Bolanos, Sheriff San Mateo County Sheriff’s Office 400 County Center Redwood City, CA 94063 2020-2022 BIENNIAL INSPECTION OF SAN MATEO COUNTY SHERIFF’S OFFICE JAILS AND COURT HOLDING FACILITIES, PENAL CODE 6031 Dear Sheriff, Bolanos: On January 25-28, 2021, the Board of State and Community Corrections (BSCC) conducted the biennial inspection of the San Mateo County Sheriff’s Office Adult Detention Facility, Maguire Correctional Facility (MCF), Maple Street Correctional Center (MSCC) and the Transitional Facility (TF). To prepare staff for the inspection, a pre-inspection briefing was held on December 16, 2020. Scope of Inspection The inspection was preceded by a desk audit of the Corrections Division’s Policy and Procedures Manual along with applicable post orders governing the operation of each facility. The inspection assessed compliance with adult regulations in Titles 15 and 24, Minimum Standards for Local Detention Facilities, California Code of Regulations (CCR). It consisted of a “walk-through” of each physical plant, review of policies and procedures governing operations, and staff and inmate interviews. Additionally, we met with health care, inmate program and food services administrators and managers. As in past inspections, we interviewed custody’s administrators, managers, supervisory and line staff associated with the facilities. We also interviewed inmates to ensure they have the opportunity to receive programs that are provided by your agency. The complete BSCC inspection report is enclosed and consists of: this transmittal letter; the one Procedures Checklist for the three detention facilities; one consolidated Procedures Checklist for the Court Holding Facilities; a Physical Plant Evaluations for each facility, outlining Title 24 requirements for design; and, a Living Area Space Evaluation summarizing each facility’s physical plant configurations. Local Inspections: In addition to a biennial inspection by the BSCC, inspections are also required annually by the County Health Officer and biennially by the State Fire Marshal or an authorized representative (Health and Safety Code Sections 101045 and 13146.1). Fire and Local Health inspections for each facility are current with no deficiencies. Consider our report in conjunction with the reports from the County Health Officer and the Fire Authority for a comprehensive perspective of your facilities. 4910+ San Mateo II IV CH LTR 20-22 Carlos Bolanos, Sheriff 2 | Pa g e BSCC Inspection: Title 15, CCR; Policy, Procedures and Practice: A desk audit of the Corrections Division’s Policy and Procedures Manual was conducted prior to the on-site inspection. All five facilities operate as a system; therefore, policies and procedures reviewed are applicable to all facilities. The department is constantly reviewing and revising their policies. On-site, BSCC evaluated procedures and compared them against policy. Those evaluations include a review of documentation related to jail operations including security logs, shift schedules, local inspection results, classification and housing assignments, incident reports, disciplinary actions, grievance actions and other records which give insight to the facility’s operations. When applicable, special attention was given to those low-incidence but high-liability practices involving inebriates (sobering cells), high-risk inmates and use of restraints and safety cell placement. BSCC sought to ensure that practices matched written procedures and that written documents reflected actual events. Lastly, BSCC interviewed staff and inmates housed at the facilities to ensure that documented procedures were being performed according to policy. All documents reviewed were completed and well organized One area of non-compliance was noted at the Maguire Correctional Facility: • 1280. Facility Sanitation, Safety, and Maintenance: This regulation requires that policies and procedures maintain an acceptable level of cleanliness, repair and safety in the facility. During our walk-through of the Administrative Segregation housing unit, cells appeared to be in unsanitary condition. Please review the enclosed policy and procedures checklists for details and further information. Title 24, CCR Physical Plant: Maguire Correctional Facility With a rated capacity of 688, on the day of our visit, there were 373 males and one female inmate in custody. Constructed in 1988, the facility was remodeled in 1994 and was designed using single cell, double cell, multiple occupancy cell and dormitory housing configurations. MCF is the intake facility for the county jail system and the primary provider of medical and mental health services to all inmates. The facility is evaluated under the 1980 (Old Maguire portion) and 1988 (New Maguire portion) Title 24 standards that were in effect at the time of the original construction or significant remodeling. One area of non-compliance was noted: • § 1231.2.10 Exercise area: The exercise area must contain or provide free access to a toilet, wash basin, and drinking fountain as provided in Section 1231.3. In the Administrative Segregation housing unit’s outdoor area, several locked “one-person” exercise enclosures have been installed and lack the required toilet, wash basin or drinking fountain. Maple Street Correctional Center Once booked at the Maguire Facility, inmates are transferred to the Maple Street facility fully dressed in jail clothing. The facility has a rated capacity of 680; on the day of inspection, there were 271 male and 63 female inmates in custody. 4910 + San Mateo II IV CH LTR 20-22 Carlos Bolanos, Sheriff 3 | Pa g e Maple Street also houses the San Mateo Transitional Facility, a Type IV Facility for minimum security inmates who are either participants in the Sheriff’s Work Furlough Program or are assigned to perform work in and around the facility property. On the day of inspection, there were six males and four females in custody. There were no items of non-compliance with Title 24 standards. Hall of Justice & Northern Court Holding Facilities We identified no noncompliance issues at either facility. Corrective Active Plan We received a Corrective Active Plan dated, February 17, 2021, for the two non-compliance issues outlined above. Regarding Title 15, Section 1280, the west A-side housing unit’s cells, and dayroom have been disinfected, deep cleaned, and repainted to achieve and better maintain sanitary conditions. In addition, a new protocol has been established where Sergeants will ensure each housing unit is kept in sanitary and safe condition. Upon re-inspection, this non-compliance issue will be documented as having been resolved. Regarding the Title 24, Section 1231.2.10, Exercise Area, the agency recognizes that each locked individual exercise enclosure lacks the required toilet, wash-basin and drinking fountain; inmates can use a call button if they need to use the restroom or need a drink of water. The assigned deputy will immediately respond to the inmate’s request. The agency understands that, technically, this will not meet the standards as required, but having more inmates participate in an outdoor exercise program outweighs eliminating the individual exercise area. This concludes our inspection report for the 2020–2022 inspection cycle. (e) Supervision depending on level of suicide risk. 10.06 Suicide Prevention Policy Patients/inmates identified with possible suicide ideation shall have suicide safety precautions with staggered 15 minute or direct observation ☒ ☐ ☐ within a safety cell based on clinical necessity and are initiated by the QHP until an assessment by a QMHP is completed.
