August 8, 2018 Bill Brown, Sheriff-Coroner Santa Barbara County Sheriff's Department 4436 Calle Real Santa Barbara, CA 93110 2016-2018 BIENNIAL INSPECTION, PENAL CODE 6031, WELFARE & INSTITUTION CODE 209 SANTA BARBARA COUNTY'S TYPE II AND COURT HOLDING FACILITIES Dear Sheriff Brown: From April 30 through May 5, 2018, staff of the Board of State and Community Corrections (BSCC) conducted the 2016-2018 biennial inspection of the following Santa Barbara County local detention facilities: Main Jail Medium Security Facility Santa Barbara Court Holding Facility Santa Maria Court Holding Facility Lompoc Court Holding Facility Pursuant to Penal Code Section 6031, these inspections were performed to determine compliance with the Minimum Standards for Local Detention Facilities as outlined in Titles 15 and 24, California Code of Regulations. In addition, BSCC staff conducted compliance monitoring pursuant to Welfare and Institutions Code Section 209(f) for the federal Juvenile Justice and Delinquency Prevention Act (JJDPA) for the separation requirements of juveniles from incarcerated adults. The complete BSCC inspection report is enclosed and consists of: this transmittal letter; the Title 15 Procedures checklist outlining Title 15 requirements for each facility; a Physical Plant Evaluation outlining Title 24 requirements for design for each facility; and, a Living Area Space Evaluation summarizing the physical plant configuration and showing the rated capacity of each facility. LOCAL INSPECTIONS In addition to the biennial inspection by the BSCC, inspections are also required annually by the County Health Officer and biennially by the State Fire Marshal or an authorized representative (Health and Safety Code Sections 101045 and 13146.1). Please consider our report in conjunction with the reports from the County Health Officer and the respective fire authorities for a comprehensive perspective of your facilities. We encourage the practice of maintaining a permanent file for historical copies of all inspections that would also include documentation of corrections made following the inspections. There were several non-compliance issues noted on the evaluations. During our inspection it was observed you have corrected most of the issues and developed a corrective action on completing the remainder of the discrepancies. Environmental Health and Safety Evaluation The Environmental Health inspections were current had noted two areas of non-compliance. If you choose to address these issues, please provide the BSCC with a corrective plan. Fire and Life Safety Inspections The fire and life safety inspections for the Type II facilities were current. BSCC INSPECTION Type II Jails Title 15 Inspection – Policies, Procedures and Documentation Our inspection of Santa Barbara County's jails began with a review of the Sheriff's Office Custody Operations, Policy and Procedures Manual. Our audit consisted of a review of only those policies and procedures related specifically to the applicable regulations included in Title 15, Minimum Standards for Local Detention Facilities.1 After the review of your Policy and Procedures manual, we reviewed a sampling of hourly safety checks at each facility and found your staff were performing their checks within the 60 minutes required by Title 15, Section 1027, and by policy. We also reviewed documentation on the use of sobering cells, safety cells and restraints (when used as defined in Section 1058, Use of Restraints) and found the documentation conformed to applicable regulations. Our review of a sampling of grievances and discipline reports revealed timely and appropriate responses. 1 BSCC does not review all policies and procedures. We do not “approve” policies and procedures nor do we review them for constitutional or legal issues. We recommend agencies seek review through their legal advisor, risk manager and other persons deemed appropriate. Sheriff Bill Brown 2016-2018 BIENNIAL INSPECTION SANTA BARBARA COUNTY'S TYPE II AND COURT HOLDING FACILITIES Page 3 Main Jail Title 15, Section 1056, Use of Sobering Cell, establishes the requirements for the use of the sobering cell including the reasons for placement, frequency of safety observations, and medical evaluations. This regulation limits the use of the sobering cells to only inmates who are a threat to their own safety or the safety of others due to their state of intoxication. When sobering cells are used according to the requirements above, we find no issues of noncompliance; however, both in policy and in practice at the Main Jail, when inmates must be closely observed because of medical or mental health concerns, they are held in the sobering cells regardless of their state of intoxication. This was evident on the day of the inspection. The sobering cells are situated in a place frequented by staff so inmates who are being held there are under closer