October 16, 2018 Erik Hurtado, Chief of Police California City Police Department 21130 Hacienda Blvd. California City, CA 93505 2016 – 2018 BIENNIAL INSPECTION CALIFORNIA CITY POLICE DEPARTMENT BSCC# 1090 PENAL CODE SECTION 6031; WELFARE AND INSTITUTIONS CODE SECTION 209; JUVENILE JUSTICE AND DELINQUENCY PREVENTION ACT Dear Chief Hurtado: On May 30, 2018, the Board of State and Community Corrections (BSCC) staff conducted the 2016 – 2018 biennial inspection of the California City Jail pursuant to Penal Code Section 6031 and Welfare and Institutions Code (WIC) Section 209. The jail was inspected for compliance with the Minimum Standards for Local Detention Facilities as outlined in Titles 15 and 24, California Code of Regulations and the federal Juvenile Justice and Delinquency Prevention Act (JJDPA) requirements for holding minors. The inspection consisted of a walk-through of the physical plant, a review of applicable written policies and procedures governing the operation of the facility, and a review of documentation to verify that your practices follow your written procedures. Sergeant’s Jack Craig and Ben Blanton were present during the inspection and assisted by answering questions and clarifying procedural issues. Their involvement in the inspection process was extremely valuable. The professionalism and courtesy extended is appreciated. The complete BSCC inspection report is enclosed and consists of: • This transmittal letter; • The Procedures Checklist outlining applicable Title 15 sections; • The Physical Plant Evaluation outlining Title 24 requirements for design; and, • The Living Area Space Evaluation that summarizes the detention facility configuration. Local Inspections: In addition to a biennial inspection by the BSCC, inspections are also required by the County Health Officer and the State Fire Marshal or local fire inspector (Health and Safety Code Sections 101045 and 13146.1). Please consider our report in conjunction with the reports from the Health Department and the fire inspector for a comprehensive perspective of your facility. 1090 California City TH Letter Erik Hurtado, Chief of Police California City Police Department Page 2 Fire Inspection: Health and Safety Code Section 13146.1 requires a biennial inspection for fire and life safety issues. This was completed on May 30, 2018. Fire clearance was granted with no cited deficiencies. Health Inspections: The local health authority is required to conduct annual inspections of all local detention facilities, including evaluation of medical/mental health and the environmental health standards. A nutritional inspection is not required for Temporary Holding Facilities. The following is the date of the most recent inspections. Inspection Date Health-Environmental April 11, 2018 Health-Medical/Mental Health April 3, 2018 Health-Nutrition Not required No issues of non-compliance were noted in either of the local health inspection reports. We encourage the practice of maintaining a permanent file for historical copies of BSCC inspection files along with the local inspections outlined above. Additionally, you should maintain documentation of how and when areas of non-compliance/concerns are resolved. BSCC Inspection Physical Plant: Completed in 1994, the California City Jail is inspected as a temporary holding facility and evaluated using the 1991 Title 24 regulations. The facility consists of three holding rooms and one sobering cell, for a capacity of 15 inmates. There was one inmate in custody at the time of the inspection in the sobering cell. The jail was clean and appeared well maintained. No issues of non-compliance with applicable physical plant standards were identified. Please see the Procedures Checklist for detailed information. Minors in secure detention are held in a locked interview room, outside of the facility’s secure perimeter, and sight and sound separate from adult inmates. Minors in non-secure detention are held in an interview room or officer briefing area. Policies, Procedures, and Practices: During the inspection, we reviewed applicable policy, procedures, practices and supporting documentation where necessary. Those evaluations included a review of documentation related to jail operations including security logs, shift schedules, local inspection results, incident reports, classification documents and other records which give insight to the facility’s operations1. 1BSCC does not review all of your policies and procedures, only those related specifically to the applicable regulations in Title 15, Minimum Standards for Local Detention Facilities. We do not “approve’ your policies nor do we review them for constitutional or legal issues. 1090 California City TH Letter Erik Hurtado, Chief of Police California City Police Department Page 3 Inmates are supervised by the Watch Commander or Sergeant at the jail, or in some instances, by the arresting officer. In most cases, inmates are not heled beyond six hours before release or transfer to the Kern County Jail. Female inmates are only booked when a female staff person is immediately available. We also noted, female dispatchers, who are trained, would occasionally supervise female inmates. BSCC sought out evidence to ensure practices matched regulations. We reviewed a sampling of bookings for the inspection cycle and noted several instances of incomplete documentation. Technical assistance was provided to include an audit process to ensure completeness and accountability for the booking logs. We found consistent safety checks, screenings and housing requirements. Safety checks were timely and random. Suicidal or mentally disordered inmates and those requiring restraint are not booked at this facility. Inmates requiring exceptional supervision, such as intoxicated inmates or those having medical issues, are not accepted at this facility and are booked at a sub-station or county jail in Bakersfield. We note your policy for Emergency Procedures lacks the details required by regulation. Title 15, Section 1029 - Policy and Procedures Manual, indicates the Administrator shall maintain specific policies and procedures for emergencies. We were unable to locate such specific policies while on-site. Also, your current Lexipol Manual was last updated in January 2016. Section 1029 requires a review and update every two years. The following issue of non-compliance was noted: Title 15, Section 1029: Policy and Procedure This regulation requires the agency to maintain a published manual of policies and procedures which include Emergency Procedures. Policy 900.11 identifies the agency Administrator is to have specific procedures for various emergencies. We were unable to locate such procedures. This section also requires you update your manual every two years. The last update was in January 2016. To ensure compliance, please identify and include procedures for emergencies identified in regulation and provide us with an updated copy of your Policy and Procedure manual. JUVENILE JUSTICE AND DELINQUENCY PREVENTION ACT (JJDPA) COMPLIANCE MONITORING: Pursuant to WIC§ 209, we reviewed applicable policy, procedures, practices and supporting documentation to comply with Title 15 Article 9, Minors in Custody in a Law Enforcement Facility. In accordance with the JJDPA, BSCC monitors law enforcement facilities for compliance with three core requirements of the Act: Deinstitutionalization of Status Offenders, Separation of Juveniles from Incarcerated Adults, and Removal from Adult Jails and Lockups (6-hour secure detention limitation). We reviewed the log to date for this cycle and found 1 youth was held in secure detention and 87 were held in non-secure detention.
