Bolanos, Sheriff San Mateo County Sheriff’s Office 400 County Center Redwood City, CA 94063 2016-2018 BIENNIAL INSPECTION PENAL CODE 6031 Dear Sheriff Bolanos: On March 12-15, 2018 the Board of State and Community Corrections (BSCC) conducted the biennial inspection of the San Mateo County Sheriff’s Office Adult Detention Facility, Maguire Correctional Facility (MCF), Maple Street Correctional Center” (MSCC) and the Transitional Facility (TF). As in prior inspection cycles and at your management team’s request, we also inspected the court holding facilities including the San Mateo Hall of Justice (HOJ) and the North County Court Holding Facility (NCH).1 To prepare staff for the inspection, a pre-inspection briefing was held on December 13, 2017. Scope of Inspection The inspection was preceded by a desk audit of the Corrections Division’s Policy and Procedures Manual along with applicable post orders governing the operation of each facility. The inspection assessed compliance with adult regulations in Titles 15 and 24, Minimum Standards for Local Detention Facilities, California Code of Regulations (CCR). It consisted of a “walk-through” of each physical plant, review of policies and procedures governing operations, and staff/inmate interviews. Additionally, we met with health care, inmate program and food services administrators and managers. As in past inspections, we interviewed custody’s administrators, managers, supervisory and line staff associated with the facilities. We also interviewed inmates to ensure they have the opportunity to receive programs that are provided by your agency. We want to express our appreciation to Captains Scott Kirkpatrick and Paul Kunkel, Lieutenant Allen Eamonn, Sergeant Chris Sweeny and a special thank you to Management Analyst Kathleen Irvine for once again coordinating and her involvement throughout the inspections. We found your agency to be well prepared with facility staff having information and documentation readily available in anticipation of any questions or concerns we had. I would also like to thank Undersheriffs Mark Robbins and now retired Trisha Sanchez for participating in an exit briefing at the close of our on-site review. This was a clear demonstration of the importance San Mateo Sheriff’s Department places on the inspection process. Bolanos, Sheriff 3 | Pa ge BSCC Inspection: System Wide This report addresses compliance issues with Titles 15 and 24, California Code of Regulations (CCR) for the San Mateo Sheriff’s Department. I will also be addressing my observations and documentations for each facility which led to non-compliance (if applicable) for a specific Title 15 and 24, CCR section as required by 6031.1. PC. This report will include the newest facility, Maple St Correctional Center, which was opened March of 2016. Title 15, CCR; Policy, Procedures and Practice: A desk audit of the Corrections Division’s Policy and Procedures Manual was conducted prior to the on- site inspection. All four facilities operate as a system; therefore, policies and procedures reviewed are applicable to each. Staff members are constantly in the process of reviewing and revising policies. We informed your staff that there is a recently updated version of Title 15 minimum standards and that the facility should go through the new standards to ensure that the facilities will remain in compliance with their policy and procedures manual. Please review the enclosed policy and procedures checklist. On-site BSCC continued its inspection by evaluating procedures at the facility and compared them against policy. Those evaluations include a review of documentation related to jail operations including security logs, shift schedules, local inspection results, classification/housing assignments, incident reports, disciplinary actions, grievance actions and other records which give insight to the facility’s operations. When applicable, special attention was given to those low-incidence but high-liability practices involving inebriates (sobering cells), high-risk inmates and use of restraints and safety cells placement. BSCC sought to ensure that practices matched written procedures and that written documents reflected actual events. Lastly, BSCC interviewed staff to ensure that documented procedures were being performed according to policy. All documents reviewed were completed and well organized. No area of non- compliance was noted related to the policies and procedures manual. One key determination to be made during the inspection process is the adequacy of staffing. Title 15 Section 1027 requires each facility to maintain adequate on-duty staff to ensure the implementation of all programs and activities as required by regulation. Supervision of arrestees is the responsibility of correctional officers, supervised generally by a Jail Manager. BSCC reviewed security check logs, incident reports and arrestee files to ensure that all required tasks were completed in a timely and safe manner. Although the policy and procedure manual had no non-compliance issues, the following staff practices and documentations were observed to be non-compliance: • Title 15, Section, 1027 Number of Personnel (Safety Checks): Policy and Procedures § 02.01 (6 & 05.07 requires deputies to conduct 60 min. safety checks on inmates that are in their cell. During our document review we noticed several safety checks past the 60-mins. (Maguire & Maple St). • Title 15, Section, 1055 Safety cell: Policy and Procedures § 06.12 requires deputies to conduct and document at least two direct visual observation every 30 mins. Bolanos, Sheriff 4 | Pa ge • Title 15, Section, 1065 Exercise and Recreation: This regulation requires three hours of exercise and recreation distributed over a period of seven days. Policy and Procedures § 06.06 (6) states “Inmates housed in Administrative Segregation housing units will receive no less than three hours of recreation time in a seven-day period.” While touring the adseg units, I was informed by staff the inmates are let out of their cell one by one for thirty minutes a day. During the thirty minutes they have the opportunity to shower (hygiene), have outside recreation, watch tv, read or just hang out in the day room. Policy and Procedures § 15.04 (E) states “Inmates will be allowed to shower on a daily basis during hygiene time, or at a minimum, every other day.” Title 15, Section, 1266: Inmates shall be permitted to