August 8, 2018 Donny Youngblood, Sheriff-Coroner Kern County Sheriff's Office 1350 Norris Road Bakersfield, CA 93308 2016-2018 BIENNIAL INSPECTION, PENAL CODE 6031, WELFARE & INSTITUTION CODE 209 KERN COUNTY'S TYPE I, TYPE II, TEMPORARY HOLDING AND COURT HOLDING FACILITIES Dear Sheriff Youngblood, In June of 2018, staff of the Board of State and Community Corrections (BSCC) conducted the 2016-2018 biennial inspection of the following Kern County local detention facilities: Central Receiving Facility Lerdo Pre-Trial Facility Lerdo Maximum/Medium Lerdo Minimum Facility Taft Court Holding Mojave Jail Justice Building Court Holding Kern River Valley Sheriff's Shafter Court Holding Substation Delano Court Holding Lamont Sheriff's Substation and Kern Justice Facility Court Holding Pursuant to Penal Code Section 6031, these inspections were performed to determine compliance with the Minimum Standards for Local Detention Facilities as outlined in Titles 15 and 24, California Code of Regulations. In addition, BSCC staff conducted compliance monitoring pursuant to Welfare and Institutions Code Section 209(f) for the federal Juvenile Justice and Delinquency Prevention Act (JJDPA) for the separation requirements of juveniles from incarcerated adults. The complete BSCC inspection report is enclosed and consists of: this transmittal letter; four Title 15 Procedures checklists outlining Title 15 requirements for each facility; a Physical Plant Evaluation outlining Title 24 requirements for the design for each facility; and, a Living Area Space Evaluation summarizing the physical plant configuration and showing the capacity of each facility. The BSCC is in receipt of a letter from Chief Deputy Larry McCurtain stating the Ridgecrest Jail Facility was closed on June 30, 2016; the facility was not inspected during this cycle. Chief Deputy Larry McCurtain’s letter stated you will notify the BSCC if the decision is made to reopen the Ridgecrest Jail Facility. LOCAL INSPECTIONS In addition to the biennial inspection by the BSCC, inspections are also required annually by the County Health Officer and biennially by the State Fire Marshal or an authorized representative (Health and Safety Code Sections 101045 and 13146.1). Please consider our report in conjunction with the reports from the 1000+ Kern Ltr 16-18 Sheriff Donny Youngblood Kern County Sheriff’s Office Page 2 County Health Officer and the respective fire authorities for a comprehensive perspective of your facilities. We encourage the practice of maintaining a permanent file for historical copies of all inspections including documentation of corrections made following the inspection. This file should be the first point of reference when preparing for future inspections. Health Inspections The health inspections for each facility were current. There were no issues of noncompliance; however, the Health Inspector did make several notes for concerns to be addressed. If you choose to address the issues noted by the Health Inspector, please provide a corrective action to the BSCC to file with the inspection report. Fire and Life Safety Inspections The fire and life safety inspections for all the facilities were current. BSCC Inspection (Title 15, CCR; Policy and Procedures) Prior to the inspection, we reviewed the Kern County Sheriff’s Office Detentions Bureau Policy and Procedure Manual and the policy and procedures manuals for court holding and substations. Our audit consisted of a review of only those policies and procedures related specifically to the applicable regulations included in Title 15, Minimum Standards for Local Detention Facilities.1 Our review determined issues of noncompliance with the manual, and are summarized below. The on-site inspection of the facilities began with a review of documentation including safety check logs, incident reports, grievances and disciplinary actions to ensure practices are consistent with policies and Title 15. Our inspection revealed timely and appropriate responses to grievances and disciplinary reports were completed in accordance with Title 15. The Compliance Unit has an extensive tracking system for tracking, handling, assigning and conducting a follow up on the grievances filed. The review of the documentation for hourly safety checks disclosed a system wide discrepancy in the checks being completed within the required hour. We also reviewed documentation on the placement and management of inmates in the sobering cells, safety cells and restraints (when used as defined in Section 1058). We found the documentation conformed to applicable regulations and policies for inmates who are placed in a safety cell in accordance of Title 15 Section 1055 with the exception for inmates placed in a safety cell for suicide watch overflow. Such placements can be a major source of jail litigation, but when operated and managed according to regulation, exposure to litigation is reduced. The review for appropriate justification for placement in the sobering cells, safety cells and in restraints appeared to be with in Title 15 regulations. Documentation on the above mentioned items can be found in more detail on the Procedures Checklist. 1 BSCC does not review all of your policies and procedures. We do not “approve” your policies and procedures nor do we review them for constitutional or legal issues. We recommend agencies seek review through their legal advisor, risk manager and other persons deemed appropriate. 