Executive Oirector Governor August 20,2018 Robert Sharpnack, Chief of Police Costa Mesa Police Department 99 Fair Drive Costa Mesa, CA 92628 2016-2018 BIENNIAL INSPECTION 6031 PC & 209 WIC Dear Chief Sharpnack: On June 6, 2018, Board of State and Community Corrections (BSCC) staff conducted the biennial inspection of the Costa Mesa City Jail pursuant to Penal Code Section 6031 for compliance with the Minimum Standards for Local Detention Facilities as outlined in Titles 15 and 24, California Code of Regulations. In addition, BSCC staff conducted compliance monitoring pursuant to the federal Juvenile Justice and Delinquency Prevention Act (JJDPA) for the secure detention of minors. The inspection was preceded by a desk audit of applicable policies and procedures governing the operation of the facility1. The on-site inspection began with a review of documentation to verify that practices follow written procedures and regulation, and concluded with a walk-through of the physical plant. We personally thank Lieutenant Keith Davis for devoting the extra time and effort needed to prepare for a successful inspection. Inspections create significant demands on your already very busy staff. All of the staff we spoke with during the inspection were knowledgeable of the applicable regulations and policies and professional in their appearance and demeanor. The complete BSCC inspection report is enclosed and consists of: This transmittal letter; Inspection Cycle Information sheet identifying the facility and listing any areas, of non compliance; The Procedures Checklist outlining applicable Title 15 sections; The Physical Plant Evaluation outlining Title 24 requirements for design;2 and, The Living Area Space Evaluation summarizing the detention facility's physical plant configuration. 1 BSCC does not review all of your policies and procedures, We only review those policies related specifically to the applicable regulations included in Title 15, Minimum Standards for Local Detention Facilities for issues of non compliance, We do not "approve" your policies nor do we review them for constitutional or legal issues, We recommend agencies seek policy review through their legal advisor, risk manager, and other persons deemed appropriate. 2 Facilities are assessed against Title 24 requirements in place at the time of design or significant remodel to the jail area 3620 Costa Mesa City Jail I; Robert Sharpnack, Chief of Police 2 1Page Local Inspections In addition to a biennial inspection by the BSCC, inspections are also required annually by the County Health Officer and biennially by the State Fire Marshal or an authorized representative (Health and Safety Code Sections 101045 and 13146.1). Please consider our report in conjunction with the reports from the County Health Officer and the Costa Mesa Fire Department for a comprehensive perspective of your facility. Fire Inspection: A firellife safety inspection was conducted on September 6, 2017 by the Costa Mesa Fire Department. No deficiencies affecting fire/life safety were noted and a fire clearance was granted. Health Inspections: The local health authority conducted the required medical/mental health services, nutritional requirements and environmental health standards on October 24, 2017. There were no non compliance issues. We encourage the practice of maintaining a permanent file for historical copies of all inspections. This file should be the first point of reference when preparing for all future inspections. BSCC Inspection Physical Plant: Completed in 1967 the Costa Mesa City Jail is inspected as a Type I facility and evaluated using the 1963 Physical Plant Standards. With a Rated Capacity of 32, no inmates were in-custody at the time of the inspection. The jail was clean and appeared well maintained. The only issue of non-compliance with applicable physical plant standards is the lack of a holding cell. Policy and Procedures: As with the last inspection cycle, the faCility operates as a temporary holding facility. We reviewed a subset of the agency's policy manual specific to the facility operations and compared the contents against relevant regulations to ensure that each subject required by regulation was addressed in policy. We informed Lt. Davis that there is a recently updated version of Title 15 minimum standards and that the facility should go through the new standards to ensure that the facility will remain in compliance with their policy and procedures manual. There were no areas of non-compliance noted. r Juvenile Inspection We reviewed policy, procedures, practice and supporting documentation related to the requirements of Title 15 Article 9 - Minors in Custody in a Law Enforcement Facility and WIC Section 207.1(d). Minors are held in the report writing area separate and away from adult inmates. Minors are not held in secure detention.
