January 15, 2019 David Riviere, Chief of Police Chowchilla Police Department 122 Trinity Avenue Chowchilla, CA 93610 2016-2018 BIENNIAL INSPECTION PENAL CODE SECTION 6031; WELFARE AND INSTITUTIONS CODE SECTION 209; JUVENILE JUSTICE AND DELINQUENCY PREVENTION ACT Dear Chief Riviere: On June 25, 2018, staff of the Board of State and Community Corrections (BSCC) conducted the 2016 - 2018 biennial inspection of the Chowchilla Police Department Temporary Holding Facility pursuant to Penal Code Section 6031 and Welfare and Institutions Code (WIC) Section 209. The facility was inspected for compliance with the Minimum Standards for Local Detention Facilities as outlined in Titles 15 and 24, California Code of Regulations and for the federal Juvenile Justice and Delinquency Prevention Act (JJDPA) requirements for holding minors. The inspection consisted of a review of applicable operational policies and procedures, including ensuring practices are consistent with regulations and written procedures, a review of documentation to verify compliance with regulatory expectations, a walk-through of the physical plant and administrative staff interviews. There were no adult arrestees or juveniles present at the time of the inspection. The complete BSCC inspection report is enclosed and consists of: • This transmittal letter; • The Procedures Checklist outlining applicable Title 15 sections; • The Physical Plant Evaluation outlining Title 24 requirements for design; and, • The Living Area Space Evaluation that summarizes the facility’s physical plant configuration. We encourage continuing the practice of maintaining a permanent file for historical copies of all inspections. This file should be the first point of reference when preparing for all future inspections. LOCAL INSPECTIONS Annual inspections are required by the County Health Department and biennially by the State Fire Marshal or an authorized representative (Health and Safety Code Sections 101045 and 13146.1). Clearance was granted. HEALTH INSPECTIONS: As of the writing of this report we have not received your public health reports for 2017 or 2018. Please forward them to us as you receive them. BSCC INSPECTION Physical Plant: The Chowchilla PD Temporary Holding Facility was opened in 1976 and was evaluated under the 1973 and the 2001 Title 24 Standards. The facility consists of two holding cells, known as the small and the large cell and a secure booking area. There are no special-need cells such as a sobering or safety cell. There were no areas of non-compliance noted regarding the physical plant. The area was clean and well maintained. Juvenile Justice and Delinquency Prevention Act (JJDPA): In accordance with the JJDPA, BSCC monitors law enforcement facilities for compliance with JJDPA. All logs were reviewed, and some inconsistencies were found. Agency corrected their documentation and provide revised documentation to the BSCC for review. No issues of non- compliance regarding JJDPA were noted. TITLE 15 INSPECTION RESULTS POLICY REVIEW: BSCC reviewed a subset of the agency’s policy manual specific to the facility operations and reconciled the contents against relevant regulations to ensure that each subject required by regulation was addressed in policy. The following items of non-compliance were noted: Title 15 Section 1058 Use of Restraints: This regulation requires that an agency opting to use restraints in its facility has a set of procedures governing their use. There are two policies; Policy 900.3.1(l): Individuals Who Should Not Be in Temporary Custody and Policy 900.6: Use of Restraint Devices that are contradictory and need to be clarified. Both note that the restraints should not be used; but, does not forbid them. Agency policy authorizes staff to use restraints in the facility when needed, but fails to address some of the required conditions imposed by regulation (mental health considerations, hydration, range of motion exercises, etc.) If the agency intends to allow for the use of restraints, all protections imposed by this regulation must be addressed in policy. Title 15 Section 1150 Supervision of Minors in Non-Secure Custody: Current policy does not require that entry and release times shall be documented and made available for review. Policy will need to be updated to include this requirement. PROCEDURE AND DOCUMENTATION REVIEW: BSCC evaluated facility operations to ensure consistency with Title 15 Regulations and Agency Policy and Procedures. Please refer to the attached policy and procedure checklist for detailed information. The following areas of non-compliance were noted: Title 15 Section 1024 Temporary Holding Facility Training: This regulation requires that all personnel responsible for supervising arrestees receive a specialized training within six months of assignment and every two years thereafter. All persons who supervise arrestees will need to be trained as required. Title 15 Section 1027 Number of Personnel: Whenever there is an arrestee in custody, there shall be at least one employee on duty at all times in a local detention facility or in the building which houses a local detention facility who shall be immediately available and accessible in the event of an emergency. The employee shall not have any other duties which would conflict with the supervision and care of inmates in the event of an emergency. Whenever one or more females are in custody, there shall be at least one female employee who shall be immediately available and accessible to such females. We noted incidents where dispatchers are responsible for the supervision of the arrestees; however, dispatchers cannot leave their post to address emergencies. We also noted that females are not always present when a female is in custody. These areas will need to be remedied. Title 15 Section 1028 Fire and Life Safety Staff: This regulation requires a staff member trained in fire and life safety issues to be present whenever an arrestee is confined. All persons who supervise arrestees will need to be trained as required. Title 15 Section 1050 Classification Plan: This regulation requires all arrestees to receive a classification interview at intake by a trained staff member. Staff have not been trained pursuant to Section 1024. Additionally, we found no documentation that a classification process was initiated. All persons who supervise arrestees will need to be trained as required and agency forms need revision to document that all arrestees are classified.