1000+ Kern Ltr 16-18 Sheriff Donny Youngblood Kern County Sheriff’s Office Page 3 The following system wide items of noncompliance were found: Title 15, Section 1029, Policies and Procedures Manual, requires that facility administrator(s) shall develop and publish a manual of policy and procedures for the facility. The policy and procedures manual shall address all applicable Title 15 and Title 24 regulations and shall be comprehensively reviewed and updated at least every two years. We determined the Detentions Bureau Policies and Procedures and the Temporary and Court Holding Station Policies (Shafter Court Holding, Delano Court Holding and Kern River Valley Sheriff's Substation) are noncompliant with Title 15 Section 1029 Policy and Procedures Manual due to the manuals not being comprehensively reviewed and updated at least every two years. The dates on numerous policies from the manuals are outside of the two-year requirement. Title 15, Section 1027, Number of Personnel, requires that a sufficient number of personnel shall be employed in each local detention facility to conduct at least hourly safety checks of inmates through direct visual observation of all inmates and to ensure the implementation and operation of the programs and activities required by these regulations. BSCC staff reviewed hourly safety checks documented at each facility for 2017 and 2018. The documentation showed staff were generally performing their safety checks, but they were not completed within the required sixty minutes at all detention facilities. Additionally, staff were not following your Detentions Bureau Policy, C-450 Directive 2, by not documenting the reason for the late safety check and notifying a supervisor. When interviewing staff and supervisors on the agency procedure for late safety checks, some were unaware of the policy process. At the end of our inspections at each facility, we made notifications to the Facility Commanders or their administrative staff. It should be noted the Facility Commander’s and the Compliance Unit were preparing to corrective actions for safety checks. Title 15, Section 1272, Mattresses, requires that any mattress issued to an inmate in any facility shall be enclosed in an easily cleaned, nonabsorbent ticking, and conform to the size of the bunk as referenced in Title 24, Part 2, Section 1231.3.5, Beds. During our inspection we observed and verified by interviews with staff, the use of the TheraBand Professional Floor Exercise Mat 24” x 75” being given to inmates placed in a safety cell for suicide watch overflow and in your suicide watch cells as a mattress substitute. When using the TheraBand Professional Floor Exercise Mat as a mattress, your agency is considered noncompliant with Title 15 Section 1272, Mattresses, Title 24, Part 2, Section 1231.3.5 and the State Fire Marshal on the Bureau of Home Furnishings Section, 1374 Flammability, test standard for penal mattresses. Facility Specific Central Receiving Facility (CRF) Title 15, Section 1056, Use of Sobering Cell, requires intermittent direct visual observation of inmates held in the sobering cell shall be conducted no less than every half hour. BSCC staff reviewed the sobering cell safety check observation logs in the presence of the Compliance Unit and the Facility Commander dated March, April and May of 2018 at the Central Receiving Facility (CRF). We found an issue of noncompliance with Title 15 Section 1056 on the safety checks having to be conducted no less than every thirty minutes. Our review of the documentation disclosed numerous safety checks over the required thirty minutes requirement at CRF during the months reviewed. 1000+ Kern Ltr 16-18 Sheriff Donny Youngblood Kern County Sheriff’s Office Page 4 Temporary and Court Holding Facilities Title 15 Inspection During our inspection of Temporary and Court Holding facilities, it was noted several facilities operate under their own Policy and Procedures. We reviewed the safety checks at the various facilities and found they were in compliance with Title 15. All of the facilities were very clean and well maintained. Facility Specific The following item of noncompliance was found: Shafter and Delano Court Holding Title 15, Section 1027, Number of Personnel, states whenever one or more female inmates are in custody, there shall be at least one female employee who shall in like manner be immediately available and accessible to such females. After reviewing policies and speaking with staff assigned, it was determined Shafter Court Holding and Delano Court Holding are noncompliant with Title 15 Section 1027 and your agency’s court policies A-103 and A-104 for not having a female available for female inmates in custody. It was communicated to us during the interview of staff, that a female staff member is not available most days when a female inmate is placed in a court holding cell from a jail facility and male deputies conduct a pat down in view of a recording camera on females who are remanded to custody prior to them being placed in a holding cell. As a reminder, Penal Code 4021 states there shall be trained female staff available for female prisoners. Title 24 Physical Plant Inspection The following system wide noncompliance issue was found: Title 24 CCR 1231.2.5 and Title 15 Section 1055, Use of Safety