Fresno County Jails and court holding facilities. The facilities were inspected for compliance with the Minimum Standards for Local Detention Facilities, as outlined in Titles 15 and 24, California Code of Regulations. The inspection consisted of a review of applicable written policies and procedures governing the operation of the facility, a site visit, and a review of documentation to verify that regulated practices occur as required. Captains Ron Vega and Stephen McComas, Lieutenants John Copher and Rich Wilhoite, and Sergeants Matt Nunley, Robert Buenrosto and Chris Curran were instrumental in the inspection process and your facilities were well prepared for our visit. The complete BSCC inspection report is enclosed and consists of: this transmittal letter; the Procedures checklists outlining applicable Title 15 sections for both jail and court holding facilities; and individual Physical Plant Evaluations and Living Area Space Evaluations that summarize each facility’s physical plant configuration. We encourage the practice of maintaining a permanent file for historical copies of all inspections that would also include documentation of corrections made following the inspections. This file should be the first point of reference when preparing for all future inspections. Local Inspections In addition to a biennial inspection by the BSCC, inspections are required by the County Health Officer annually and the State Fire Marshal (or designee) biennially. Jail fire inspections are current but a fire clearance was withheld pending corrections. Fire inspections for some court holding facilities are overdue, leading to the following issue of non-compliance: Title 15 Section 1032: Fire Suppression Preplanning – This regulation requires fire prevention inspection at least once every two years. Inspections are overdue for the court holding facilities at Superior Court, B. F. Sisk Court and the Juvenile Justice court. All other inspections revealed no significant areas of non-compliance. The individual inspector’s comments and concerns were noted in their local reports, including discussion of maintenance and housekeeping issues. Refer to original local inspection reports for other details. BSCC Inspection Title 24 - Physical Plant Generally, jails are designed in accordance with Title 24 standards which establish the capacity of cells based on living space, recreational space and fixtures such as washbasins and showers. Those capacities are the “Rated Capacity” and are used by BSCC to compare a facility to the applicable standards. But, the Sheriff’s Department reports that, because of a lawsuit, a court has allowed the county’s jails to exceed the BSCC capacities. For the purposes of this report, we compare the physical plants to the capacities as established by BSCC and not any other standards. 0700+ Fresno II CH 16-18 Ltr: 8/29/2018 Margaret Mimms, Sheriff Page 3 Main Jail: Completed in 1989, the Main Jail was evaluated using physical plant standards from 1980, 1988 and 1994.1 At the time of our site visit, two sobering cells were out of service due to damage but were returned to service prior to the submission of this report. The facility operates an intake & release area on the first floor and five housing floors consisting of single, double and multiple cell types. The combined capacity of the housing cells is 1,064 and the facility housed 897 inmates on the day of our visit. Despite its age, the facility was clean and no items of deferred maintenance were noted. South Annex Jail: This facility was opened in 1941 and is evaluated using physical plant standards from 1963, 1986, 1988 and 1994. The four-floor facility consists of holding cells, dorms, single cells and multiple cells. The first-floor cells have been removed from service, leaving 379 usable bunks for housing, plus holding and special use cells. The BSCC rated capacity remains unchanged at 528, regardless of the closed housing areas. At the time of our site visit, 420 inmates were housed. A new facility, the West Annex, is under construction and will replace this facility when completed. Due to crowding, the following issue of non-compliance was noted: Title 24 Section 8227 Multiple Cells (1963): This regulation establishes the criteria for multiple cells, including a minimum space of 500 cubic feet per inmate. Cells 3 C&D, 4 A&C and 4 D, E&F each had more inmates housed than permitted by the space available. North Annex Jail: This facility was opened in 1992 and is evaluated using physical plant standards from 1988 and 2001. The facility has a rated capacity of 1,152 inmates, all held in dormitory housing. On the day of our inspection, the facility held 1,532 inmates. Twenty-three of twenty-four dorms exceeded their BSCC rated capacity. The facility was clean, and no evidence of deferred maintenance was noted. The following issues of non-compliance at the North Annex Jail were noted: Title 24 Section 1231.2.8 Dormitories: This regulation establishes criteria for dormitories including the maximum number of inmates allowed in any single dorm (64 inmates). Dorms on all floors exceeded the maximum permissible count for any dorm. Title 24 Section 1231.2.9 Dayrooms: This regulation establishes the minimum dayroom space for each inmate (35 square feet). All housing on the second through fifth floors (except Pod 2A) lacked sufficient dayroom space for the number of inmates confined. Title 24 Section 1231.3.1 Toilets: This regulation establishes the minimum toilet-to-inmate ratio to inmates at 1:10. Each dorm has six toilets installed but nearly all dorms exceeded 60 inmates. Due to crowding, not enough toilets were available in dorms on all floors. Title 24 Section 1231.3.2 Washbasins: This regulation establishes the minimum washbasin- to-inmate ratio to inmates at 1:10. Each dorm has six washbasins installed but nearly all dorms exceeded 60 inmates. Due to crowding, not enough washbasins were available in dorms on all floors. 1 Facilities are evaluated against the versions of Title 24 in effect at the time of construction or significant remodel. It is common for different revisions of Title 24 to be applicable to a single facility. 