February 11, 2021 San Francisco City and County Juvenile Probation Department Katherine Weinstein Miller, Chief Probation Officer 375 Woodside Avenue San Francisco, CA 94127 RE: 2018-2020 BIENNIAL INSPECTION OF SAN FRANCISCO CITY AND COUNTY JUVENILE PROBATION DEPARTMENT, WELFARE AND INSTITIONS CODE SECTION 209; JUVENILE JUSTICE AND DELINUENCY PREVENTION ACT Dear Chief Miller: Pursuant to the California Welfare and Institutions Code Section 209, the BSCC shall conduct a biennial inspection of each juvenile facility used for confinement of minors for more than 24 hours. These inspections are performed to determine compliance with the Minimum Standards for Local Detention Facilities as outlined in Titles 15 and 24, California Code of Regulations. Statewide, regional trainings were held in preparation for revised regulations in December 2018 to introduce and educate staff on the expectations of the new regulations and to provide technical assistance and direction. An onsite, pre inspection briefing was held April 24, 2019, for facility staff responsible for the inspection process. A policy review was completed on June 9, 2020. All inspection documentation was requested and subsequently reviewed by virtual desk audit due to the coronavirus pandemic and the issuance of statewide and local shelter‐in‐place orders. BSCC staff were prohibited from traveling and unable to complete on‐site inspections. Completing an inspection remotely and virtually does not allow for our regular onsite experiences that assist in the overall determination of compliance. This includes the onsite tour of the facility, observation of daily programs, activities and operations, face to face interviews with facility partners, staff and residents and the ability to observe and make a determination of the culture and environment of the facility. We also miss the opportunity to meet one on one to debrief our findings directly as appropriate. The complete BSCC inspection report is enclosed and consists of this transmittal letter, the Title 15 Procedures Checklist, outlining applicable minimum standards; a Physical Plant Evaluation, outlining Title 24 requirements for design; and a Living Area Space Evaluation, summarizing the physical plant configuration and showing the capacity of the facility. Please refer to the Title 15 procedures checklist for indication of facility compliance status and evidence used to determine compliance. 7517 San Francisco JH LTR 18-20 Chief Miller 2 City and County of San Francisco Juvenile Probation Department Local Inspections In addition to the biennial inspection by the BSCC, Title 15, Section 1313 and statute also require an annual local inspection from the following: county building inspector or person designated by the Board of Supervisors, annual local health officer, annual county Superintendent of Schools; Juvenile Court and the Juvenile Justice Commission. A biennial inspection is required from the fire authority having jurisdiction. Please refer to the Title 15 procedures checklist for dates and specific notes regarding these inspections and consider our report in conjunction with all other reports received for a comprehensive perspective of your facility. There are no outstanding areas of noncompliance in your local inspection reports. Inspection Scope and Results Title 15, CCR Minimum Standards Prior to the desk audit inspection, we began with a review of the San Francisco City and County Probation Department Policy and Procedure Manual. Our evaluation consists of reviewing only those policies, procedures specifically related to the Juvenile Hall and applicable regulations included in Title 15, CCR1. We noted there were multiple policies that were not updated as they were missing information or were inconsistent with the new requirements of the regulations. There were areas of policy and procedure that required various levels of improvement and corrective action. Some areas were able to be addressed and rectified quickly; however, other areas required revision to become compliant. We reviewed facility documentation and other forms or proof of practice which included incident reports regarding suicide watch, use of force and restraints for movement within the facility. We also reviewed room confinement logs, grievances, admission, release and classification documents, assessments and case plans, due process documentation and safety checks. During our review, we identified items of concern. We noted several areas where documentation was lacking due to policy and procedure not being fully updated to recently revised regulations and training not being completed. Documentation was not compliant with regulations in those specific areas at the time of inspection. Subsequent to the inspection, policy matters and procedures were discussed and updated, and operational areas were brought into compliance with training, guidance and technical assistance prior to the completion of this letter. We provided many best-practice recommendations to your new leadership team to assist in obtaining compliance and to enhance facility operations. They have worked very hard to meet minimum standards. Since implementing additional policy, procedures, and training, there have only been a few incidents in the areas where policy and procedure were updated for compliance. We will continue to monitor documentation in these areas to ensure continued compliance. As such, we will request bi-monthly updated documentation to review until we are able to complete our 2020-2022 onsite inspection or until we have determined that full compliance has been obtained. We will also check in monthly to provide guidance and technical assistance as needed. 1 BSCC does not review all policies and procedures. We do not “approve” policies and procedures, nor do we review them for constitutional or legal issues. Upon final review of all documentation and upon the conclusion of this report, all areas of non-compliance have been addressed and we will continue to monitor as noted in the procedures checklist. Title 24, CCR Physical Plant San Francisco Juvenile Justice Center Rated Capacity: 150 We found no areas of noncompliance related to Title 24. Please refer to the Physical Plant Checklist for detailed information. Training The most recent Standards and Training for Corrections audit reports that the San Francisco City and County Probation Department is in full compliance with all relevant regulations and mandates. Juvenile Justice and Delinquency Prevention Act Compliance Monitoring There have been no violations of JJDPA this inspection cycle and no areas of non-compliance were noted. Showers (2.4) Showers provide tempered water and are available on living  units at a ratio of at least one shower or bathtub to every six minors. Shower areas provide for inmate privacy without mitigating staff's ability to supervise.  Beds (2.5) Beds are at least 30 inches wide and 76 long and are of a  pan-bottom type or constructed of concrete. Beds are at least 12 inches of the floor and spaced no less than 36 inches apart.  Lighting (2.6) There is at least 20 foot-candles (216 1x) of illumination at desk level in locked sleeping rooms, single and double  occupancy rooms, dormitories, dayrooms and activity areas. Night lighting in the above areas provides good visibility and is conducive to sleep.  Padding (2.7) Padding in safety rooms covers the floor, door and walls to  a clear height of eight feet. Benches or platforms are not placed on the floor of safety rooms. Padded rooms are equipped with a tamper-resistant fire  sprinkler as approved by the State Fire Marshal (SFM). The padding is approved by the SFM and is: non-porous; at least one-half inch thick; of a unitary or laminated construction; firmly bonded to all padded surfaces; and, is  without exposed seams.
