Box 489 Lakeport, CA 95453 2018-2019 BIENNIAL INSPECTION OF LAKE COUNTY SHERIFF’S OFFICE MAIN JAIL, PENAL CODE 6031 Dear Sheriff Martin, On February 7, 2019, staff of the Board of State and Community Corrections (BSCC) conducted the 2018-2020 biennial inspection of the Lake County Main Jail. A pre-inspection briefing was held on December 19, 2018. Pursuant to Penal Code Section 6031, this inspection was performed to determine compliance with the Minimum Standards for Local Detention Facilities as outlined in Titles 15 and 24, California Code of Regulations (CCR). In addition, BSCC staff conducted compliance monitoring pursuant to Welfare and Institutions Code Section 209(f) for the federal Juvenile Justice and Delinquency Prevention Act (JJDPA). The complete BSCC inspection report is enclosed and consists of: this transmittal letter; the Title 15 Procedures Checklist outlining applicable minimum standards; a Physical Plant Evaluation outlining Title 24 requirements for design; and, a Living Area Space Evaluation summarizing the physical plant configuration and showing the capacity of the facility. Refer to the Title 15 Procedures Checklist for indication of compliance status and evidence used to determine compliance. LOCAL INSPECTIONS In addition to the biennial inspection by the BSCC, inspections are also required annually by the County Health Officer and biennially by the State Fire Marshal or an authorized representative (Health and Safety Code Sections 101045 and 13146.1). Please consider our report in conjunction with the reports from the County Health Officer and the respective fire authorities for a comprehensive perspective of your facilities. BSCC INSPECTION The inspection consisted of a review of the Lake County Sheriff’s Department Custody Policy and Procedure Manual, a site visit to review operations, physical plant and relevant documentation, and interviews with administration, facility staff, inmates and collaborative partners. 1265 Lake County LTR; 3/19/2019 Sheriff Brian Martin Lake County Sheriff’s Office Page 2 Title 15, CCR Inspection Our evaluation consisted of reviewing only those policies and procedures related specifically to the applicable regulations included in Title 15, CCR.1 We found the final items of noncompliance. Title 15, Section 1027.5 Safety Checks: Safety checks were reviewed by BSCC staff. During the review of the documentation of safety checks in modules A, D, H and F, the documentation disclosed safety checks not being routinely completed within the required 60-minute time frame between checks. Please refer to the Procedures Checklist for detailed information. Title 24, CCR Physical Plant There were no changes made to the physical plant and your rated capacity remains at 286. We found the following items of noncompliance. Title 24, Section 1231.2.6 Single Occupancy Cells: In 2017 a second bunk was added to the single occupancy cells in Pod B. On the day of our inspection, three single cells housed two inmates exceeding the RC of 9. Title 24, Section 1231.2.7 Double Occupancy Cells: Pod F has an RC of 40. On the day of inspection, Pod F housed 42 inmates with two cells (F-20 and F- 102) utilizing one stackable bunk in each cell. Title 24, Section 1231.2.9 Dayrooms: This regulation mandates the minimum square footage required for dayrooms and requires permanent, fixed seating for all inmates. On the day of the inspection, four of ten housing units exceeded the inmate capacity allowed by the available dayroom space and seating. Title 24, Section 1231.3.1 Toilets and Title 24, Section 1231.3.2 Washbasins: This regulation establishes the minimum number of toilets and washbasins for each pod (one each for each ten inmates.) On the day of the inspection, several housing modules had an insufficient number of fixtures for the number of inmates being housed. Title 24, Section 1231.3.5 Beds: When inmates are housed in the Intake and Booking holding cells, they are provided plastic stackable bunks for use as a bed and not the required bunks as indicated in this section. Even though the department’s policy does not have the required hourly retention, the observation log used for inmates in restraints clearly articulates the watch commander will document and review the retention every hour in accordance with this section. All documents reviewed by BSCC staff were dated in 2018 prior to the new Title 15 changes that were implemented in January 2019. Therefore, a finding of compliance was determined with this section. (2) A pregnant inmate in labor, during delivery, or in 524.8.1 Inmates in Labor recovery after delivery, shall not be restrained by the wrists, X ankles, or both, unless deemed necessary for the safety and security of the inmate, the staff, or the public. (3) Restraints shall be removed when a professional who is 524.8.1 Inmates in Labor currently responsible for the medical care of a pregnant inmate during a medical emergency, labor, delivery, or X recovery after delivery determines that the removal of restraints is medically necessary. (4) Upon confirmation of an inmate's pregnancy, she shall 524.8 Pregnant Inmates be advised, orally or in writing, of the standards and policies governing pregnant inmates.