supervision than may be accomplished in other cells located in the facility. Additionally, the padded floor and the absence of a bench in sobering cells could be considered a safer environment. While the decision to use the sobering cells as observation cells is primarily driven by the physical plant limitations, such action is considered noncompliant with Title 15 Section 1056. Title 24 – Physical Plant Inspection Main Jail This facility is evaluated under the Pre-1973, 1982, 1986, 1988, 1998 and 2005 Title 24, Minimum Standards for Local Detention Facilities.2 The facility was very clean and well-maintained despite its age. As the central intake facility for the county, this facility has a BSCC rated capacity of 659 inmates. On the day of the inspection there were 656 male inmates and 106 female inmates in custody. During our inspection there were inmates assigned to “stack-a-bunk” beds located in the dayrooms of multiple dormitory housing areas. As a result of the crowded conditions, we found the following: Title 15, Section 8227, Multiple Occupancy Cells, establishes the standards for multiple occupancy cells. The multiple occupancy cells have insufficient space and an insufficient number of toilets and washbasins for the additional population resulting in noncompliance with this regulation. Title 15, Section 2.8 Dormitories, establishes the standards for capacities of dormitories. Many of the dormitories contain extra beds which are used on a regular basis. The dormitories have insufficient square footage for the additional population resulting in noncompliance with this regulation. Title 15, Section 2.9 Dayrooms, establishes the minimum requirements for the dayrooms of both multiple occupancy cells and dormitories. In those housing modules with multiple occupancy cells and dormitories, there is insufficient square footage for the additional population of the beds added to the dayrooms resulting in noncompliance with this regulation. 2 Facilities are assessed against Title 24 requirements in place at the time of design or significant remodel to the jail area. Sheriff Bill Brown 2016-2018 BIENNIAL INSPECTION SANTA BARBARA COUNTY'S TYPE II AND COURT HOLDING FACILITIES Page 4 Medium Security Facility This facility is evaluated under the 1963 and 2001 Title 24, Minimum Standards for Local Detention Facilities. The rated capacity of this facility is 160 inmates. On the day of the inspection, there were 173 males and 0 female inmates in custody. The female dormitory was closed and was being used as a classroom. However, it can be used for housing if needed. The facility was clean and well-maintained. As a result of the crowded conditions, we found the following: Title 15, Section 2.8 Dormitories, establishes the standards for capacities of dormitories. All of the men’s dormitories contain extra beds which are used on a regular basis. The dormitories have insufficient square footage for the additional population resulting in non-compliance with this regulation. Santa Maria Branch Jail: Permanently closed on July 17, 2017 (closure letter attached to report). Court Holding Facilities Title 15 Inspection – Policies, Procedures and Documentation The policies and procedures pertaining to the operation of the court holding facilities reside in the Sheriff's Office Custody Operations, Policy and Procedures Manual. Our audit consisted of a review of only those policies and procedures related specifically to the applicable regulations included in Title 15, Minimum Standards for Local Detention Facilities. We also reviewed pertinent documentation such as hourly safety checks at each facility. Our review of policies, procedures and documentation resulted in no findings of non- compliance with Title 15 regulations. Title 24 – Physical Plant Inspection The three court holding facilities are each inspected under different Title 24, Minimum Standards for Local Detention Facilities: Santa Barbara Superior Court Holding (1988); Lompoc Court Holding (1999); and Santa Maria Court Holding (1989). Each facility was clean and well maintained. There were no Title 24 non- compliance issues. Juvenile Justice and Delinquency Prevention Act Compliance Monitoring In accordance with the JJDPA, BSCC monitors jail facilities for compliance with three of four core requirements of the Act, Separation of Juveniles from Incarcerated Adults. Minors are not housed at this facility; therefore, no violations of the JJDPA were identified. Corrective Action Plan If the current practice of using the sobering cell as observation cells changes, please advise us and we will update our records to show compliance with Section 1056 Use of Sobering Cell. With respect to the Title 24 non-compliance issues, if the population of any of your facilities reduces sufficiently to stay within rated capacity, please notify us and we will reevaluate these non-compliance issues.
