July 25, 2020 Ted Stec, Chief of Police Bishop Police Department 207 West Line Street Bishop, CA 93514 2018-2020 BIENNIAL INSPECTION OF BISHOP POLICE DEPARTMENT, TEMPORARY HOLDING FACILITY, PENAL CODE 6031 Dear Chief Stec: On May 20, 2020, staff of the Board of State and Community Corrections (BSCC) conducted the 2018-2020 biennial inspection of the Bishop Police Department Temporary Holding Facility. Pursuant to Penal Code Section 6031, this inspection was performed to determine compliance with the Minimum Standards for Local Detention Facilities as outlined in Titles 15 and 24, California Code of Regulations (CCR). In addition, BSCC staff conducts compliance monitoring pursuant to the federal Juvenile Justice and Delinquency Prevention Act (JJDPA) for the separation requirements of juveniles from incarcerated adults. Due to the coronavirus pandemic and the issuance of a statewide shelter-in-place order, the BSCC was unable to complete on-site inspections from mid-March through June 30, 2020, the end of the 2018-2020 biennial inspection cycle. BSCC staff conducted virtual inspections via desk audit of all facilities originally scheduled for inspection during this time. Desk audits are comprised of a comprehensive review of all applicable policies and procedures and documentation. The complete BSCC inspection report is enclosed and consists of this transmittal letter, the Title 15 Procedures Checklist outlining applicable minimum standards, a Physical Plant Evaluation Outlining Title 24 requirements for design and, a Living Area Space Evaluation summarizing the physical plant configuration and showing the capacity of the facility. Refer to the Title 15 Checklist for indication of compliance status and evidence used to determine compliance. LOCAL INSPECTIONS In addition to the biennial inspection by the BSCC, inspections are also required annually by the County Health Officer and biennially by the State Fire Marshal or an authorized representative (Health and Safety Code Sections 101045 and 13146.1). Inspection Date Fire and Life Safety June 16, 2020 Environmental Health July 1, 2020 Health Inspections We have a current health inspection report for the above listed facility. The local health inspector found no items of non-compliance. BSCC INSPECTION The inspection consisted of a review of the Bishop Police Department Policy Manual which includes procedures for the operation of the Temporary Holding Facility. In addition, relevant documentation, phone interview with Lieutenant Joshua Ellsworth, and a discussion of any changes to the physical plant of facility. Title 15, CCR Inspection Our evaluation consisted of reviewing only those policies and procedures related specifically to the applicable regulations included in Title 15, CCR.1 We identified the following items of noncompliance: Title 15, §1024, Court Holding and Temporary Holding Facility Training Custodial personnel who supervise inmates in, and supervisors of, a Court Holding or Temporary Holding facility shall complete 8 hours of specialized training. Additionally, eight hours of refresher training shall be completed once every two years. Training has not been completed in the last three years. Title 15, §1032, Fire Suppression Preplanning Regular fire prevention inspections by facility staff on a monthly basis with two-year retention of the inspection record BSCC Staff requested two years of fire prevention inspections. There were no inspections completed by facility staff. 1 BSCC does not review all policies and procedures. We do not “approve” policies and procedures, nor do we review them for constitutional or legal issues. Title 24, CCR Physical Plant Through interviewing with Lt. Ellsworth, BSCC Staff was informed that there were no changes made to the physical plant. The facility was originally constructed under the 1976 Title 24 Regulations. On the day of the interview, there were no inmates being held in the facility. There were no issues of non-compliance. Juvenile Justice and Delinquency Prevention Act Compliance In accordance with JJDPA. BSCC monitors jail facilities for compliance with one of four core requirements of the Act, Separation of Juveniles from Incarcerated Adults. Minors are not detained in the lockup at this facility; therefore, no violations of the JJDPA were identified. Technical Assistance At the conclusion of the inspection interview, BSCC staff provided a debrief of the items found out of compliance. Understanding the issues with the current COVID-19 emergency and being able to send personnel to be trained, on-line and other training options were discussed with Lt. Ellsworth to address the required training. Additionally, examples of fire and life safety checklists were also provided to help develop a local monthly inspection form. Corrective Action Plan If you choose to address the noncompliance issues noted above, please provide a corrective action plan so that we may update our files to indicate compliance.
