January 31, 2019 Donny Youngblood, Sheriff-Coroner Kern County Sheriff's Office 1350 Norris Road Bakersfield, CA 93308 2018-2020 BIENNIAL INSPECTION OF RIDGECREST SUBSTATION COURT HOLDING FACILITY KERN COUNTY'S TEMPORARY HOLDING AND COURT HOLDING FACILITIES Dear Sheriff Youngblood, On November 8, 2018, staff of the Board of State and Community Corrections (BSCC) conducted the 2018-2020 biennial inspection of the Kern County Ridgecrest Substation Court Holding Facility. Pursuant to Penal Code Section 6031, these inspections were performed to determine compliance with the Minimum Standards for Local Detention Facilities as outlined in Titles 15 and 24, California Code of Regulations. In addition, BSCC staff conducted compliance monitoring pursuant to Welfare and Institutions Code Section 209(f) for the federal Juvenile Justice and Delinquency Prevention Act (JJDPA) for the separation requirements of juveniles from incarcerated adults. The complete BSCC inspection report is enclosed and consists of: this transmittal letter; Title 15 Procedures Checklist outlining Title 15 requirements for the facility; a Physical Plant Evaluation outlining Title 24 Minimum Standards for design for the facility; and, a Living Area Space Evaluation summarizing the physical plant configuration and showing the capacity of the facility. LOCAL INSPECTIONS In addition to the biennial inspection by the BSCC, inspections are also required annually by the County Health Officer and biennially by the State Fire Marshal or an authorized representative (Health and Safety Code Sections 101045 and 13146.1). Please consider our report in conjunction with the reports from the County Health Officer and the respective fire authorities for a comprehensive perspective of your facilities. We encourage the practice of maintaining a permanent file for historical copies of all inspections including documentation of corrections made following the inspection. This file should be the first point of reference when preparing for future inspections. Environmental Health and Fire/Life Safety Inspections The Environmental Health and Fire/Life safety inspections for the facility were both current. Sheriff Donny Youngblood Kern County Sheriff’s Office Page 2 BSCC INSPECTION Title 15 Inspection – Policies, Procedures and Documentation Our inspection of the Kern County Ridgecrest Court Holding Facility began with a review of the Kern County Sheriff's Office Detentions Bureau Policies and Procedures (DBPP) and the Ridgecrest Substation Court Holding Facility Policy and Procedures (RSCHFPP). Our review consisted of only those policies and procedures related specifically to the applicable regulations included in Title 15 Minimum Standards for Local Detention Facilities.1 At the conclusion of the desk audit we identified the following item of non-compliance: Non-compliance Title 15 § 1029 Policy and Procedures Manual Facility administrator(s) shall develop and publish a manual of policy and procedures for the facility. The policy and procedures manual shall address all applicable Title 15 and Title 24 Minimum Standards and shall be comprehensively reviewed and updated at least every two years. It was noted and verified through your Compliance Unit that you are currently in the process of updating the DBPP manual from your non-compliance during the 2016-2018 inspection cycle. We understand the length of time it takes to review and update policy manuals through your county counsel and chain of command. During our inspection and review, it was noted that the RSCHFPP staff was currently in the process of completing their manual update. During our inspection it was noted, after reviewing policies and interviewing staff assigned to the court holding facility, that there is not a female staff member readily available for female inmates being held to attend court or remanded to custody. Therefore, we identified the following item of non-compliance: Non-compliance Title 15 § 1027 Number of Personnel …..Whenever one or more female inmates are in custody, there shall be at least one female employee who shall in like manner be immediately available and accessible to such females. As a reminder, Penal Code 4021 states there shall be trained female staff available for female prisoners. Penal Code 4021 Whenever any female prisoner or prisoners are confined in any local detention facility in the state there shall be an appropriately trained female custodial person assigned, available, and accessible for the supervision of the female prisoners. 1 BSCC does not review all policies and procedures. We do not “approve” policies and procedures nor do we review them for constitutional or legal issues. We recommend agencies seek review through their legal advisor, risk manager and other persons deemed appropriate. 1105 Ridgecrest CH 18-20 Ltr Sheriff Donny Youngblood Kern County Sheriff’s Office Page 3 In your 2014-2016 Biennial Inspection report it stated the sobering cell is no longer in use as a sobering cell for inmates. During this inspection cycle (2018-2020) your staff affirmed it is not used for intoxicated inmates; however, they informed us the sobering cell is being used as an overflow court holding cell in which mainline inmates are provided with plastic chairs. Staff also informed us the cell is used for inmates who are on suicide watch from the detention facilities or when they place an inmate on suicide watch after the inmate states they are suicidal while awaiting their court appearance. It should be noted the cell contains several areas of possible ligature points and no visual means when an inmate is behind the privacy screen with ligature points at the top of the privacy screen. Our concern is your current RSCHFPP C-102 policy contradicts the practice of your staff placing inmates in the cell for suicide watch who claim they are suicidal while attending court. We have been in contact with Lt. Deleon and he informed us he and his staff are in the process of changing policy to use a local provider for psychiatric services during these occasions when his staff determines an inmate needs to be placed on suicide watch. After the policy has been changed, please send us a copy to review. Court Holding Facilities – Title 24 Physical Plant Inspection Ridgecrest Substation Court Holding Facility was classified as a Type I jail prior to closing in June of 2016. Ridgecrest Substation Court Facility Holding has since been reclassified as a Temporary Court Holding Facility per the letter received from your agency. If you choose to reopen the jail and reclassify the court holding facility in the future, please inform me and the BSCC for a re-inspection prior to opening. The Ridgecrest Substation Court Facility Holding is evaluated under the 1988 Title 24, Minimum Standards for Local Detention Facilities; we did not identify any areas of non-compliance. Juvenile Justice and Delinquency Prevention Act Compliance Monitoring In accordance with the JJDPA, BSCC monitors jail facilities for compliance with one of four core requirements of the Act, Separation of Juveniles from Incarcerated Adults. Minors are not housed or held at the Ridgecrest Substation Court Facility Holding; therefore, no violations of the JJDPA were identified. Corrective Action Plan If you choose to address the non-compliant issues noted above, please provide your corrective plan to me at the BSCC for documentation in your inspection file. There is no corrective action plan required at this time for the DBPP manual being non-compliant.
