March 11, 2019 Eric Sills, Chief of Police Soledad Police Department 236 Main Street Soledad, CA 93960 2016-2018 BIENNIAL INSPECTION PENAL CODE SECTION 6031; WELFARE AND INSTITUTIONS CODE SECTION 209; JUVENILE JUSTICE AND DELINQUENCY PREVENTION ACT Dear Chief Sills: On April 10, 2018, staff of the Board of State and Community Corrections (BSCC) conducted the 2016 - 2018 biennial inspection of the Soledad Police Department Temporary Holding Facility pursuant to Penal Code Section 6031 and Welfare and Institutions Code (WIC) Section 209. The facility was inspected for compliance with the Minimum Standards for Local Detention Facilities as outlined in Titles 15 and 24, California Code of Regulations and for the federal Juvenile Justice and Delinquency Prevention Act (JJDPA) requirements for holding minors. The inspection consisted of a review of applicable operational policies and procedures, including ensuring practices are consistent with regulations and written procedures, a review of documentation to verify compliance with regulatory expectations, a walk-through of the physical plant and administrative staff interviews. There were no prisoners present at the time of the inspection. The complete BSCC inspection report is enclosed and consists of: • This transmittal letter; • The Procedures Checklist outlining applicable Title 15 sections; • The Physical Plant Evaluation outlining Title 24 requirements for design; and, • The Living Area Space Evaluation that summarizes the facility’s physical plant configuration. LOCAL INSPECTIONS Annual inspections are required by the County Health Department and biennially by the State Fire Marshal or an authorized representative (Health and Safety Code Sections 101045 and 13146.1). Please consider our report in conjunction with these reports for a comprehensive perspective of your facility. FIRE INSPECTION: The fire inspection report was not completed at the time of the BSCC inspection. The inspection was scheduled and completed on July 11, 2018; however, the documentation was misplaced. The fire department completed an additional inspection on December 27, 2018 and clearance was granted. 3345 Soledad PD TJH\16 18\Letter Eric Sills, Chief of Police Page 2 HEALTH INSPECTIONS: Medical /Mental Environmental Health Nutritional Health SOLEDAD PD THJ 03/07/2018 03/07/2018 03/07/2018 BSCC INSPECTION PHYSICAL PLANT: The Soledad Temporary Holding Facility was evaluated under the 1986 Title 24 Standards. The facility consists of two holding cells and a secure booking area. There are no special-need cells such as a sobering or safety cell. There were no areas of non-compliance noted regarding the physical plant. The area was clean and well maintained. JUVENILE JUSTICE AND DELINQUENCY PREVENTION ACT (JJDPA): In accordance with the JJDPA, BSCC monitors law enforcement facilities for compliance with JJDPA. All logs were reviewed and found to be complete and comprehensive. No issues of non- compliance regarding JJDPA were noted. TITLE 15 INSPECTION RESULTS: POLICY REVIEW: The agency has two policy and procedure documents: a Lexipol document and a facility specific policy guide. The most recent full policy review and revision occurred in 2017. We reviewed the relevant sections of both against regulation to ensure each area required by regulation was addressed. Although both policy documents address all regulatory requirements, there is conflicting policy between the two. We suggest that one policy document be adopted to eliminate duplication and confusion. PROCEDURES AND DOCUMENTATION REVIEW: Documentation requested and reviewed included booking logs, screening forms, shift schedules, local inspection results, classification documents, incident reports and other records which give insight to the facility’s operations. We reviewed agency practice against procedures and regulation to ensure consistent operations. Technical assistance was provided regarding documentation requirements and suggestions for operations. Please refer to the attached policy and procedures checklist for detailed information. The following area of non-compliance was noted: Title 15 Section 1027 Number of Personnel: Whenever one or more females are in custody, there shall be at least one female employee who shall be immediately available and accessible to such females. Lexipol notes that a female staff should be present when a female adult is in temporary custody and if none are readily available, the arrestee should be transported to the County Jail or released through another process. The Soledad THJ policy notes if a female is not available, the female should be “booked” and released or transported to the County Jail. These policy statements are confusing. The THJ policy should be X revised consistent with the requirements of Section 1027. Soledad PD does not always have female officers or other female staff on duty. They request assistance from other local agencies for assistance for searches and to be present; however, based on documentation we reviewed, this does not always occur, and documentation was not clear if a female officer or staff were present. This practice is non-compliant. Regulation requires if a female arrestee is in custody, a female staff member is required to be present.
