December 5, 2018 Andrew White, Chief of Police Clearlake Police Department 14050 Olympic Drive Clearlake, CA 95422 PENAL CODE SECTION 6031; WELFARE AND INSTITUTIONS CODE SECTION 209; JUVENILE JUSTICE AND DELINQUENCY PREVENTION ACT Dear Chief White: On December 7, 2017, staff of the California Board of State and Community Corrections (BSCC) conducted the 2016–2018 biennial inspection of the Clearlake Police Department holding facility pursuant to Penal Code Section 6031 and Welfare and Institutions Code (WIC) Section 209. The facility was inspected for compliance with the Minimum Standards for Local Detention Facilities as outlined in Titles 15 and 24, California Code of Regulations and the federal Juvenile Justice and Delinquency Prevention Act (JJDPA) requirements for holding minors. Since out visit, we have worked with Sergeant Martin Snyder to clarify and remedy issues of compliance. We have completed those efforts and may now submit our report. The inspection consisted of a review of applicable policies and procedures governing the operation of the facility, staff interviews, a review of documentation to verify that your practices follow your written procedures, and a walk-through of the physical plant. Sergeant Martin Snyder coordinated our site visit and his assistance is appreciated. The complete BSCC inspection report is enclosed and consists of this transmittal letter, the Procedures checklist outlining applicable Title 15 sections, the Physical Plant Evaluation outlining Title 24 requirements for design, and the Living Area Space Evaluation that summarizes the detention facility’s physical plant configuration. We encourage continuing the practice of maintaining a permanent file for historical copies of all inspections. This file should be the first point of reference when preparing for all future inspections. LOCAL INSPECTIONS In addition to a biennial inspection by the BSCC, inspections are also required annually by the County Health Officer and biennially by the State Fire Marshal or an authorized representative (Health and Safety Code Sections 101045 and 13146.1). Please consider our report in conjunction with these reports for a comprehensive perspective of your facility. FIRE INSPECTION: Fire inspections are required biennially. The most recent fire inspection occurred on 11/23/15 and is overdue. The following item of non-compliance is noted: Title 15 Section 1032 Fire Suppression Preplanning: This regulation requires fire prevention inspections biennially by the State Fire Marshal or a designee. HEALTH INSPECTIONS: Health Department inspections for the facility occurred as follows: Medical /Mental Environmental Health Nutritional Health Clearlake Police Detention 2/20/2013 2/23/2013 N/A Facility All local health inspections are overdue. Please forward current inspection reports to BSCC as they become available. Note: Overdue health inspections do not cause non-compliance with Title 15 regulations. BSCC INSPECTION PHYSICAL PLANT: The Clearlake Police Department holding facility was opened in 1996 and is evaluated under the 1994 Title 24 standards.1 The facility consists of three holding cells and two sobering cells with a combined seating capacity of 18 arrestees. Based on the applicable standards, there were no issues of non-compliance noted. The facility was clean and well-kept. POLICY REVIEW: BSCC reviewed the relevant sections of agency policy against regulations to ensure that each subject required by regulation was addressed in policy.2 The agency’s latest published adult policy manual (2018) and juvenile manual (2013) were used for our review. Regarding policy, the following item of non-compliance was noted: Title 15 Section 1029 Policy and Procedure Manual – This regulation requires, among other things, that the policy manual contains procedures directing staff in a variety of emergency conditions (escape, hostage, etc.) Although agency policy directs the Division Commander to complete the supplemental procedures, they were not found in policy nor available for review. The absence of emergency procedures is non-compliant with this regulation. To remedy this issue, please complete policies for the applicable conditions (found on the Procedures checklist, attached) and forward them to BSCC as they become available. Regarding policy, no other areas on non-compliance were noted. 1 Facilities are assessed against Title 24 requirements in place at the time of design or significant remodel. 2BSCC does not review all your policies and procedures. We only review those policies related specifically to the applicable regulations included in Title 15, Minimum Standards for Local Detention Facilities for issues of non-compliance. We do not “approve’ your policies nor do we review them for constitutional or legal issues. We recommend that agencies seek policy review through their legal advisor, risk manager, and other people deemed appropriate. 1280 Clearlake THJ Ltr 16-18: 11/28/18 Andrew White, Chief of Police Page 3 PROCEDURES REVIEW: BSCC continued its inspection by evaluating procedures at the facility and reconciling them against regulation. Those evaluations typically include an in-depth review of documentation related to jail operations including security logs, shift schedules, local inspection results, classification documents, incident reports and other records which give insight to the facility’s operations. BSCC sought out evidence to ensure that practices matched regulations. No inmates were confined during our site visit and no inmate interviews were conducted. Regulations require a female staff member’s presence whenever a female arrestee is confined. At this agency, a female presence is provided by female officers or other staff. If the absence of a female presence, female bookings are denied. Regulations further require initial and refresher training for staff that supervise arrestees. At this facility, arrestees are supervised by the arresting officers, who remain in the booking area when arrestees are present. The agency is unable to certify that all relevant staff is current in refresher training and the following issue of non-compliance is noted: Title 15 Section 1024 Training: This regulation requires all staff members responsible for supervising inmates to receive eight hours of specialized training within six months of assignment and biennially thereafter. Not all agency staff members that supervise arrestees are current in biennial training requirements. To remedy this issue, please forward evidence of completion of training, when available, for all relevant staff. BSCC reviewed a variety of records to determine the adequacy of staffing and to ensure that procedures were adequate to meet the minimum standards. The agency transfers or cites inmates whenever possible and arrestees are usually held fewer than three hours. Intake records revealed that officers were uniformly assessing each inmate’s overall health and risk factors. Safety checks were timely and random. Staff documents all safety checks on paper logs with supervisory oversight. Special needs inmates, who require enhanced surveillance and care, include inebriated, self-destructive or violent inmates. Suicidal or mentally disordered arrestees and those requiring restraint are not booked at this facility. Inebriated inmates who are so impaired as to require a protected environment are held in the sobering cell under more intensive surveillance. Concerning the jail’s procedures, no other area of non-compliance was noted.
