Executive Director Governor September 10,2018 David Valentin, Chief of Police Santa Ana Police Department 60 Civic Center Plaza Santa Ana, CA 92701 2016-2018 BIENNIAL INSPECTION 6031 PC and 209 WIC Dear Chief Valentin: On June 5, 2018, Board of State and Community Corrections (BSCC) staff conducted the biennial inspection of the Santa Ana Police Department City Jail pursuant to Penal Code Section 6031 for compliance with the Minimum Standards for Local Detention Facilities as outlined in Titles 15 and 24, California Code of Regulations (CCR). In addition, BSCC staff conducted compliance monitoring pursuant to Welfare and Institutions Code Section 209(f) for the federal Juvenile Justice and Delinquency Prevention Act (JJDPA) for the secure detention of minors. The inspection was preceded by a desk audit of applicable policies and procedures governing the operation of the facility, wherein policy content was reconciled against relevant regulations to ensure that each subject required by regulation was addressed in policy. The on-site inspection began with a review of documentation to verify that practices follow written procedures and regulation, and concluded with a walk-through of the physical plant and an exit briefing with Jail Manager Christina Holland. Correctional Sergeant Teresa Velasco was present during the inspection and assisted by answering questions and clarifying procedural issues. Her involvement in the inspection process was extremely valuable. The professionalism and courtesy extended during the process was appreciated. The complete BSCC inspection report is enclosed and consists of: this transmittal letter; the Procedures Checklist outlining applicable Title 15 sections I; the Physical Plant Evaluation outlining Title 24 requirements for design2 and, the Living Area Space Evaluation summarizing the detention facility's physical plant configuration. 1 BSCC does not review all your policies and procedures. We only review those policies related specifically to the applicable regulations included in Title 15, Minimum Standards for Local Detention Facilities for issues of non compliance. We do not "approve" your policies nor do we review them for Constitutional or legal issues. We recommend agencies seek policy review through their legal advisor, risk manager, and other persons deemed appropriate. 2 Facilities are assessed against Title 24 requirements in place at the time of design or significant remodel. 3765 Santa Ana PD City Jail LTR; 09/10/2018 David Valentin, Chief of Police Page 2 Local Inspections In addition to a biennial inspection by the BSCC, inspections are also required mlliually by the County Health Officer and biennially by the State Fire Marshal or an authorized representative (Health and Safety Code Sections 10 I 045 and 13146.1). Please consider our report in conj unction with the reports from the County Health Officer and Santa Ana City Fire Department for a comprehensive perspective of your facility. Fire Inspection: The Santa Ana City Fire Department completed a fire/life safety inspection on May 1, 21017. No deficiencies atTecting tire/life safety were noted and a lire clearance was granted. Health Inspections: The local health authority is required to conduct annual inspections of all detention facilities and includes evaluation of medical and mental health services, nutritional requirements and environmental health standards. The inspections were conducted on September 6 and 9, 2017. No deficiencies related to local ilU11ates were noted on the rep0l1. We encourage the practice of maintaining a permanent file for historical copies of all inspections. This file should be the first point of reference when preparing for all future inspections. BSCC Inspection Physical Plant: Completed in 1997, the Santa Ana City Jail is inspected as a Type II facility and evaluated using the 1994 Title 24, CCR standards. With a rated capacity of 480 no local ilU11ates were in custody were housed on the day of the inspection. The detention facility operates as a Temporary Holding Facility for local illli1ates and a Type II facility for U.S. Marshal inmates. Local illli1ates are processed in the reception area and immediately transported to the adjacent Orange County .Iail via a tunnel. The jail was clean and appeared well maintained. No issues of non-compliance with applicable physical plant standards where local inmates are processed were identified. Policy, Pl'Ocedures and Practice: During the inspection, BSCC staff reviewed applicable policy, procedures, practices and supporting documentation where necessary. We informed your staff that there is a recently updated version of Title 15 minimum standards and that the facility should go through the new standards to ensure that the facility will remain in compliance with their policy and procedures manual. Documentation review included training records, daily/monthly inspections, receiving screening and safety checks. One area of non compliance was noted: Title 24, Section 1058 Use of Restraint Devices - Requires at least two -30 minutes documented observation. Several observation loges exceeded 30 minutes. In accordance with the .I.1DPA, BSCC monitors law enforcement facilities for compliance with three core requirements of the Act: Deinstitutionalization of Status Offenders, Separation of Juveniles fi·Oln Incarcerated Adults, and Removal from Adult .Iails and Lockups (6-hour secure detention limitation). Minors do not enter this facility. Minors are held in separate portion of the building under the control and operation of law enforcement personnel.
