August 14, 2018 Dean Growdon, Sheriff-Coroner Lassen County Sheriff's Office 1405 Sheriff Cady Lane Susanville, CA 96130 Dear Sheriff Growdon: BOARD OF STATE AND COMMUNITY CORRECTIONS BIENNIAL INSPECTION LASSEN COUNTY ADULT DETENTION AND COURT HOLDING FACILITIES (PC 6031) On April 17, 2018, Board of State and Community Corrections (BSCC) staff conducted the 2016-2018 biennial inspection of the Lassen County Adult Detention Facility and court holding facility. These facilities were inspected for compliance with the Minimum Standards for Local Detention Facilities, as outlined in Titles 15 and 24, California Code of Regulations. The complete BSCC inspection report is enclosed and consists of: this transmittal letter; two Title 15 Procedures checklists outlining Title 15 requirements for both facilities; two Physical Plant Evaluations outlining Title 24 requirements for the design of both facilities;1 and two Living Area Space Evaluations summarizing the physical plant configuration of both facilities. We encourage the practice of maintaining a permanent file for historical copies of all inspections that would also include documentation of corrections made following the inspection. This file should be the first point of reference when preparing for all future inspections. Local Inspections In addition to a biennial inspection by the BSCC, inspections are required biennially by the State Fire Marshal and annually by the County Health Officer pursuant to Health and Safety Code §13146.1 and §101045 respectively. Please consider our report in conjunction with the reports from the Fire Marshal and the Health Department for a comprehensive perspective of your facility. The fire and health inspections are current for the Adult Detention Facility and there were no noncompliance issues. The fire inspection for the court holding facility was current; however, a health inspection was not conducted. 1 Facilities are assessed against Title 24 requirements in place at the time of design or significant remodel to the jail area. 1305 Lassen SD ltr Dean Growdon, Sheriff-Coroner Page 2 BSCC Inspection Adult Detention Facility Title 15 Inspection We reviewed only those policies and procedures related specifically to the applicable regulations in Title 15, Minimum Standards for Local Detention Facilities.2 We found no issues of noncompliance but made several suggestions regarding policy implementation. The inspection continued with a review of safety check logs, documentation regarding use of the safety cell and use of the sobering cell, incident reports, grievances and disciplinary actions to ensure that practices are consistent with policies and Title 15. Our review on the placement and management of inmates in sobering cells and safety cells determined compliance with regulatory requirements. Such placements can be a major source of jail litigation, but when operated and managed according to regulation, exposure to litigation is reduced. Documentation showed appropriate justification for placement, timely safety checks, required approvals for retention and consults. In our review of the documentation of the grievance and disciplinary processes, we found the responses were timely, appropriate and provided an avenue of appeal. Noncompliance issue. Section 1027, Number of Personnel, requires a sufficient number of personnel in each local detention facility to conduct and document at least hourly safety checks of inmates. Of the documentation reviewed, there were a number of times that the checks were late anywhere from a few minutes up to an hour resulting in noncompliance with this regulation. Please see the Procedures checklist for further information. Programs The Sheriff's Office and other agencies collaborated with Lassen Community College in applying for the Assembly Bill 86 Adult Education Block Grant, to provide educational services within the jail. These resources provide high school education to interested inmates and will fund future re-entry programs. In addition to the high school program, the jail provides the following: • Education tablets; • A Substance Use Disorder program; and • An Anger Management program. Title 24 Physical Plant Inspection Completed in 1991, the Lassen County Adult Detention Facility was inspected and evaluated using the 1988 Title 24, Minimum Standards for Local Detention Facilities. With a rated capacity of 156, there were 112 male inmates and 17 female inmates in custody on the day of the inspection. Noncompliance issue. Section 1231.2.5, Safety Cell, requires that this cell be no smaller than 48 square feet. The safety cell in this facility measures less than 47 square feet resulting in noncompliance with this regulation. 2 BSCC does not review all of your policies and procedures. We do not “approve” your policies and procedures nor do we review them for constitutional or legal issues.
