Harbor Blvd. Anaheim, CA 92805 2016-2018 BIENNIAL INSPECTION 6031 PC and 209 WIC Dear Chief Harvey: On June 5, 2018, the Board of State and Community Corrections (BSCC) conducted the biennial inspection of the Anaheim Police Department's City Jail pursuant to Penal Code Section 6031 for compliance with the Minimum Standards for Local Detention Facilities as outlined in Titles 15,and 24, California Code of Regulations. BSCC staff also conducted compliance monitoring pursuant to Welfare and Institutions Code Section 209(f) for the federal Juvenile Justice and Delinquency Prevention Act (JJDPA) for the secure detention of minors. Sergeant Patrick Putman was present during the inspection and assisted in coordinating the inspection, answering questions, clarifying procedural issues, and escorting us through the facility. He devoted the extra time and effort needed to prepare for a successful inspection. The complete BSCC inspection report is enclosed and consists of this transmittal letter: Inspection Worksheet identifying the facilities and the areas of non-compliance, Procedures Checklist outlining applicable Title 15 sections, Physical Plant Evaluation outlining Title 24 requirements for design' and Living Area Space Evaluation summarizing the detention facility's physical plant configuration Local Inspections In addition to a biennial inspection by the BSCC, inspections are also required annually by the County Health Officer and biennially by the State Fire Marshal or an authorized representative (Health and Safety Code Sections 101045 and 13146.1). Please consider our report in conjunction with the reports from the County Health Officer and Anaheim Fire Department for a comprehensive perspective of your facility. A fire/life safety inspection was conducted on April 12, 2018 by the Anaheim Fire Department. No deficiencies affecting fire/life safety were noted and a fire clearance was granted. The local health authority inspection was conducted on October 7, 12, and 17, 2017. All deficiencies have been corrected. Julian Harvey, Chief of Police , Facilities are assessed against Title 24 requirements in place at the time of design or significant remodel to the jail area. 3580 Anaheim PO City Jail: 08/06/2018 Page 2 We encourage the practice of maintaining a permanent file for historical copies of all inspections. This file should be the first point of reference when preparing for all future inspections. BSCC Inspection Physical Plant: Completed in 1962, the Anaheim City Jail is inspected as a Type I facility and evaluated using the 1980 and 1994 Physical Pant Standards. With a Rated Capacity of 120, there are 126 actual beds. The jail was clean and appeared well maintained. Each holding cell is less than the 40 square foot minimum as required by Title 24, Section 1231.2.2. No other issues of non-compliance with applicable physical plant standards were identified. Policies, Procedures and Practices: During the inspection, we reviewed the relevant sections of policy to ensure that each subject required by regulation was addressed.'. We informed your staff that there is a recently updated version of Title 15 minimum standards and that the facility should go through the new standards to ensure that the facility will remain in compliance with the policy and procedures manual. We also evaluated procedures at the facility and compared them against policy. Those evaluations typically include an in-depth review of documentation related to jail operations including security logs, shift schedules, local inspection results, classification documents, grievances, disciplinary actions, incident reports and other records which give insight to the facility's operations to ensure that practices matched written procedures and that written documents reflected actual events. Eight inmates were in custody at the time of our inspection. We reviewed a variety of records including classification forms, safety check logs and intake screening instruments. Documents of specialty housing were reviewed, including the sobering and safety cell logs. There were two non-compliance issues: • 1055 Use of Safety Cell: Part of this section requires intermittent direct visual observation to occur no less than twice every half hour. During our review of the safety cells logs, there were several observations logs that exceeded the required time frame. • 1056 Use of Sobering Cell: Part of this section requires intermittent direct visual observation to occur no less than every half hour. During our review of the sobering cells logs, there were several observation logs that exceeded the 30-minute requirement. Juvenile Inspection We reviewed policy, procedures, practice and supporting documentation related to the requirements of Title 15 Article 9 - Minors in Custody in a Law Enforcement Facility and WIC Section 207.1(d). Minors in non-secure detention are held outside the secure perimeter in a common area. BSCC is the designated compliance monitoring agency for the Juvenile Justice and Delinquency Prevention Act (JJDPA), and is authorized by Welfare and Institutions Code 209(1) to inspect facilities that may detain minors in secure detention. Three minors were detained past 6-hours. , BSCC does not review all of your policies and procedures. We only review those policies related specifically to the applicable regulations included in Title 15, Minimum Standards for Local' Detention Facilities for issues of non-compliance. We do not "approve" your policies nor do we review them for Constitutional or legal issues. We recommend agencies seek policy review through their legal advisor, risk manager, and other persons deemed appropriate. 3580 Anaheim PD City Jail; 08/06/2018 Julian Harvey, Chief of Police Page 3 We strongly encourage continued management oversight related to the detention of minors as compliance with WIC Section 207.1(d) and Title 15, Article 9 is required to maintain suitability for the secure confinement of minors in law enforcement facilities. Corrective Action Plan: Please advise us of the status of correcting the issues of non-compliance and the Juvenile violations identified in this report by September 17, 2018. Please provide us with copies of any policies or practices that were modified or created. We are always available to provide any technical assistance you might request. A total of thirty-nine (of the sixty-one) single-occupancy rooms were changed to double-occupancy. The reason not all of the single cells were reclassified was to keep in compliance with the shower ratio (1994’s ratio is 1:20). Prior LASEs counted the receiving shower as the 5th shower and the dorm housing shower as the 6th. The 6th shower can be utilized to increase the RC to 120 however, there needs to be a schedule in place to allow the use of this particular shower. The department will need to identify the cells that will be converted to double occupancy cells and notify the Board of the anticipated change.
