May 6, 2020 Matt Kendall, Sheriff – Coroner County of Mendocino 951 Low Gap Road Ukiah, CA 95482 Dear Sheriff Kendall: 2018-2020 BIENNIAL INSPECTION OF MENDOCINO COUNTY ADULT DETENTION FACILITY AND COURT HOLDING FACILITY, PENAL CODE 6031 On January 27, 2020 Board of State and Community Corrections (BSCC) staff conducted the 2018-2020 biennial inspection of the Mendocino County Adult Jail Facility, the Mendocino County Superior Court Holding Facility and the Fort Bragg Justice Center. Pursuant to Penal Code Section 6031, this inspection was performed to determine compliance with the Minimum Standards for Local Detention Facilities as outlined in Titles 15 and 241, California Code of Regulations (CCR). In addition, BSCC conducted compliance monitoring pursuant to Welfare and Institutions Code Section 209(f) and the federal Juvenile Justice and Delinquency Prevention Act (JJDPA). The complete BSCC inspection report is enclosed and consists of: this letter; the Title 15 Procedures Checklist outlining applicable minimum standards of each facility; a Physical Plant Evaluation outlining Title 24 requirements for design of each facility; and, a Living Area Space Evaluation summarizing the physical plant configuration and showing the rated-capacity of each facility. Refer to the Title 15 Checklists for compliance status and evidence used to determine compliance. Local Inspections In addition to the biennial inspection by the BSCC, inspections are also required annually by the County Health Officer and biennially by the State Fire Marshal or an authorized representative (Health and Safety Code Sections 101045 and 13146.1). Please consider our report in conjunction with the reports from the County Health Officer and the respective fire authorities for a comprehensive perspective of your facility. Current inspections are noted below. Once you receive a copy of the missing inspections, please forward them to the BSCC. Those missing are Fire and Life Safety inspections for the Adult Jail and Court Holding facility; Medical/Mental Health inspections for the Court Holding facility and Fort Bragg Justice Center; Environmental Health inspections for the Court Holding facility and the Fort Bragg Justice Center; and a Nutritional Health inspection for the Adult Jail. 1 Facilities are assessed against Title 24 requirements in place at the time of design or significant remodel to the jail area. Bragg Justice 06/03/18 Not Needed BSCC Inspection Title 15, CCR Inspection The inspection consisted of a review of the policies and procedures related specifically to applicable Title 15, CCR sections, a site visit to review operations, physical plant and relevant documentation, and interviews with administration, facility staff, inmates and collaborative partners. The Mendocino County Jail was very clean and free of graffiti, reviews of written documents were concise and followed written policy. The Policy and Procedures Manual is thorough and identifies each person’s responsibilities. The following items of noncompliance with Title 15, CCR were identified; please refer to the Procedures Checklist for detailed information and technical assistance. Mendocino County Jail Title 15, Section 1029 Policy and Procedures Manual Subsection (6) Annual Internal and External Review of Security Measures including measures specific to the prevention of sexual abuse and sexual harassment. No documentation was provided indicating the date of the annual inspection. We were unable to determine compliance with the following Title 15, CCR regulations due to lack of documentation; we will determine compliance when we receive documentation. Title 15, Section 1027.5 Safety Checks We are unable to determine compliance with this regulation based upon policy review only. Documentation of safety checks was not provided at the time of inspection. Title 15, Section 1055, Use of Safety Cell We are unable to determine compliance with this regulation based upon policy review only. Documentation of safety cell was not provided at the time of inspection. Title 15, Section 1056 Sobering Cell 3100+ Mendocino County 18-20 Matt Kendall, Sheriff – Coroner 3 We are unable to determine compliance with this regulation based upon policy review only. Documentation of sobering cell placements was not provided at the time of inspection. Mendocino Court Holding Facility Title 15, Section 1029 Policy and Procedures Manual Subsection (6) During the review of the documentation, it was determined the agency did not provide a document indicating when the Annual Internal and External Review of Security Measures including measures specific to the prevention