May 11, 2020 William Honsal, Sheriff-Coroner Humboldt County Sheriff’s Office 826 4th Street Eureka, CA 95501 2018-2020 BIENNIAL INSPECTION OF HUMBOLDT COUNTY SHERIFF’S OFFICE JAIL AND COURT HOLDING FACILITY, PENAL CODE 6031 Dear Sheriff Honsal: Between February 24-25, 2020, Board of State and Community Corrections (BSCC) staff conducted the 2018-2020 biennial inspection of the Humboldt County Sheriff’s Office County Correctional Facility and the Court Holding Facility. Pursuant to Penal Code Section 6031, this inspection was performed to determine compliance with the Minimum Standards for Local Detention Facilities as outlined in Titles 15 and 24, California Code of Regulations (CCR). In addition, BSCC conducted compliance monitoring pursuant to Welfare and Institutions Code Section 209(f) and the federal Juvenile Justice and Delinquency Prevention Act (JJDPA). The complete BSCC inspection report is enclosed and consists of: this transmittal letter; the Title 15 Procedures Checklist outlining applicable minimum standards; a Physical Plant Evaluation outlining Title 24 requirements for design; and, a Living Area Space Evaluation summarizing the physical plant configuration and showing the capacity of the facility. Refer to the Title 15 Checklist for compliance status and evidence used to determine compliance. LOCAL INSPECTIONS In addition to the biennial inspection by the BSCC, inspections are also required annually by the County Health Officer and biennially by the State Fire Marshal or an authorized representative (Health and Safety Code Sections 101045 and 13146.1). Please consider our report in conjunction with the reports from the County Health Officer and the respective fire authorities for a comprehensive perspective of your facilities. The following items of noncompliance with Title 15, CCR were identified; please refer to the Procedures Checklist for detailed information and technical assistance: Humboldt County Correctional Facility Title 15, Section 1027.5 Safety Checks The agency provided BSCC staff with seven months of documentation of safety checks to review. During the review of safety checks in dormitory housing, BSCC staff determined your agency is noncompliant with this regulation for not routinely completing safety checks with the 60-minute time frame as required by this regulation. The documentation for the dormitory housing areas showed consistently late safety checks throughout each shift with no supervisory notification. During the review of cell housing safety checks, BSCC staff noted you are in compliance with this regulation for completing safety checks within the 60-minutes. However, you are not in compliance with your agency’s own policy for conducting 30-minute safety checks. The documentation for the cell housing areas showed consistently late safety checks throughout each shift with no supervisory notification. Title 15, Section 1032 Fire Suppression Preplanning On the day of inspection, the agency’s staff could not produce monthly fire prevention inspection documents for BSCC staff to review as required by this regulation. 1 BSCC reviews only those policy and procedures required by, and applicable to, Title 15, CCR. BSCC staff do not “approve” policies and procedures nor do we review them for constitutional or legal issues. We recommend agencies seek review through their legal advisor, risk manager and other persons deemed appropriate. 0860 0865 Humboldt CCF CH LTR 18-20 Sheriff-Coroner William Honsal Humboldt County Page 3 Humboldt Court Holding Facility Title 15, Section 1024 Court Holding and Temporary Holding Facility Training The agency provided a copy of their Standards and Training for Corrections (STC) signature roster for Temporary Holding Facility refresher training. The roster was dated 7/15/2017. BSCC staff determined the agency to be noncompliant for not completing refresher training once every two years for bailiffs who supervise inmates in holding. Title 15, Section 1030 Suicide Prevention Program and (a) The agency could not provide current suicide prevention training documentation for the bailiff’s assigned to supervise inmates. Title 15, Section 1032 Fire Suppression Preplanning (b) On the day of inspection, the agency’s staff could not produce monthly fire prevention inspection documents for BSCC staff to review as required by this regulation. Title 24, CCR Physical Plant No changes were made to the physical plant of the County Correctional Facility or the Court Holding Facility during this rating cycle. There is one outstanding item of noncompliance with Title 24 minimum standards. Please see the Living Area Space and Physical Plant Evaluations for detailed information. County Correctional Facility Title 24, Section 2.8 Dormitories On the day of inspection, BSCC staff determined your agency to be noncompliant with this regulation due to being over BSCC rated capacity in Dorms S363, S385 and S555. Juvenile Justice and Delinquency Prevention Act Compliance Monitoring The BSCC monitors local detention facilities for compliance with the JJDPA. Minors are not held at any of the Humboldt County Sheriff’s Office County Detention Facility. Minors are brought to the Humboldt County Courthouse by Probation staff. Minors are kept out of sight and sound of adult inmates. Probation staff maintain control and supervision of the minors while in the court house at all times. Technical assistance was provided to your Compliance Sergeant by discussing various ways and times shift supervisors or senior deputies could conduct compliance checks of opposite teams. This would provide transparency and generate documentation to hold staff accountable to complete safety checks within the required time frames by regulation and your agency’s policy. Notwithstanding the use of the video as evidence in a criminal proceeding, the tape shall be retained administratively. 1061 INMATE EDUCATION PROGRAM M-001 Facility Programs, General M-003 Learn Program The facility administrator of any Type II or III facility shall ☒ ☐ ☐ M-004 Substance Abuse Programs plan and shall request of appropriate public officials an inmate education program. Reasonable criteria for program eligibility shall be M-003 Learn Program established and an inmate may be excluded or removed ☒ ☐ ☐ based on sound security practices or failure to abide by facility rules and regulations. 1062 VISITING M-012 Inmate Visiting (a) The facility administrator shall develop written policies ☒ ☐ ☐ and procedures for inmate visiting which shall provide for as many visits and visitors as facility schedules, space, and number of personnel will allow. (TYPE II ONLY) M-012 Inmate Visiting All inmates in Type II facilities are allowed at least two ☒ ☐ ☐ visits totaling at least one hour per inmate each week. (TYPE III ONLY) M-012 Inmate Visiting Inmates in Type III facilities are allowed one or more ☐ ☐ ☒ visits, totaling at least one hour per week. (c) The visiting policies developed pursuant to this section M-012 Inmate Visiting shall include provision for visitation by minor children of ☒ ☐ ☐ the inmate. (d) Video visitation may be used to supplement existing M-012 Inmate Visiting visitation programs, but shall not be used to fulfill the ☐ ☐ ☒ requirements of this section if in-person visitation is requested by an inmate. (e) Facilities shall not charge for visitation when visitors are M-012 Inmate Visiting onsite and participating in either in-person or video ☐ ☐ ☒ visitation. Inmates classified as Protective Custody will visit on Sundays 1900-2130 and on Thursdays 1230-1530. Inmates classified as General Population will visit on Tuesdays 1900- 2130 and on Fridays 1230-1530. Any restrictions on inmate visitation.