0700+ Fresno II CH 16-18 Ltr: 8/29/2018 Margaret Mimms, Sheriff Page 4 Title 24 Section 1231.3.4 Showers : This regulation establishes the minimum shower-to-inmate ratio to inmates at 1:20. Each dorm has three showers installed but nearly all dorms exceeded 60 inmates. Due to crowding, not enough showers were available in dorms on all floors. B.F. Sisk Court Holding: This facility is a former federal court and is evaluated against the 2005 Title 24 standards. The facility has a capacity of 68 inmates, held in 19 holding cells on four floors. No areas of non-compliance were noted. North Annex Court Holding: The North Annex Court holding facility is co-located with the North Annex jail. The facility was constructed or remodeled in 1994 and is inspected under the 1992 Title 24 standards. The facility has a capacity of 89 inmates held in nine holding cells. No areas of non- compliance were noted regarding the physical plant. Juvenile Justice Court Holding: The Juvenile Justice Center court holding facility is used to hold adults summoned to the juvenile courts. The facility was constructed in 2009 and is evaluated under the 2005 Title 24 standards. The facility appears new and is well maintained. It has the capacity to hold 14 adults and 90 juveniles. Separation is maintained by moving juveniles directly from housing to the courtrooms. No inmates were present during our site visit. No areas of non-compliance were noted regarding the physical plant. Superior Court Holding: The Fresno Superior Court holding facility was constructed in 1965 and evaluated under the 1963, 1980, 1988 and 1994 Title 24 standards. The facility has a capacity of 123 inmates, held in 21 cells. No areas of non-compliance were noted regarding the physical plant. Regarding the physical plants, no other issues of non-compliance were noted. Title 15 Inspection – Operational Review During the inspection, BSCC staff reviewed applicable policy, procedures, practices and supporting documentation as indicated. Policy 2– A single policy manual, supplemented by facility-specific Operational Orders, applies to all facilities, both jails and court holding. We noted that all components required by regulation were found in policy. Policies are reviewed annually and revised as needed. BSCC recommends that specialized policy be developed for court holding facilities which may require different procedures than the jails (e.g. counts.) Training –The most recent Standards and Training for Corrections (STC) audit (September 2017) found the agency in compliance with all training requirements. We interviewed line staff and found them knowledgeable about emergency procedures, Title 15 standards and related issues. The agency self-certified that all court holding staff met the minimum training standards. The agency has implemented a corporal rank for career training, but all actual supervision is conducted by Sheriff’s sergeants. All supervisors are current in supervisory training. 2 BSCC does not review all your policies and procedures. We only review those policies related specifically to the applicable regulations included in Title 15, Minimum Standards for Local Detention Facilities for issues on non-compliance. We do not “approve” your policies nor do we review them for constitutional or legal issues. We recommend agencies seek policy review through their legal advisor, risk manager, and other people deemed appropriate. 0700+ Fresno II CH 16-18 Ltr: 8/29/2018 Margaret Mimms, Sheriff Page 5 Procedures - BSCC also reviewed a variety of records to ensure that procedures relevant to Title 15 standards matched policy and that all required procedures were being performed within regulated criteria. To assess the facility’s staffing levels, BSCC reviewed security logs, shift rosters, incident reports, and related records which give insight to the facility’s operation. For the housing units, records of time-sensitive events, including meal and laundry services, safety checks, recreation movements and non-professional visiting, are kept in automated journals. We noted that safety checks were consistently timely. Out of cell opportunities (recreation, exercise, etc.) are documented and met the required minimum frequency. We reviewed grievances and did not note persistent complaints about missed recreation, visits, laundry exchanges or other activities which are often delayed in understaffed facilities. Grievances were all reviewed by a supervisor and were accepted for any condition of confinement. We interviewed inmates at each jail. Inmates complained about crowded conditions generally but did not complain specifically about missed programming, cold food or yard opportunities, which is often the case in crowded facilities. Intake medical screening is conducted by trained staff and a medical professional assesses all inmates prior to housing. Overall, despite the crowded conditions, we found no indication that staffing was insufficient to meet the minimum standards. Inmates in certain high-risk low-incidence conditions often require supervision in special use equipment and cells, such as restraint chairs, sobering cells and safety cells. Specialty cells are only available at the Main Jail as the safety cells at South Annex have been closed. Restraints: Each use of restraints (restraint chair) is documented by an incident report while timed events are tracked in the automated event tracking system. BSCC reviewed a sampling of events and found documentation to be clear and comprehensive. Checks and interventions, including medical and supervisory checks, are logged electronically and were consistently timely. Sobering Cells: Sobering cell logs at the Main Jail revealed timely safety checks and supervisory oversight. Logs verify that the cell’s occupants, as a group, are observed at least every 30 minutes. Medical and supervisory interventions were timely. Medical staff assessed any inmate remaining in the cell longer than six hours. Safety Cells: There are four safety cells at the Main Jail, all in the intake area. Safety cells are used for violent or self-injurious inmates requiring mental health intervention. The need to place an inmate in the safety cell, along with the supervisor’s oversight, is recorded in an incident report for each placement. All required events, such as safety checks and offers of food and water, are recorded electronically. A sampling of safety cell confinements was reviewed and all events and interventions by custody and medical staff were noted to be timely and complete. Supervisory and management oversight was evident. Programming and educational offerings are limited by space and capacity but are delivered upon request. A variety of outreach programs are offered by ten staff members and volunteers. The opening of the West Annex should provide more programming space. 0700+ Fresno II CH 16-18 Ltr: 8/29/2018 Margaret Mimms, Sheriff Page 6 Operations in the court holding facilities are overseen by Sheriff’s sergeants. Classification and hazard information from the jail was effectively communicated to court staff on paper files. Remanded arrestees are not mixed with jail inmates prior to classification and medical screening. Safety checks were timely. Concerning procedures, no areas of non-compliance were noted at any of the facilities. Juvenile Justice and Delinquency Prevention Act (JJDPA) Compliance Monitoring: In accordance with the JJDPA, BSCC monitors jail facilities for compliance with one of four core requirements of the Act - Separation of Juveniles from Incarcerated Adults. Minors are not housed at the jails. Effective separation is maintained at the Juvenile Justice Center, the only court holding facility that accepts both adult and minor offenders. No violations of the JJDPA were identified.
