YES DATE CAP DUE TO BSCC: 3/18/2022 Current Items of Noncompliance Title 15. Section Description On the day of inspection, a sobering cell was being § 1056. Use of Sobering Cell used for overflow in booking. On the day of inspection, a safety cell was being used § 1055. Use of Safety Cell for observation not related to suicidal ideations. Title 24. Section Description On the day of inspection, personal storage space was 1231.2.8 Dormitories not being provided to inmates housed in dormitories. The toilet, wash basin, and drinking fountain 1231.2.10 Exercise area positioned adjacent to the outdoor recreation, exercise area was not “freely” accessible to inmates. On the day of inspection, two of the safety cells located in the booking area were noncompliant with 1231.2.5 Safety cell this regulation. The padding was torn, tattered, and deteriorating. Technical Assistance Provided • Suicide hazards should be included in the agency annual security audit. • Completion of refurbishment in main jail will require BSCC inspection prior to occupying. • JBCT beds will be rated as “Special Use” beds and will not be included in the total rated capacity. • The agency may consider reclassifying some of the safety and or sobering cells to “Observation Cells.” • This will allow the agency some flexibility in the use of these spaces when appropriately outlined in policy. • Modifications to allow for free access to toilets, wash basins and drinking fountains should be made to the outdoor exercise/recreation area
