Executive Director Governor October 16, 2018 Roxana Kennedy, Chief of Police Chula Vista Police Department 315 Fourth Ave. Chula Vista, CA 91910 2016-2018 BIENNIAL INSPECTION 6031 PC & 209 WIC Dear Chief Kennedy: On .Iune 20, 2018, the Board of State and Community Corrections (BSCC) staff conducted the biennial inspection of the Chula Vista City Jail pursuant to Penal Code Section 6031 for compliance with the Minimum Standards for Local Detention Facilities as outlined in Titles 15 and 24, California Code of Regulations. In addition, BSCC stalT conducted compliance monitoring pursuant to the federal Juvenile Justice and Delinq uency Prevention Act (.1.1 DP A) for the secure detention of minors. The inspection was preceded by a desk audit of applicable policies and procedures governing the operation of the facility', wherein policy content was reconciled against relevant regulations to ensure that each subject required by regulation was addressed in policy. The on-site inspection consisted of a review of documentation, verif"ication that your practices follow your written procedures and regulation, and concluded with a walk-through of the physical plan!. Lieutenant Don Redmond and his staff assisted by answering questions and clarifying procedural issues. Their involvement in the inspection process was extremely valuable. The professionalism and courtesy extended during the inspection was appreciated. The complete BSCC inspection report is enclosed and consists of: this transmittal letter; Inspection Cycle Information sheet identifying the facility and listing any areas of non-compliance; the Procedures Checklist outlining applicable Title · 15 sections; The Physical Plant Evaluation outlining title 24 requirements for design;2 and, the Living Area Space Evaluation summarizing the detention facility's physical plant contiguration. I BSCC does not review all of your policies and procedures. We only review those policies related specifically to the applicable regulations included in Title 15, Minimum Standards for Local Detention Facilities for issues of non-compliance. We do not "approve" YOLlr policies nor do we review them for constitutional or legal issues. We recommend agencies seek policy review through their legal advisor, risk manager, and other persons deemed appropriate. 2 Facilities are assessed against Title 24 requirements in place at the time of design or significant remodel to the jail area. 4618 Chula Vista PO City Jaill LTR; 10/16/2018 Roxana Kennedy, Chief of Police 2 1Page Local Inspections In addition to a biennial inspection by the BSCC, inspections are also required annually by the County Health Otlicer and biennially by the State Fire Marshal or an authorized representative (Health and Safety Code Sections 101045 and 13146.1). Please consider our report in conjunction with the rep0l1s from the County Health Officer and the Chula Vista Fire Department for a comprehensive perspective of your facility. Fire Inspection: A lire/life safety inspection was conducted on December 22, 2016 by the Chula Vista Fire Department. No deficiencies were noted and the facility was granted a fire clearance. Health Inspections: The local health authority conducted the annual inspections on January 22, and April 27, of 2018. No non-compliances issues were noted. BSCC Inspection Physical Plant: Completed in 2004, the Chula Vista City .Jail is inspected as a Type [ facility and evaluated using the 2001 Title 24 physical plant standards. Rated for 46, the depat1ment contracts with the US Marshal to hold federal inmates. By practice, local inmates are rarely held or booked into the facility. They are transported to the county jail from the field. No issues of non-compliance with applicable physical plant standards were identified. Police, Procedures and Practices: The agency has a comprehensive policy manual applicable to both federal and local inmates. We reviewed the relevant sections of the existing policy and reconciled the contents against regulations to ensure that each subject required by regulation was addressed in policy. We reviewed the facility's documentation related to jail operations including security logs, shift schedules, local inspection results, classification documents, incident reports and other records which give insight to the facility's operations. We interviewed statTto ensure that practices matched written procedures and that written documents reflected actual events. No items of non-compliance were noted concerning the agency policy. Juvenile Inspection: We reviewed policy, procedures, practice and supporting documentation related Minors in Custody in a Law Enforcement Facility. Minors are held in an area adjacent to the of[icer's report writing room. BSCC is the designated compliance monitoring agency for the Juvenile Justice and Delinquency Prevention Act (.I.JDPA), and is authorized by Welfare and Institutions Code §209(f) to inspect facilities that may detain minors in secure detention. There were no violations noted.
