November 29, 2018 Tina Nieto, Chief of Police Marina Police Department 211 Hillcrest Avenue Marina, CA 93933 2016-2018 BIENNIAL INSPECTION PENAL CODE SECTION 6031; WELFARE AND INSTITUTIONS CODE SECTION 209; JUVENILE JUSTICE AND DELINQUENCY PREVENTION ACT Dear Chief Nieto: On October 27, 2017, staff of the California Board of State and Community Corrections (BSCC) conducted the 2016– 2018 biennial inspection of the Marina Police Department holding facility pursuant to Penal Code Section 6031 and Welfare and Institutions Code (WIC) Section 209. The facility was inspected for compliance with the Minimum Standards for Local Detention Facilities as outlined in Titles 15 and 24, California Code of Regulations and the federal Juvenile Justice and Delinquency Prevention Act (JJDPA) requirements for holding minors. Since our visit, we have worked with Sergeant James Clegg to clarify and remedy issues of compliance. We have completed those efforts and may now submit our report. The inspection consisted of a review of applicable policies and procedures governing the operation of the facility, staff interviews, a review of documentation to verify that your practices follow your written procedures, and a walk-through of the physical plant. Sergeant Clegg coordinated our site visit and his assistance is appreciated. The complete BSCC inspection report is enclosed and consists of this transmittal letter, the Procedures checklist outlining applicable Title 15 sections, the Physical Plant Evaluation which outlines Title 24 requirements for design, and the Living Area Space Evaluation that summarizes the detention facility’s physical plant configuration. We encourage continuing the practice of maintaining a permanent file for historical copies of all inspections. This file should be the first point of reference when preparing for all future inspections. LOCAL INSPECTIONS In addition to a biennial inspection by the BSCC, inspections are also required annually by the County Health Officer and biennially by the State Fire Marshal or an authorized representative (Health and Safety Code Sections 101045 and 13146.1). Please consider our report in conjunction with these reports for a comprehensive perspective of your facility. FIRE INSPECTION: Regulations require a fire inspection every two years. The most recent fire inspection occurred on 6/30/16 and was current at the time of our visit but should now be repeated. 3315 Marina THJ Ltr 16-18: 12/5/18 Tina Nieto, Chief of Police Page 2 HEALTH INSPECTIONS: Health Department inspections for the facility occurred as follows: Medical /Mental Environmental Health Nutritional Health Marina Detention Facility 4/5/16 4/5/16 4/29/16 All local inspection reports are complete, and no areas of non-compliance were noted. They are now due to be repeated. BSCC INSPECTION PHYSICAL PLANT: The Marina Police Department holding facility was opened in 1991 and is evaluated under the 1986 Title 24 standards.1 The facility consists of one holding cell with a seating capacity of 5 arrestees. Based on the applicable standards, there were no issues of non-compliance noted. The jail was clean and well-kept. Minors in secure detention are held in the holding cell or a locked interview room. Minors in non-secure detention are held in the report writing room. POLICY REVIEW: BSCC reviewed the relevant sections of agency policy against regulations to ensure that each subject required by regulation was addressed in policy.2 At the time of our site visit the agency was transitioning from its legacy jail policy to a new commercial policy. Relevant citations from both volumes were used for our review and no issue of non-compliance was noted. PROCEDURES REVIEW: BSCC continued its inspection by evaluating procedures at the facility and reconciling them against regulation. Those evaluations typically include an in-depth review of documentation related to jail operations including security logs, shift schedules, local inspection results, classification documents, incident reports and other records which give insight to the facility’s operations. BSCC sought out evidence to ensure that practices matched regulations. No inmates were confined during our site visit and no inmate interviews were conducted. Arrestees are supervised by the arresting officers, who remain in the booking area when arrestees are present. When female arrestees are present, a female presence is provided by female officers or staff. If the absence of a female presence, female bookings are denied. 1 Facilities are assessed against Title 24 requirements in place at the time of design or significant remodel. 2BSCC does not review all of your policies and procedures. We only review those policies related specifically to the applicable regulations included in Title 15, Minimum Standards for Local Detention Facilities for issues of non-compliance. We do not “approve’ your policies nor do we review them for constitutional or legal issues. We recommend that agencies seek policy review through their legal advisor, risk manager, and other people deemed appropriate. 3315 Marina THJ Ltr 16-18: 11/29/18 Tina Nieto, Chief of Police Page 3 Regulations require all staff members responsible for supervising inmates to receive eight hours of specialized training within six months of assignment and biennially thereafter. The agency is unable to certify that all relevant staff is current in refresher training and is non-compliant with this regulation. The following issue of non- compliance is noted: Title 15 Section 1024 Training: Agency staff members that supervise arrestees are not current in biennial training requirements. To remedy this issue, please forward evidence of completion of training, when available, for all relevant staff. BSCC reviewed a variety of records to determine the adequacy of staffing and to ensure that procedures were adequate to meet the minimum standards. The agency transfers or cites inmates whenever possible and arrestees are not usually held in a holding cell. Only four arrestees had been confined during this inspection cycle as of the date of our site visit. Intake records revealed that officers were uniformly assessing each inmate’s overall health and risk factors. Safety checks were timely and random. Staff documents all safety checks on paper logs. Special needs inmates, who require enhanced surveillance and care, include inebriated, self-destructive or violent inmates. Suicidal, inebriated, or mentally disordered arrestees and those requiring restraint are not booked at this facility. Concerning the jail’s procedures, no other area of non-compliance was noted. JUVENILE JUSTICE AND DELINQUENCY PREVENTION ACT COMPLIANCE MONITORING: In accordance with the JJDPA, BSCC monitors law enforcement facilities for compliance with three core requirements of the Act: Deinstitutionalization of Status Offenders, Separation of Juveniles from Incarcerated Adults, and Removal from Adult Jails and Lockups (6-hour secure detention limitation). Minors in secure detention were held in the pre-booking area under the constant supervision of an officer. All detentions were reviewed, and we noted no violations of the JJDPA. We noted that detention logs did not consistently contain all data needed to verify compliance with the JJDPA, including the rationale for selecting secure rather than non-secure detention and the provisions of advisements as required. BSCC recommends that the agency further train staff on the JJDPA’s requirements. CORRECTIVE ACTION: Please provide evidence of correction as indicated above.
