July 25, 2019 Ian Parkinson, Sheriff-Coroner San Luis Obispo County Sheriff’s Office 1545 Kansas Avenue San Luis Obispo, California 93405 SAN LUIS OBISPO COUNTY SHERIFF’S OFFICE BIENNIAL INSPECTION, 6031 PC and 209 WIC Dear Sheriff Parkinson: On June 11-14, 2019, the Board of State and Community Corrections (BSCC) conducted the 2018-2020 biennial inspection of the San Luis Obispo Main Jail, Honor Farm and the Court Holding Facilities. A pre-inspection briefing was held on March 21, 2019. Pursuant to Penal Code Section 6031, this inspection was performed to determine compliance with the Minimum Standards for Local Detention Facilities as outlined in Titles 15 and 24, California Code of Regulations (CCR). In addition, BSCC conducted compliance monitoring pursuant to Welfare and Institutions Code Section 209(f) for the federal Juvenile Justice and Delinquency Prevention Act (JJDPA). The complete BSCC inspection report is enclosed and consists of: this transmittal letter; the Title 15 Procedures Checklist outlining applicable minimum standards; a Physical Plant Evaluation outlining Title 24 requirements for design; and, a Living Area Space Evaluation summarizing the physical plant configuration and showing the capacity of the facility. Refer to the Title 15 Procedures Checklist for indication of compliance status and evidence used to determine compliance. LOCAL INSPECTION: In addition to a biennial inspection by the BSCC, inspections are required annually by the County Health Officer and biennially by the State Fire Marshal/local fire authority pursuant to Health and Safety Code §101045 and §13146.1 respectively. All fire and local Health inspections are current and all concerns/compliance have been addressed. Local inspection reports are forwarded to your office under a separate cover. 4800 + San Luis Obispo II III CH LTR; 07/25/2019 Ian Parkinson, Sheriff-Coroner 2 | Pa ge BSCC INSPECTION: Title 15 Policies, Procedures, and Practices The inspection consisted of a review of the San Luis Obispo Sheriff’s Office Custody and Court Holding Policies and Procedures Manual1, a site visits to review operations, physical plant and relevant documentation, and interviews with administration, facility staff, inmates and collaborative partners. Please refer to the Procedures Checklist for detailed information. We found the following non-compliances: • Section 1056, Use of the Sobering Cell. This regulation limits the use of the sobering cell to only inmates who are a threat to their own safety or the safety of others due to their state of intoxication. Disruptive, unruly or suicidal inmates are often held in the sobering cells regardless of their state of intoxication. Title 24 Physical Plant County Jail The older section of the jail was constructed under the 1963 Title 24 Regulations. The facility was expanded on multiple occasions and those areas were inspected under the applicable regulations that were in place at the time each was constructed. As a result, the 1986, 1988, 2001 and 2005 regulations are also included in this inspection. With a rated capacity of 639 611 inmates were in custody on the day of the inspection. We found the following non-compliances: • Section 470A.2.8, Dormitories. The West Dormitories 700, 800 and R-Deck Dormitory containing more bunks than their rated capacity. Honor Farm The Men’s Honor Farm provides the majority of educational, vocational, and program space. The men’s dormitories at the Honor Farm were constructed under the 1994 Title 24 Regulations. The female dormitory was relocated to the newest women’s dormitories housing, 201 -203. No area of non-compliance was noted. Court Holding Facility The court holding facility was opened in 1982 and is inspected against the 1980 Title 24 Standards. The facility has space for 77 arrestees in its nine holding cells. No compliance issues were noted related to the physical plant. Juvenile Justice and Delinquency Prevention Act (JJDPA) Compliance Monitoring In accordance with the JJDPA, BSCC monitors jail facilities for compliance with one of four core requirements of the Act; Separation of Juveniles from Incarcerated Adults. Minors are not housed at any of the facilities. 1 BSCC does not review all policies and procedures. We do not “approve” policies and procedures nor do we review them for constitutional or legal issues.
