Duffy Administrative Center 9621 Ridgehaven Court San Diego, CA 92123 Dear Undersheriff Martinez: 2020-2022BIENNIAL INSPECTION SAN DIEGO COUNTY'S COURT HOLDING FACILITIES; PENAL CODE SECTION 6031 On November 30, 2021, staff of the Board of State and Community Corrections (BSCC) provided pre-inspection briefings to facility supervisors outlining the proposes, process and necessary documentation needed for the biennial inspection. Staff gave participants a complete preview of the inspections that took place in January 2022. BSCC staff provided applicable checklists and answered any questions. The complete BSCC inspection report is enclosed and consists of this transmittal letter, the Title 15 Procedures Checklist outlining applicable minimum standards, a Physical Plant Evaluation Outlining Title 24 requirements for design and, a Living Area Space Evaluation summarizing the physical plant configuration and showing the capacity of the facility. Refer to the Title 15 Checklist for indication of compliance status and evidence used to determine compliance. BSCC conducted the 2020-2022biennial inspection of the following San DiegoCounty court holding facilities during January 2022: North County Superior San Diego Central Courthouse San Diego Juvenile Court Court (Vista) East County Superior Court South County Superior San Diego Hall of Justice (El Cajon) Court (Chula Vista) These inspections were performed pursuant to Penal Code Section 6031, for compliance with the Minimum Standards for Local Detention Facilities as outlined in Titles 15 and 24, California Code of Regulations. The complete BSCC inspection report is enclosed and consists of: (cid:120) This transmittal letter, (cid:120) The Court Holding Facilities Procedures checklist outlining Title 15 requirements for each of the above facilities, (cid:120) A Physical Plant Evaluation outlining Title 24 requirements for design for each of the above facilities, and (cid:120) A Living Area Space Evaluation summarizing the physical plant configuration of each of the above facilities. 4383+ San Diego CH CHJ LTR 20-22 Undersheriff Martinez San Diego County Sheriff’s Office Page 2 Local Inspections In addition to the biennial inspection by the BSCC, inspections are also required annually by the County Health Officer and biennially by the State Fire Marshal or an authorized representative (Health and Safety Code Sections 101045 and 13146.1). Please consider our report in conjunction with the reports from the County Health Officer and the respective fire authorities for a comprehensive perspective of your facilities. We encourage the practice of maintaining a permanent file for historical copies of all inspections. This file should be the first point of reference when preparing for all future inspections. Health Inspections We have a current health inspection report for all the above listed facilities. The local health inspector did not identify any non-compliant Title 15 items. Fire and Life Safety Inspections, CCR 15, 1032(c): We were also able to review current fire and life safety inspections for all above listed facilities. BSCC Inspection Title 15 Inspection Prior to the inspection of each of the listed facilities, we reviewed the San Diego Sheriff's Department Court Services Manual, applicable sections of the San Diego Sheriff's Department Custody Division Manual and branch specific policies. Our audit consisted of a review of only those policies and procedures related specifically to the applicable regulations included in Title 15, Minimum Standards for Local Detention Facilities.1 There were no issues of noncompliance identified during our review of the policy and procedures manuals; our review of pertinent documentation in each of the above facilities found no items of noncompliance. Title 24 Inspection BSCC Staff completed a walk-through of all the listed facilities. We found no issues of noncompliance with Title 24. Juvenile Justice and Delinquency Prevention Act Compliance In accordance with JJDPA BSCC monitors jail facilities for compliance with one of four core requirements of the Act, Separation of Juveniles from Incarcerated Adults. Minors are held in secure confinement for short periods of time in the court holding facilities. In the facilities where minors are detained in the facility for court hearings, they are kept separate from adult inmates, and are under 1 BSCC does not review all of your policies and procedures. No violations of the JJDPA identified during our review. Technical Assistance BSCC staff continually offer technical assistance to facility management. This included an immediate review of the inspection and any non-compliance issues. Additional BSCC Staff provided an initial inspection report and debriefing on January 20, 2022. This included providing information on potential courses of action to prevent non-compliance issues, guidance on developing a corrective action plan, and changes to JJDPA records requirements. Corrective Action Plan There are currently no outstanding items of noncompliance. This concludes our inspection report for the 2020-2022 inspection cycle.
