The facility was inspected for compliance with the Minimum Standards for Local Detention Facilities as outlined in Titles 15 and 24, California Code of Regulations (CCR), and the Federal Ollice of Juvenile Justice and Delinquency Prevention (O.JJDP) standards for holding minors. Inspection Scope: The inspection consisted of a walk-through of the physical plant, a review of applicable written policies and procedures governing the operation of the facil ity and a review of documentation to verify that your practices follow your written procedures. Jail Manager Wellington Hengst was present during the inspection and assisted by answering questions and clarifying procedural issues. His involvement in the inspection process was extremely valuable. The professionalism and courtesy he extended was appreciated. The complete BSCC inspection report is enclosed and consists of: this transmittal letter; the Procedures Checklist outlining applicable Title 15 regultins; the Physical Plant Evaluation outlining Title 24 requirements for designl and, the Living Area Space Evaluation summarizing the detention facility's physical plant conliguration. Local Inspections: Inspections are also required annually by the County Health Officer and bielmially by the State Fire Marshal or an authorized representati ve (Health and Safety Code Sections 101045 and 13146.1). We encourage continuing the practice of maintaining a permanent file for historical copies of all inspections. This tile should be the first point of reference when preparing for all future inspections. BSCC Inspection: Physical Plant Completed in 1959, the Palos Verdes Estates City Jail is inspected as a Type I facility and evaluated using the 1963 Minimum lail Standards. With a Rated Capacity of 12, no inmates were in-custody at the time of the inspection. The jail was clean and appeared well maintained for its advanced age. No issues of non-compliance with applicable physical plant standards were identified. Policy and Procedures BSCC reviewed a subset of the agency's policy manual specific to the facility operations and compared the contents against relevant regulations to ensure that each subject required by regulation was addressed in policy2 We informed your staff that there is a recently updated version of Title 15 minimum standards and that the facility should go through the new standards to ensure that the facility will remain in compliance with their policy and procedures manual. We evaluated procedures at the facility and compared them against policy. Those evaluations included a review of documentation related to jail operations including security logs, shin schedules, local inspection results, classification documents, incident reports and other records which give insight to the facility'S operations. BSCC sought to ensure that practices matched written procedures and that written documents retlected actual events. We interviewed staff to ensure that documented procedures were being performed according to policy. There were no areas of non-compliance noted. Juvenile Inspection We reviewed policy, procedures, practice and supporting documentation related to the requirements of Title 15 Article 9 - Minors in Custody in a Law Enforcement Facility and WIC Section 207.1(d). Minors held in the detention area are separate and away li'om adult inmates. BSCC is the designated compliance monitoring agency for the Juvenile Justice and Delinquency Prevention Act (JJDPA), and is authorized by Welfare and Institutions Code §209(t) to inspect facilities Ihat may detained minors in secure detention. Four minors were held in secure detention. Two minors were held passed 6 hrs. due to an extensive investigation. We provided technical assistance and were assured this was an isolated incident and will not occur again. We continue to encourage management oversight related to the detention of minors as compliance with WIC Section 207.1( d) and Title 15, Article 9 regulations is required to maintain suitability for the secure confinement of minors in law enforcement facilities. 2 BSCC does not review all of your policies and procedures. We only review those policies related specifically to the applicable regulations included in Title 15, Minimuill Standards for Local Detention Facilities for issues on non-compliance. WE do not "approve" your policies nor do we review them for Constitutional or legal issues.
