Main Street EI Cajon, CA 92020 2016 - 2018 BIENNIAL INSPECTION 6031 PC & 209 WIC Dear Chief Davis: On June 21, 2018, the Board of State and Community Corrections (BSCC) conducted an Inspection of the EI Cajon Police Department's temporary holding facility as it relates to the Minimum Standards for Local Detention Facilities as outlined in Titles 15 and 24, California Code of Regulations, (CCR) and the Federal Office of Juvenile Justice and Delinquency Prevention (OJJDP) standards for holding minors. The inspection was preceded by a desk audit of applicable policies and procedures governing the operation of the facility " wherein policy content was reconciled against relevant regulations to ensure that each subject required by regulation was addressed in policy. The on-site inspection began with a review of documentation to verify that practices follow written procedures and regulation, and concluded with a walk-through of the physical plant. We want to thank Officer John Pears ley for his assistance in answering questions, clarifying procedural issues, and escorting us through the facility. Several operational and physical plant issues were discussed. The complete BSCC inspection report is enclosed and consists of: This transmittal letter; The Procedures Checklist outlining applicable Title 15 sections; The Physical Plant Evaluation outlining Title 24 requirements for design;' and, The Living Area Space Evaluation summarizing the detention facility's physical plant configuration. Local Inspections In addition to a biennial inspection by the BSCC, inspections are also required annually by the County Health Officer and biennially by the State Fire Marshal or an authorized representative (Health and Safety Code Sections 101045 and 13146.1). Please consider our report in conjunction with the reports from the 1 BSCC does not review all of your policies and procedures. We only review those policies related specifically to the applicable regulations included in Title 15, Minimum Standards for Local Detention Facilities for issues of.non compliance. We do not "approve" your policies nor do we review them for constitutional or legal issues. We recommend agencies seek policy review through their legal advisor, risk manager, and other persons deemed appropriate. , Facilities are assessed against Title 24 requirements in place at the time of design or significant remodel to the jail area. 4452 EI Cajon PD City Jail LTR: 10116/2018 Jeff Davis, Chief of Police 21 Page County Health Officer and the San Diego County Fire Authority for a comprehensive perspective of your facility. Fire Inspection: The fire inspection is overdue. Please schedule and forward the results upon completion. Health Inspections: The local health authority conducted the annual inspections on February 15, 2018. No non-compliance issues were noted. We encourage the practice of maintaining a permanent file for historical copies of all inspections. This file should be the first point of reference when preparing for all future inspections. BSCC Inspection Physical Plant: Completed in 2009, as a Type I facility, the facility continues to operate as a temporary holding facility and will be evaluated as such. The facility was built under the 2005 standards that were in effect at the time of the original construction. The facility consists of 8 holding cells that can house up to 1 prisoner past 12 hours and 2 holding cells that can house up to 2 prisoners past 12 hours. The facility is constructed in a horseshoe format with two distinct entries; one for adult prisoners and the other for juvenile offenders. Prisoners are rarely held in a holding cell. For the most part prisoners are typically handcuffed to a bench between 15 -30 min before being cited out or transferred to the county jail. Secure youth are held in cells 9 and or 10. Non-secure youth are placed on a beach in the detention area. The youth entry door into the facility's will remain open. The youth can exit the facility into the vehicle sally port and exit out the pedestrian door, which leads the street as prescribed by statute and regulation. These cells are separated from the adult cells. No non-compliance issues were identified. Policies, Procedures and Practice: We informed your staff that there is a recently updated version of Title 15 minimum standards and that the facility should go through the new standards and update the facility's policy and procedures manual. We evaluated the department's procedures and reconciled them against policy. Those evaluations included a review of documentation related to jail operations including daily inspection sheets, shift schedules, local inspection results, classification documents, incident reports and other records which gave insight to the facility's operations. There were two Title 15 non- compliance issues: 1024 Temporary Holding Facility Training: Requires all personnel who are responsible for supervising inmates to complete the eight hours of specialized training outlined in this regulation within six (6) months of assignment. In addition, eight hours of refresher training is to be completed every two years. It was reported that newly assigned personnel have not completed the required eight hours training nor have current personnel have completed the refresher course. 1027 Number of Personnel: In part requires whenever one or more female inmates are in custody, there is at least one female employee immediately available and accessible. In the rare occasion that there is a female prisoner brought into the facility, there is no immediately female personnel available as required by the regulations nor is there a trained female personnel available as required by 4021 PC. 4452 EI Cajon PD City Jail LTR; 1011612018 Jeff Davis, Chief of Police 31 Page Juvenile Inspection: We reviewed policy, procedures, practice and supporting documentation related to the requirements of Title 15 Article 9 - Minors in Custody in a Law Enforcement Facility and WIC Section 207.1( d). Youth are held in the detention area separate and away from adult's inmates. BSCC is the designated compliance monitoring agency for the Juvenile Justice and Delinquency Prevention Act (JJDPA), and is authorized by Welfare and Institutions Code §209(f) to inspect facilities that may detain minors in secure detention. There were two violations noted. One youth were held p'ast 6 hours and one youth was removed from secure detention and placed in non-secure without a release time making it impossible to determine the duration of secure detention. Corrective Active Plan If the department elects to correct the above non-compliance issues, please forward a corrective response by December 14, 2018. This concludes our inspection report for the 2016-2018 inspection cycle.