shower/bath at least every other day or more often if possible. Showers are neither recreation nor exercise but are a regulated inmate right and cannot be included in the time allotted to “Exercise and Recreation.” I applaud the effort of the facility letting inmates out of their cell daily; however, thirty minutes a day does not meet the three hours of recreation time in a seven days period if it includes mandated activities such as showering. I explained to staff that these two regulations are separate and they cannot be combined into one- time period. • Title 15, Section, 1081 Plan for Inmate Discipline: Part of this regulation requires violation(s) acted on no later than 72 hours from the time the inmate is informed of the charge(s) in writing unless waived by the inmate or for good cause. During our document review we noticed several documented observation checks past the 72-mins. without any cause. (Maguire). Evidence Based Programs: There is an assortment of programs available to inmates. The programs are primarily focused on addressing the typical areas of weakness that prevent inmates from successfully re-entering to the community: giving them skills to avoid the temptations to reoffend and to find success in the workplace. General education, cognitive behavioral, and substance abuse programs are available at the jails as well as vocational training and spiritual assistance. Alternative to custody release programs and electronic monitoring are designed to reduce the jail population in the short term and allow inmates to retain family ties and continued employment, as efforts to reduce recidivism. In addition, Service League of San Mateo County is a private non-profit corporation operating a human services assistance program in San Mateo County. The agency’s mission is to provide programs and resources which promote positive changes in individual and their families involved in the criminal justice system. The agency coordinates and delivers programs to both MCF and MSCC. These programs provide problem-solving, humanitarian, education and personal growth oriented services. Inmates can request and fill out a request form in each pod. The service league provides counseling, religious services, help with family matters, as well as assistance with voting. Transitioning Animals into Loving Situations (T.A.I.L.S.) is a partnership between Peninsula Humane society and SPCA and the Sheriff’s Office since 2009. Shelter dogs with various behavioral challenges are paired with inmate’s handlers. A trainer teaches a structured weekly obedience class for the handlers and their dogs. After 8 weeks of training, the doges are placed in a new loving home. The inmates learn new skills and have a meaningful way to use their time. 4910 + San Mateo II CH LTR; 07/18/2018 Carlos G. Bolanos, Sheriff 5 | Pa ge Title 24, CCR Physical Plant: Maguire With the addition of the Maple St Correction Center, the facility’s population is lower than the 2014-2016 inspection cycle. With a rated capacity of 688, on the day of our visit, there were 523 males and 2 female inmates in custody. Constructed in 1988, the facility was remodeled in 1994 and was designed using single cell, double cell, multiple occupancy cell and dormitory housing configurations. MCF has been and will continue to be the intake facility for the county jail system and the primary provider of medical and mental health services to all inmates. The facility is evaluated under the 1980 (Old Maguire portion) and 1988 (New Maguire portion) Title 24 standards that were in effect at the time of the original construction or significant remodeling. Several security upgrades, which began in August 2015 are completed with additional security upgrades scheduled for completion in the near future. This involved the installment of the video visitation units in the visiting areas. The upgrades have improved the safety and security, both inside and outside of the facility. In addition to electronic upgrades, the lobby is now secure at night and sentenced inmates are released during daylight hours. A new computerized jail management program has been implemented to better manage all of the jail records. There were no non-compliance issues with title 24 standards. Maple Street Correctional Center and the Men’s and Women’s Transitional Facility Opened in 2016, the facility is constructed under the 2010 regulations. With a 680-rated capacity, the facility is a full functional jail; however, booking and intake take place at Maguire facility. Inmates are transferred to the Maple St. facility fully dressed in jail clothing. On the day of inspections, there were 332 males and 126 females. The center also houses the Transitional Facility for minimum security inmates who are either participants in the Sheriff’s Work Furlough Program or are assigned to perform work in and around the facility property. There were no non-compliance title 24 standards. Hall of Justice & Northern Court Holding At the request of management, we inspected the overall operation of the HOJ and NCH and all of the holding cells located within each facility regardless of date of construction. We were pleased to see that the San Mateo Sheriff’s Office makes every effort to operate the older facilities in compliance with current Title 15 regulations and continues to request they be inspected biennially. Penal Code Section 6031.4 (b) authorizes the BSCC to inspect court holding facilities built after January 1, 1978. Unless a department specifically requests an inspection, we do not have the authority to inspect court holding facilities built before that date. Holding cells on the second floor, seventh floor and eighth floor of the Hall of Justice Court building and all of the cells at the Northern Court building were constructed before January 1, 1978 and would not be included in our standard inspection cycle. In the normal course, we would only inspect the holding cells on the fourth floor of the Hall of Justice, which were completed in 1994 under the applicable 1988 Title 24 regulations. An organizational change was implemented in 2011 that resulted in the transfer of the operational duties in respect to the HOJ fourth floor holding cells from the Court Services Division to the MCF. The cells are now considered to be a part of the jail as they are operated by the jail management team under the jail policies. We will now inspect these cells as part of the jail.
