We also conducted compliance monitoring pursuant to Welfare and Institutions Code Section 209(f) and the federal Juvenile Justice and Delinquency Prevention Act (JJDPA) for the separation requirements of juveniles from incarcerated adults. To prepare staff for the inspection, a pre-inspection briefing was held for both the Corrections and Court Services Division on June 8, 2022. In addition to this letter, the inspection report includes a Procedures Checklist for each facility type, outlining areas of Title 15 and coinciding compliance determination; a Physical Plant Evaluation for each facility outlining requirements for design (Title 24) and coinciding compliance; and, a Living Area Space Evaluation for each facility which summarizes the physical plant configuration, and provides the rated capacity. All areas of non-compliance are briefly outlined in this letter. LOCAL INSPECTIONS In addition to a biennial inspection by the BSCC, inspections are required annually by the County Health Officer and biennially by the State Fire Marshal/local fire authority pursuant to Health and Safety Code §101045 and §13146.1 respectively. Please consider our report in conjunction with the reports from the Health Department and the Fire Marshal for a comprehensive perspective of your facility. This file should be the first point of reference when preparing for future inspections. BSCC INSPECTION Title 15 Inspection – Policies, Procedures and Documentation Our inspection began with a review of the Napa County Detentions Policies and Procedures Manual. Both Jail and Court services share the same policy manual. Our review consisted of only those policies and procedures related specifically to the applicable regulations included in Title 15 Minimum Standards for Local Detention Facilities. The agency is continually updating their manual to ensure consistency and completeness. We conducted a review of documentation related to jail operations including security logs, shift schedules, local inspection results, classification documents, incident reports, and other records which give insight to the facility’s operations. The following areas of Title 15 non-compliance were noted. Please review the attached Title 15 Procedures Checklist for more information. § 1056. Use of Sobering Cell: There was no evidence that prisoners were placed in the sobering cell for their safety or the safety of others due to their state of intoxication. § 1058. Use of Restraint Devices: Facility watch commander and health care staff failed to complete their retention review minimum of every hour. Title 24 Inspections – Physical Plant The Napa County Jail facility is evaluated as a Type II facility under the 1973, 80’, 86’, 94’ 2001 and 2013 regulations. With a rated capacity of 276, on the day of inspection 263 inmates were in custody. The following areas of Title 24 non-compliance were noted: § 8227 Multiply Occupancy cell: Several modules were over the rated capacity allowable. § 1231.3.5 Beds: Plastic bunks on floor in men’s west 202 & 315. The Napa County Court facility is evaluated as a Court Holding facility under the 1994 regulations. There were no areas of non-compliance issues noted. Juvenile Justice and Delinquency Prevention Act Compliance Monitoring In accordance with the JJDPA, BSCC monitors jail facilities for compliance with one of four core requirements of the Act: Separation of Juveniles from Incarcerated Adults. Minors are not housed or supervised in these facilities; therefore, no violations of the JJDPA were identified. 3400+ Napa Detentions II CH LTR 20-22 Dina Jose Director Page 3 Corrective Active Plan The department submitted a Corrective Action Plan (CAP) on August 25, 2022. The CAP addressed all noncompliance issues that were identified during the onsite inspection; there are currently no outstanding items of noncompliance at the Napa County Jail. -- This concludes our inspection report for the 2020 – 2022 inspection cycle. In any case in which a minor dies while detained in a jail, ☒ ☐ ☐ lockup, or court holding facility: (1) The administrator of the facility shall provide to the Board a copy of the report submitted to the Attorney General under Government Code Section 12525. A copy ☒ ☐ ☐ of the report shall be submitted within 10 calendar days after the death. (2) Upon receipt of a report of death of a minor from the administrator, the Board may within 30 calendar days inspect and evaluate the jail, lockup, or court holding ☒ ☐ ☐ facility pursuant to the provisions of this subchapter. Based on traditional dayroom alone, the rated capacity would be a maximum of 39 inmates. With additional beds, dayroom size would allow a rated capacity of 48 in each unit. The State Fire Marshal occupancy rating allows for a maximum of 20 inmates on each tier. In 1993, one cell in each unit was modified as a pass-through to the exercise yard. There are a total of 19 cells in each unit. Each unit has 4 showers.