Cell, requires those inmates who display behavior which results in the destruction of property or reveals an intent to cause physical harm to self or others. The intended use of the safety cell is for short term holding of inmates until housing arrangements are made. The safety cell cannot be used as a substitution for treatment. Several observation logs we reviewed documented inmates being placed in a safety cell on suicide watch overflow and being provided the TheraBand Professional Floor Exercise Mat to be used as a mattress for eight or more consecutive days. When providing a mattress in a safety cell, your agency is considered noncompliant with Title 24, CCR 1231.2.5 where design criteria for the safety cell distinguishes this cell from holding and housing cells and Title 15 Section 1055, Use of Safety Cell. It was also evident there was a significant reduction of using safety cells as suicide watch overflow at the Lerdo Pre-Trial and Lerdo Med/Max facilities since the opening of the Justice Facility in May 2018. Facility Specific Central Receiving Facility: Inspected on June 15, 2018, this facility is evaluated under the 1963 and 1982 Title 24, Minimum Standards for Local Detention Facilities and has a rated capacity of 292. On the day of the inspection, the facility housed 144 male and 53 female inmates. Below are two Title 24 noncompliance issues documented during the inspection: 1000+ Kern Ltr 16-18 Sheriff Donny Youngblood Kern County Sheriff’s Office Page 5 Title 24 Section 1231.2.2, Temporary holding cell or room, shall contain seating to accommodate all inmates. On the day of the inspection Temporary Holding cells A1-1 and A1-2 at CRF did not have benches installed and one of the cells were occupied by inmates. It was explained by the facility staff the wood benches were removed due to deterioration, cell refurbishment and they would be installing the new benches when they arrive. When using cells A1-1 and A1-2 to hold inmates with no benches, you are non-compliant with Title 24 Section1231.2.2. Please notify the BSCC as soon as the benches are installed. Title 24 Design Requirements for Suicidal Hazards is to reduce hazards posed by fixtures and equipment which could be used for an act of suicide by an inmate. CRF is noncompliant with this section due to Sobering Cell A2-4 having a security camera installed above the door within reach of inmate which could be used as an attachment point for a self-inflicted injury or attempt suicide. Lerdo Minimum Facility: Inspected on June 13, 2018, this facility is evaluated under the 1982, 2001 and 2008 Title 24, Minimum Standards for Local Detention Facilities. Historically, this facility has had a rated capacity of 800 inmates with 22 dorms for male inmates. During inspection cycle 2014-2016, four dorms dormitories (15 through 18) were demolished (32 x 4 = 128 beds) and were replaced by two 60 (120) bed dormitories (15 and 16). Therefore, the RC changed to 792 (800 – 128 + 120 = 792). On the day of the inspection for the 2016-2018 cycle, the facility housed 115 male and 32 female inmates. During our inspection dorms one through fourteen of the sixteen dorms were closed for plumbing maintenance and refurbishment. Dorms fifteen and sixteen remain open for inmate laborers. There were no signs of hard structure changes during the walk through of dorms being refurbished. Please notify us at the BSCC when the facility refurbishment has been completed before populating dorm housing. There were no Title 24 noncompliance issues to report. Temporary and Court Holding Facilities – Title 24 Physical Plant Inspection Lamont Substation is classified as both a Temporary Holding and a Court Holding facility. The Kern River Valley Substation is classified as a Temporary Holding facility. Both facilities are evaluated under the 1988 Title 24, Minimum Standards for Local Detention Facilities. During the biennial inspection cycle 2014-2016, Taft Court Holding had two Title 24 noncompliance issues regarding audio/visual equipment for holding cells and weapon lockers. Since the last inspection, Taft Court Holding has corrected the issues and are now in compliance from the previous inspection. At the time of the current 2016-2018 biennial inspection, it should be noted Taft Court Holding is only open one day a week when a judge is available to conduct court business. Juvenile Justice and Delinquency Prevention Act Compliance Monitoring In accordance with the JJDPA, BSCC monitors jail facilities for compliance with three of four core requirements of the Act, Separation of Juveniles from Incarcerated Adults. Minors are not housed at these facilities; therefore, no violations of the JJDPA were identified. We were informed by the Compliance Unit and the facility staff the detentions bureau is on mandatory overtime. This was evident on the day of the inspection for the Pre- Trial Facility (June 14, 2018). It appears the late safety checks are during times when staff coverage is at their lowest between the hours of 10:00 am (1000 hours) and 3:00 pm (1500 hours). This correlates with the overtime for shift hold over for four hours and those ordered to come in early for fours leaving the No No No No No staffing shortages between this time. When we questioned staff about the late safety checks, most did not know they needed to notify a supervisor or document why the safety check was late.