of sexual abuse and sexual harassment. Title 15, Section 1032 Fire Suppression Preplanning (b) No monthly fire prevention inspection reports by facility staff were provided at the time of inspection. (c) No documentation provided indicating a fire inspection was performed. Fort Bragg Justice Center Title 15, Section 1027.5 Safety Checks The logs for safety checks were not easy to read and did not provide indication that safety checks occurred with no more than a 60-minute lapse between checks. Title 15, Section 1029 Policy and Procedures Manual During the review of the documentation, it was determined the agency did not provide a document indicating when the Annual Internal and External Review of Security Measures including measures specific to the prevention of sexual abuse and sexual harassment. Title 15, Section 1032 Fire Suppression Preplanning No monthly fire prevention inspection reports by facility staff were provided at the time of inspection. Title 24, CCR Physical Plant The inspection consisted of a walk-through of each facility and a review of the applicable Title 24 CCR sections associated with each building. Mendocino County Jail was built under Title 24 regulations 1980 and 1986. The Mendocino Superior Court Holding Facility was built under Title 24 regulations 1980. Mendocino County Jail Title 24 Sections 1231.2.7 Double Occupancy Cells and 1231.2.8 dormitories During the inspection, it was noted that there is use of temporary stack-a-bunks in several areas. In each of the affected housing units, the occupancy rate was lower than the rated capacity. This is due to the classification status of each person, however, when the temporary stack-a-bunks are used, the area is noncompliant. 3100+ Mendocino County 18-20 Matt Kendall, Sheriff – Coroner 4 Mendocino Court Holding Facility At the time of inspection, we did not identify any areas of noncompliance. Juvenile Justice and Delinquency Prevention Act Compliance Monitoring The BSCC monitors local detention facilities for compliance with the JJDPA. Minors are not held in the temporary holding cells and arrangements are made for separation between adults and minors. Corrective Action Plan Please provide a corrective action plan to the BSCC addressing your compliance issues. Once received this will be incorporated into our files. Inmates are allowed to see different visitors in different visiting sessions if space is available. An inmate may refuse to see a visitor. Three visitors may visit an inmate at the same time. A child of walking age is considered one visitor. Visitors must conform to the dress code approved by the Corrections Division Commander and posted in the visitors’ waiting room. Visitors with obvious revealing clothing will not be allowed to visit. When there is a question of whether or not the visitor’s attire is appropriate, the Facility Supervisor will make the determination and either approve or deny the visit. Any person under 18 years of age, except emancipated juveniles and/or the spouse of the inmate with proper identification, will NOT be allowed to visit unless accompanied by an adult. It is the responsibility of the visitor to provide proof of the relationship to the satisfaction of the Corrections Division personnel. Bringing firearms, explosives, alcoholic beverages, narcotics or any controlled substance, including marijuana into this facility is a crime and cause for arrest. Visitors under the influence of alcohol or drugs will not be allowed to visit, and may be subject to arrest. Persons who are unwilling or unable to control their minor children while in this facility will not be allowed to visit. Visitors who are disruptive or cause a disturbance will be requested to leave the facility and will be denied access to visiting for that day. Visitors are not allowed to carry cameras, cell phones, tape recorders, purses, bags, briefcases, or similar objects into the visiting area of this facility (official visitors may be exempt). After being checked in by Corrections Staff, visitors will proceed directly to the visiting room. Any visitor found visiting an inmate other than the one specified is in violation of facility rules. The visit will be terminated, and the visitor will be told leave the facility. Visitors will not give anything to or take anything from an inmate without prior approval from the Facility Supervisor. When a visit is terminated, the inmate and visitor will leave the visiting room neat, clean, and free of trash. The decision to deprive inmates of such articles of clothing and bedding shall be reviewed by the facility manager or designee during each 24-hour period.
